Yes, I agree. You plan your travels based on your past experince and then you find out that the whole things takes weeks. I am glad it was only 10 days wait for you. Some of the threads on the indian consulates delays have stories from people who have waited more than 3 weeks. :(

I did my MS Comp Science from US.
The International center there makes a massive pain in CPT
regarding the clause "CPT has to be part of your education"
MBA in Finance area elective will help in long run.
Anyway if you go to India (not an impossible outcome given the greencard situation) without an MBA and just an MS, you will be severely handicapped
professionally. India management culture wants an "MBA". Without that career growth is
exremely slow. It will many years of experience to reach teamlead position in an IT company but with 2 to 3 years after MBA you can get that position.
The glass ceiling is very low in India without an MBA.
India produces massive number of Comp science Graduates and salaries are low.
You need an MBA in India for career growth.
They wont value ur MS. If you cant afford an expensive MBA do an cheaper one in US or Canada (Ryerson in Toronto or York univ).
Canada one you can apply for PR and once you get Canadian citizenship, you dont need to worry about H1B as ou can work in TN1 visa

Morrally employer will charge if you just graduated from the university. Employers can't pay for people who are working on high percentage and who don't care for them.
Since they have no clue when u will leave, they might have charged u
I worked for a fortune 30 company who sponsored me. But when i left with in some time, i paid legally 4000+ $ for the employer as H1 B expense which DOL said it is OK.
Ur employer can show some tricky things.
Also , he has blessed u anewlife with H1B and would have provided lot of benefits like training, accomodation, some addl stuff.
U should be thankful to your employer. If everyone reports to DOL about employers, then we Indians, called Desi employers and we all of us will go back to india and there no more GC Backlog
Zeroes, becareful while reporting to DOL. U might have done some things which can count against you if your employer wishes.

We all know that so many people are stucked due to this backlog and inefficient system. Some of them have spent over 5 years (counting from priority date) waiting for the green card. It would be worse for these people to wait additional 5 years to get their citizenship. I believe it would make sense to reduce the waiting time for these people by counting 5 years from their priority date or something of that sort. Would it make sense to work with senators and congressmen to have some kind of ruling on this front to ease this pain?

I got my H1B transferred from company A to company B as I got laid off from company A around 4 months ago. I got my H1B transfer approved but with a I797B (no I94 attached) instead of a I-94A. I already have a visa stamped in my passport from company A. Company B wants me to leave and reenter USA before starting to work for them.
1) Can I go to Canada or Mexico instead of India?
2) Do I need to get another visa stamping or lust re-entering US is fine?
Please help.

You can use the H1 if it was approved within last six years. Lawyer is correct. You do not need number from 65,000 cap and can start working immediately since it was approved in 2008. It does not matter even if company has canceled your H1
Only thing I have add is you have to do H1 transfer again.

cooolvick: Having a "PCC issued for Canada immigration" stamp on your passport will not create any issues. If you do not want any one to know that you have applied for Canadian immigration then ask your parents or relative to apply for PCC at local police station.

I recently filed I140 premium processing for a labor substitution case. There was a simple RFE (ability to pay), which was responded to and we got the I140 approval in a month.

Although technically she is in status as long as I94 is valid, It is a gray area if there was a mistake on I94 date.
A friend of mine got I94 validity for two years in excess of his H1 validity period at the port of entry. The officer wrote JUL 2007 instead of Jul 2005. Although technically he was in status until then , lawyers filed for extension before Jul 2005. You don't want that come back and bite :)
Error at POE does not change the fact of matter.
The lawyer did the right thing because in fact the validity of stay is only till Jul 2005 and not Jul 2007 (error at POE notwithstanding).

I think EB2/EB3 does not matter, what matters is if your I-140 requesting for replacement should be current based on this memo for interfiling.

More funds will allow us to lobby more.
Lobbying more, in due time, will increase our chances of success. (See my signature :) )
There was another thread in which someone had put together flyers. Could they, or others, please put together flyers and slides and what not, targeting EB-based immigrants. Thats right, lets put together a campaign to reach more and more of OUR people to tell them that (a) they got a huge problem with their greencards and (b) that their only hope is not USCIS, but legislative action and (c) there is an organization that is working with senators and congressmen(women) to get laws passed, and needs more members.
Market your case to your people. Lure them in.
Its good for them.
