Dear IV please help .
Could you please help me decide about my next course of action, I believe my I-485 is wrongfully denied.
My case details are as follows:
1) EB 2 India ,priority date November 2004
2) I -140 approved in 2007(employer A)
3) Filled 485 in August 2007, changed employer after 180 days of filing I-485.
4) Got RFE in 2008 august(for EVL),responded back with all the documents from the present employer.(employer B)
Received email from CIS "RFE recieved and case process resumed "
5)Renewed EAD for my spouse.
6) Approved I-140 status changed to pending in May 2009.
7) Later renewed my EAD in June 2009 with out any problems
8) Came to know that my 140 was revoked in May 2009 by employer A
9) Received I-485 denial notice in August 2009 stating the reason"485 denied due to revoke of underlying 140 by employer A."
So now iam filing MTR with the help of attorney .
iam depressed,last year when my PD was current i missed the window ,now iam afraid again i will miss the window.
what should be my course of action apart from filling MTR,how much time it will take for my case to resume pending status .
What are my chances of getting approval this year.
Gurus please advice,.

Then I believe what I was thinking is correct. The lawyers are trying to milk me twice .... first to extend only till Apr 2008 & then once again for filing beyond Apr 2008.

Hello everyone,
I just was about to be relieved thinking that my lawyer mailed the I-140/I-485 package yesterday. Its not over yet.. hmm.. Today I check the Express Mail USPS tracking system and it says the following
Notice Left, July 26, 2007, 11:50 am, MESQUITE, TX 75149
Arrival at Unit, July 26, 2007, 9:22 am, MESQUITE, TX 75149
Enroute, July 26, 2007, 3:17 am, DALLAS, TX 75260

Why would USCIS not accept my packing by 11:50 AM on a Thursday. This is getting me worried.
The application will surely have to be accepted tomorrow (Friday) else I will be in a big soup. Tomorrow is the last receipt date wherein you can pay the old I-140 fees. Starting Monday (30th July 07), the new fees get into effect for I-140 filing.
Did anyone have similar experience?? Please give your feedback.

Package got delivered the next day - ISSUE RESOLVED!
Moral of the Story: USPS Express mail does not always deliver the mail the next day. It might take 2 days.

Current Imiigration status:
Worked for compny A almost 5 years. Company-A did labor, 140 and 485. 140 approvd and 485 pending over 2 years.
Last 6 months working for company B on EAD. Didn't do AC21. Good relationship with company A and they will never revoke approved 140. They will help if any issues come in future.
Have approved H1B for company-A since dec 2010 and stamped in passport.
My questions:
1- If 485 get denied, can I go to company-A and start working on approved H1B
2- Also, can I use approved 140 at company A (even 485 denied, since not working at A) to extend H1B for 3 years.

Your questions answered.
1. Nobody can guarantee anything when it comes to USCIS. R-1 visas are now undergoing a lot of scrutiny and inspections of the prospective employers' premises. So, no one can say for sure if the visa will be ready by August.
2. To file in the family-based category yes you will have to submit form I-130 in addition to I-485 adjustment of status, I-765 application for employment authorization and/or I-131 application for advance parole.
On another note you may find more help and assistance on other forums that are focused on family-based immigration. Here our focus is employment-based immigration. I am able to answer your questions because I have personal helped relatives file family-based immigration forms.

I got this email from CRIS and online status also changed to reflect the same. But I haven't received any letter. Looks like few other people received the same. Wonder why USCIS keeps throwing these teasers.

Assuming no bill passes, ur PD should be current in 1.5 to 2 years. ( just My guess )
Any kind of Labor and I-140 process will take 1.5 years assuming no audit + $5K in attorney expense.
May not be good choice..

The above application or petition, along with any check or other form of
fee payment, is attached. The application or petition cannot be accepted
because the proper fee of $1010.00 U.S is not attached. Since the case
is not properly filed, a priority or processing date cannot be assigned.
Please attach a check or money order for this amount and resubmit this
entire package to the address listed below. To speed processing, please
leave this notice on top
Did anybody get a rejection and if you did the rejection match the one I have on here? Can anyone interprit if this is for a incorrect check or missing check. If its for a missing check, do you think i can resubmit?

I think its normal, there is no need to worry. It is not compulosry to have an LUD on your case. If I were you I will wait for couple of weeks and give a call to USCIS.

Since USCIS has pre-adjudicated all these applications, it should be fairly straight forward for them to publish a waitlist (category wise and PD wise) for assigning visa numbers.

Yes that is a good idea. We are already doing this in Tri-state and would be better to have one for each state for Senators. For house reps, they mostly prefer meeting their district residents.
Some states may not have a chapter yet, if so please mention and we can create a new State rep, based on volunteers there.

Not received any FP notice on my I-485 yet and talked to an IO last week using POJ method and the lady told me that I should received FP within a month.
There is no update in the online status check which I guess means that they have yet not sent out my FP.
Should I call again about this case?
I have already tried several services requests and Infopass appointments and nothing has worked.
I don't want not having FP notice to go against my case; My PD is current now.
Is there anything else I can do besides waiting ? Thanks for your time.
