Assuming that I got my EAD, and then my I-140 got denied for whatever reason.
What happen next? Will i be out of status? do i have to leave the country? if i'm F-1 student will i be back on F-1?

Yes.You will be out of status unless you moved into a different visa like H1B /H4 (if you time left on them and able to get in the quota) .

I requested IV to help us on this just like how IV did for the EAD cause. We all appreciate how much IV has done for us and helped in getting EAD renewed on time for so many people, may be this is something that they can take up. Here is Pappu's response for my request..

I agree with most of the posts here ..there have been lot of ideas but everyone needs to be more serious ...IV core has to come up with a new campaign. ultimately the question is do we wait for something to happen or do we try for make things happen ..

it does not matter if you are a homeowner or not ..just participate (USCIS is not going to double check) ..there will be awareness that USCIS is broken just like Brown's FEMA (the person who was in charge during katrina fiasco)...and maybe USCIS will come out with facts. ofcourse some backlash is to be expected since we waited for too long and now we are in recession !! (also Obama is not going to do anything on his own so soon as he has major major problems to solve first)

I agree with your idea. But time might not be ripe. I'm not sure how we can get attention for legal immigration when the economy is so bad. This is like a downtime. We can use this time to strengthen IV as an organization. We need to prepare for war (activism) when there is peace (downtime). I agree with Pappu, we need to spread the word of IV as much as possible. I've to go beyond my friend's circle as most of them have a GC in hand! :D

My company lawyer addressed this part. The way it works is that they will work on your file only when your PD is current. So even if you apply now, they most likely wont work on it after July as your PD wont be current. Then when next time (say in Jan 2008) when your PD becomes current, they will pick up all the files for that month and start working on it. It might be that they will work on your file on Jan1st or Jan 31st. You can send your wife AOS the moment your PD becomes current. So you want to make sure that it reaches there before they approve your AOS. In case you are extremely unlucky, then they would start working on your file on 1st day of the month and finish it before end of that day, making it impossible for your wife's application to go through. Thats rare though. So if you can make sure that her app reaches on 1st day of the month in which PD is current, then they should most likely add her to your AOS and work on those together and make your life go forward....its a chance which you will be taking...But again life is a chance

With the May 09 Visa bulletin out, it should now be even more clearer to everyone that there will no progress without coordinated action. This poll shows there are at least 40 people who are interested in doing something to make a difference (thanks to those who have participated so far). Of course, I cannot believe there are not more people out there who want to step forward and make a commitment towards achieving their goal!
At the same time, I am really surprised by the lack of response by Core as well! Maybe there are not enough people in Core to be going around posting in these threads, but isn't that a problem?? I am even more convinced we need to meaningfully expand the Leadership organization and involve more people in order to move forward. It's not realistic to have the same people running around trying to do everything but it doesn't have to be that way.
Core team, would appreciate a response.

The AP is truly an amazing conundrum. I will try to clarify.
1. When AP is filed, you need to be in the US. No if's and but's about that.
2. If AP is used at the border for entry, it DOES NOT invalidate your H1. Only using EAD to switch jobs does that.
3. Lets assume you have an AP valid till Jan 1. You apply for new AP on Oct 1. However, you need to travel on Dec 25. Now there are two scenarios:
3a) you return on Dec 30 - you can use your old AP as it is still valid. The fact that you have applied for a new AP and left the country DOES NOT abandon your new AP because your old AP is still valid.
3b) You return on Jan 3 - You need to have the new AP in hand.

People who left employer early or want to leave early will say it is ok; because it suits their needs.
People who plan on staying later or don't have any intention of leaving early will say to stay.
Bottom line is it is upto everyones own risk tolerance. I have just seen some of the biggest cowards in terms of immigration all of a sudden get so brave after they got the greencard.
If people are waiting years and playing it safe then what is the possible harm to wait a little longer and not get riled up by every small story of someone who got questioned at citizenship time, etc.
Immigration laws don't change very often; however, uscis interpretations and memos do change quite frequently. When you have to start hiring lawyers, go to court, face uncertainty then we'll see how brave people are.

Whether to leave my present employer or not has become a big question as my employer has decided to transfer me to another location in less than a month's notice which showed lack of consideration to the welfare of their employees as they're not only doing this to one person but a lot others too.
My greatest concern now is if leaving my employer would have an implication on my wife's pending AOS.

