I don't think anybody would call their lawyer everyday to get the status. Even if he calls him everyday, It is not appropriate to charge him for just an email reply.

It happended to me too, in 2005. They had just published memo for this.
Your lawyer should have requested 3 years extension and I-140 should be approved and copy attached with application. We did all that still they approved for 1 year, my lawyer called up USCIS, we got hold of the approving officer, he asked why extension is needed for 3 years, you can reapply for 1 year ? and refused to do anything else.
We filed a motion to reconsider (it has a fee of $385), with a letter explaining the situation and also attached a copy of USCIS memo and Visa bulletin. I did that and they approved it for 3 years and sent me amended petition.
Do you know any official documentation which shows that H1 Extension will be for 3 years if PD is not current at the time of Filing and not at the time of approval.

I don't know how they are going to search. Suppose if one person has a name which is common ..for e.g say Amit Joshi or Amol Patel. there will be hundreds of those guys on google. Which one they will know is the right person?? There may some thing more to this. May be they will collaborate with google to pass on the info ..like the info which we entered while shopping using google checkout.

If you are using your EAD, then there is nothing you have to do. If you are on H1, then your employer will have to file a new LCA indicating the location change and probably an amendment to your current H1 indicating the same (I am not sure about the amendment)...You can check with a lawyer...

One of the IV members contacted me today about his/her 485 denial (happened yesterday) because of employer revoked the 140. Folks who are assuming that its not that common issue, please rethink. Its getting rampant now a days. So please please participate in this campaign and send the letters. My friend just found out she's pregnant. She's currently on H4 with approved I-140 and waiting to file I-485. She doesn't have medical insurance and neither does her husband. They can hardly afford insurance. If they apply for medicaid will it effect her GC when she file I-485? They don't want to do anything to jeopardize their GC process.

I had a hard LUD on my case on 8/20. It was because they uploaded my biometrics to NSC system. Nothing after that till Sept 30 when they approved the case.

I agree with Hendrix. It is a simple straight forward question and also the reality. What can of worms will emerge out from this?
The CIR dragged for almost two years and I dont think it is going to bring any joy to any of the members who have been following it for the past two years. Our experience with CIR shows that it is a catch 22 situation and it is only for politicians to gain political mileage. There is nothing in that for high skilled immigrants like us unless it is passed which I dont think is a cake walk. It is going to wag it's tail and it will be scapegoat for US politicians for the next election. So do not get over excited when you hear about anything on CIR coming months.

If AILA is so powerful, then how about 900 of the richest corportes and universities in America ? Inspite of that they have failed to get the cap on H1-B scraped for the last 4-5 years. And yet, inspite of being "powerless" IV managed to get so many favorable clauses attached in the CIR managers amendments.
America is a democracy, and because our cause is just, we CAN be successful if we do a good job of educating the lawmakers. If corporate interest was the only thing that worked here, then you wouldnt have any environmental protection laws or any other laws that hinder the profiteering of the big corporates. If we want to settle in this country, we got to have some basic faith in this system.
If you think AILA is all-powerful and influential you are terribly mistaken.
You should meet some of people in DC's lobbying circuit and you will get an idea of how "powerful" AILA is.
Talk to anyone in DC in the lobbying/advocacy business or talk to some lawmaker's staff. They will all tell you that AILA is a toothless tiger. Getting on 20 radio stations is not a big deal. IV was in 400 radio stations a few weeks ago...if you dig thru forums, you will see.
But, you have to agree that AILA is more powerful than IV because they have rich lawyers as their supporters. We are just a loose-knit group of non-immigrants trying to become immigrants. AILA has funds in the millions compared to our few hundred thousand.

You don't need to scratch the orginal denial letter. There is a better way. Take a photocopy of the orginal, black-out sensitive info with black ink, then scan this photocopy. That way Original letter (if needed for future) isn't damaged.

These updates are crap. People who applied in mid-June are still waiting for their checks to be cashed whereas some who applied in July got EAD's. No friggin FIFO.
