Hi everybody,
I am a dentist and have come across the following situation.
I was working with this dental company for about 1 year on H1b.On 6th Aug I fell sick with acute shoulder pain and went to a doctor who adviced me complete rest for atleast 1 month.I sent doctor`s letter to my employer stating that I need complete rest due to this pain and would join as I felt better.Now last week I got a letter from my employer stating that my job is terminated as they have closed down the office where I work.I also had a contract with this employer that termination needed 60 days notice from either side which was disregarded.Now I have a feeling that my employer may cancel my H1b visa also.What should I do.I was on sick leave without pay and now I am without job.
Any advice.

You don't need to scratch the orginal denial letter. There is a better way. Take a photocopy of the orginal, black-out sensitive info with black ink, then scan this photocopy. That way Original letter (if needed for future) isn't damaged.

We know that EB2 is getting stuck in EB3 because of PD porting. I request you EB2's not to procrastinate and send the letter in the next post to the USCIS director. You may mail it with or without your contact info and stop this illegal practice.
Pls do not be lazy to mail this letter. It will save atleast 5 years of tension in your life. If you think others will mail for you are sadly mistaken. There were only 3 letters till today. We need 100 letters atleast to be mailed to the director.

Hi all,
Instead of not going to work we will all work 24X7 while fasting. I think that will be a very effective tool and it is my humble opinion.
Let us fight this injustice with non violence and make mahatma feel proud of us for following his footsteps.

Are you sure, they are going to pay you less than in LCA? If yes take one check with lesser amount and complain to labor dept. Also move your H1B to another company. They can't complain against you. They breach the agrreement with you and labor dept for the salary, if they cut your pay. So you have a case against them.
If it is yearly rate, he can pay you $1 for each paystub after the amount mentioned in the LCA. He need to pay you for 12 months.

This is really comforting to know. The only issue I can see here is that we don't know how long will it take for the I-485 receipt to come through. Given the volume of cases that will be filed in July, sending out I-485 receipts may take months and if you have to travel before that, what would you do.
Is the I-485 receipt absolutely necessary for H1/H4 stamping or is that something nice to have?
My husband is currently in England and got his H4 put in his passport last week at the London consulate. We filed AOS at the beginning of May. So he is travelling on his H4. He assures me it was very straightforward. Showed receipts for I485 etc and it went smoothly. NO advanced parole.

Let me clear it up, I recently bought a house and I guess the way you are approaching your bank is wrong.
First of all, Your status is NOT EAD but I-485 "Pending Adjustment of status".
If you tell any bank, I am on EAD there is no such status and hence all confusion and problem you are running into.
EAD may be used to show your employment authorization during your I-485 is pending.
So change your story to the bank and you will be fine.

When you came here on H1, you were threat to other GC holders.
If so many H1s are on bench, there is recession and all that, why don't you go back and give another person a chance?
You want all the benefits for yourself, you want GC fast, but you don't want others to come. Hypocrite! Selfish!!
He is not voting to discontinue the H-1 category. He is questioning the need for more H-1bs.
If you really want others to come like you said without relation to the number of available jobs here for these people who come in, then you should technically be willing to take out the quota limit for H-1b and any number of people come in. And why stop with skilled people? We should have anyone -skilled or not - come into the US at will. We don't care if they can find jobs and what will happen to them after they come in. We just want them to come inside the US, period.
Do you really see the American American Government thinking this way and opening their doors to everyone in the world without restrictions? What do you think will happen to the economy here?

The above sounds correct ..but then as people lose their jobs and are forced to leave ..you need to ask the question ,,..do I fight and try to get a gc or do you leave just like that with a question haunting you ..that you should have done something ??
my feeling is that USCIS has become extremely strict ..they will refuse as many GC's , 140's, H1 extensions as they can ..(at the same time they will be greedy and try to accept as many applications as they can to collect the fees).
also the trick is to show that immigration reform in small measures (like recapture) will actually help ..as immigrants who get GC's start spending their savings in buying new homes, cars, furniture etc

After EAD comes, it might be possible to do MBA full time. But make sure that you have future job offer ready from your sponsoring employer.
I am doing part time MBA ,maintaining my H1-B. I figured it was too risky to leave job and study full time. There are no guarantees that my employer will keep future job offer.
I am in the same boat. I'm planning for Part-Time. Most of the top rank schools do not offer part time, only E-MBA.
Both (MBA & GC) are important to me.

Because there is nothing in life that is strictly FIFO.
Just as success in life is not always connected to your education, hard work , reputation , dedication , knowledge , wisdom , truthfulness , steadfastness or any other virtues.
There is some unknown quantity , some people call it luck , some call it God's grace , some people call it just being in right place in right time.
So just take it with a pinch of salt and suck it up. Save yourself from blood pressure :)
Participate in the rally if you are willing and able to.

I have been and have seen other people crtical of the country they were born and brought up in..But I have never seen such arrogant, ignorant and selfish comment from anyone.
I dont know from which countru you are from.
I am from India and was brought up in that culture and i will be proud of my home country and is not planning to change the ways I was brought up in for the rest of my life, even it means getting citizenship or staying in an other country.

once recession hits, there will be very little political support to end retrogression - it would be considered politically incorrect. In the worst case scenario, they could even reduce the gc bucket, just like they do with H1Bs
Actualy there will be a recession for sure by next year. Whether Govt fudges teh GDP growth numbers to come up with a mild sluggish growth or mild recesion like in 2002 that i cant say
