That's what i'm trying to figure out. Won't it be a headache for the lawyers then how they will defend themselves ? Its not my/our Job to go after them and ask them to follow up for USCIS errors - Isn't it ?

This article is depressing, but this could very well be the outcome and the house speaker has proven in the past to do what he says he will do. I would not be surprised if Diane Fienstein who is continuosly pushing the illegal immigrant issue beyond what even moderate republicans can accept will be a sure way to get the whole bill gutted in the senate. So here are my concluding remarks on this topic based on logic life's answers...
Short sale and foreclosures should be no different from buying a regular property, downpayment wise and loan wise.
But it could take longer to close and you may have to spend some money upfront for inspection which you may loose if the bank does not approve.
Do foreclosures have to be approved by bank too? I know the short sales have to be.

Regarding AC21, we make our own decision as each of us has different circumstances.
Some are already contented with the current employer (petitioner) and don't want to join another company. They do not need AC21.
Some are not really contented with the current employer (petitioner), but don't want to take the risk of using AC21. Let's respect their decision.

I don't get his case any way. How is going to cliam back pay if he never worked for this employer?
He researched a lot of forums and consulted a few contingency lawyers and gathered correctly that Employer is ultimately responsible for Employee.
However there is a wrinkle to his situation.He stayed with friends/relatives. Employer is not notified. I am not sure if the lawyers he spoke to understand this or not.
The only possible way to make a case out of it is by saying that the employer has been notified.
He is already in trouble. I think he may get into bigger trouble by misrepresenting. As he is desperate he may not be thinking it thoroughly. May be I am over thinking it but just wanted to see what others think.

The job I'm doing is advertised as minimum Masters requirement....exact wordings :

responsible experience in lieu of a Masters/equivalent and 3 years of
experience. Will also accept 7 years experience in lieu of an
MS/equiv.+3/BS/equiv.+5"
I qualify against the 7 years experience qualification...applied for my PERM recently.. My questions are
1. Do I qualify for a EB2 or a EB3 ?
2. As mentioned in this thread, even if I'm through with the PERM, can my I140 get jeopardised due to this qualification mix-n-match in future ?
3. If so, is there a safer way of dealing with it ?

Now that we know she did not report to work, yes, the employer is off the hook. The onus though is now on the employee to maintain her status because she has an I-94 attached to her H-1b approval.
It is not always employer is 'abusing' the system, sometimes 'employees' too directly or indirectly. Honestly, gopudeep will not report this to DOL or USCIS. BTW, employer will not be in trouble because gopudeep did not report to work and the employer can get off the hook easily.

such admin posers should be banned but why are u posting such political opinions anyways this is not a forum to discuss politics it is to discuss immigration policy issues and problems.
even if u remain anonymous your comments will be posted on a public forum which is created for a certain purpose and you might undermine its effort.
i think it is time to recognize that being such a small minority with above average economic status every single of us is representing the whole community. both parties agree on immigration reform which will help us. the only major opposition to our cause is from few groups posing to represent american technology professionals. whether ur ideaology is liberal or conservative is of no importance to immigration matters.
i see lot of posts of all kinds even for ICICI bank!! but political comments are a PR nightmare.
IV can put a disclaimer that whatever is posted in forums is not its own opinion but ur doing a damage to IV check out opinions of dailykos and other liberal blogs they are not taken kindly by conservative media. go discuss politics on politics blogs.

Why not have dedicated paid IV attorney instead of volunteer attorney who advises the members on issues. IV members could chip in to pay for the attorney(s) for this purpose. May be have one attorney for each region of west central and east. I could chip in too for this purpose.

Initially came on F1 and then H1B and staying on H1 till to date.
PD May 2006 PERM Regular process
I140 approved on August 2007 Regular Process
I485 applied on July 2007 with receipt date on August 2007 for both me and my wife.
My I140 did received RFE and employer replied promptly with proper tax documents and got approved in a week after USCIS received documents.
I485 applied on July 2007 for both me and my wife along with EAD only but not AP for the first time. Applied for EAD and AP second time and received both without any problems.
I have used AC21 (employer sent AC21 letter to USCIS after a month of joining) after almost a year of my I140 approval and joined my client company in the same position with same job duties and client company processed H1B for me and H4 for my wife and got successfully stamped in India during December 2008.
Wife working on EAD for a different employer at the same location.
My questions are
1. Did anyone in EB2 with 2006 PD notice this kind of behavior?
2. Where will my RFE be sent? to my new employer lawyer or to my old employer lawyer?
3. Can anyone guess what might be the reason for RFE?
I will update the post as soon as I know the exact details of the RFE but meanwhile wanted to know what might be the reason and wanted to ask expert opinions on how to proceed further.

My company applied my I140 May 16, 2007. It is still pending because of background check.
I140 should not be pending because of background check. I485 requires Background check.
I applied other I140 from different company with Jun 2008 PD got approved just in 4 months but this one got stuck because of background check. Some one please throw some light on this and suggest some action items for me so that I140 can approved sooner. My pending I140 has PD June 2004.
Please help me I am frustrated with long wait first 3 years for labor backlog now this new I140 's more than 2 years wait.