I have been trying to know more about that university and until now I did not hear anything bad about the university except that the univerisity is Nationally accredited university. I am trying to know whether USCIS accepts Masters from Aspen University. Please let me know if you have got any information regarding this.

I'm a little surprised here.
The long wait for the GC is an age old issue. I know folks who came here in the 80's and 90's and went through the same issues. There were brief periods when the process did speed up .. but by and large it has been the way it is.
Lawmakers can say .. 'oh I did not know it took 7 years to get the green card." But I find that tough to believe that no one knew this until we went and said this to them? (h1 quotas get extinguished in a day .. and everyone knows this ..
The situation is still the same. CIR also puts out there .. the need for Immigration reforms. So pretty much everybody out there knows what the issue is. Now what can we do to make them move on it quickly.
I agree that getting together educated folks is difficult .. since they have no Union (like workers) and are not as close as blue collared folks. And that's the main reason why an illegal immigrant rally can get a million people on the street .. whereas a legal immigrant one gets in a 1000 people or 2000.
To summarize:
1. I think people in concern know that the immigration process is inefficient
2. Unless there is sufficient sustained pressure, nothing can change.
I would say this .. the question is this ... how can we get a huge rally going in key cities in successive weeks, so we get noticed and we can send across a stronger message?

With the continued success of the high skilled community to create more awareness for Employment Based green card backlogs, Immigration Voice will hold Advocacy Days, Press Conference and Congressional Reception in Washington DC on 7th June & 8th June.
Every member must participate in these Advocacy Days events in DC. Congress will be back from Memorial Day recess in early June and there will be a fresh look at the Comprehensive Immigration Reform, which includes high-skills immigration.
After having favorable consequences from our past effort, it is now time to have a bigger event in the front-yard of Congress in Washington DC, so that the long ignored issue of visa backlogs (retrogression) is addressed. This event will be hugely consequential as it will help our issues get much more coverage in the media and much more attention of Congress because of 2 reasons: It will be a really big crowd and secondly, it will be in Washington DC. Immigration Voice will arrange for meetings, advocacy material, and other logistics necessary for all the events during the Advocacy Days. All you have to do is show up.
Please plan to take two day off on 7th & 8th June to attend these events. If you do not live within the driving distance of DC, then there is ample time for you to book travel by air or by train ahead of time. 7th & 8th June is Monday & Tuesday, and if you book your travel and accommodation ahead of time (and there is plenty of time still) then you can participate with minimal expense.
Immigration Voice wants to do something as consequential as the flower campaign and the San Jose rally but only this time, it will be much bigger and much more consequential aimed at Congressional action on immigration reform to address visa backlogs and broken system of high-skills immigration. We aim to resolve this issue but we cannot do it alone and therefore it is imperative for everyone, and by that we mean EVERY ONE to show up. If you wanted to be a part of the past events but couldn’t, then now is your chance to make your voices heard and fight for a fair system and just process.

Absolutely wrong. Lot of misinformation here. You can very well apply for OCI for your child even if both of you are Indian citizens and the 4 steps mentioned above are just wrong. I would prefer OCI over PIO as mentioned in the other reply too, on PIO your child will have to register with the police station evry six months if stay is longer. OCI is valid forever while PIO is valid for 10 (or 5) years and OCI means you have all the rights but can't fight elections and vote.
In 2005 my first kid got an OCI as the rules were diiferent then but in 2009 the current rule is that one parent MUST be a US citizen and I had to take a PIO for my second kid in 2009.
Following is from the FAQ`s of Indian consulate at SFO
6. Are minor children whose both parents are Indian citizens eligible for OCI?
No.

Folks,
For NRE account, you can easily send money to india and then repatriate it back. But in my case I have money to my NRE and bought an apartment. Now since i have sold that apartment, that money is in NRO account which is a one way account. You can only send money to NRO but you cannot get that money back in dollars from it.
Talking about getting money thru travellers check, you can do that only if you go to india and come back here in US with it....since you have to sign it at both places. Also there is a limit of $1500 for TC's when you come from India. Limitations....limitations....limitations.
If we send money to India for investment purposes.....all you will get is LOSS.
I started a business in India....lost lot of money in India becoz ppl in India do not want to trade honestly......bottomline......if you want to stay in US,,,,dont send your money anywhere....use in US and enjoy that money !!!
