you talk to any attorney. Prepare yourself and write down yours questions in a piece of paper and at the same time have some background information handy to shoot back if they B-- s---.
Beware of this practice attorneys, they tend to keep talking on and on and on, you have to interrupt and be smart and go to the next question. DON'T be a Listener!!!!.

Hi guys,
My I140 got denied based on the three year degree we made appeal against the decision but also starting the process all over again.
I have contacted three attorneys and all of them gave different opinion the new filing, I want to consolidate all thoughts before moving forward with the application.
Please suggest what would be the best draft for education requirement for degree with math, physics and chemistry.
Your input is highly appreciated thanks in advance.
The educational requirement is determined by the job and will be included in the advertisements for the labor cert.. You just have to fit it and it has to be filed in the correct employment based category.

Kids (< 14 years) are required to go through finger printing without paying any fees. That was the answer from lawyer. We did not pay any fees for kids finerprinting and ofcourse we have got FP notices for them as well.

what about the IRS form? Should I file 1040 or 1040NR? I noticed 1040 wants her SSN for joint filing and on 1040NR I don't see any provision for joint filing.

Here is my situation. eb3 labor/gc process started in dec 02.
married in 2005. applied for 485 in june 07.
wife has been in depression since march, and recently psychotherapy sessions have revealed that its a case of "hidden personality". she is not interested in marraige/family life and wants to pursue a strong career and be independent. Since she has had a previous "self mutilation" incident in life, psychiatrist is advising me to let her go or she could spiral down more into something more disastrous.
problem is, her family is not ready to accept this and they just pushing her to rethink, make it work etc. so wife doent want to go back and wants to continue to live & make career in US. Due to difficulties with getting H1 nowadays, im ok with keeping her dependent till GC comes and then think of legal seperation (divorce in india / US -whatever is needed). Since she seeks independence she is guilty to take my gc, and i think she will try her best to get herself a h1 next year. but i dont know where this will end.
after GC, if there is seperation will derivative spouse get to keep her GC? is there some standard "soaking" period during which she cannot untie the relation. ?
Pls advice.

Your wife needs your help so help her. Don't let her go. Things like this happen. You both take a walk every day. Take few days vacation every month. Talk to her as much as you can. Admire nature. If she wants to do something on her own, let her do. You support her. Make sure you don't put your name in it. Let her be the entity of everything. Things will fall in its place.

EB3-I should land somewhere in range of Oct-Nov 01 range. Based on the data release from USCIS. EB3 Movement Tracking - Immigration Wiki (http://immigrationvoice.org/wiki/index.php/EB3_Movement_Tracking)
If we compare the numbers between the Jan 30th and March 1st pdfs for EmploymentDemandUsedForCutOffDates, we can see that the number for EB3 India has gone down by only 50 (from 1050 to 1000). If the monthly quota is 2822/12 = 235 visas per month, not sure what is the logic in only handing out 50 visas in the month of Feb! Based on this logic who knows if the date really lands in Oct-Nov in April bulletin... thoughts???

IMHO, this will show the govt. that we are willing to fork over more money. They will just raise the fees and ask for premium processing.
H1B is unlike GC, in the sense that not everyone may require premium processing. But in the case of GC, everyone would want it.
H1 getting a transfer or those who do not have a problem with waiting do not pay extra.

The problem right now is that the fees USCIS charges to process our I-140/I-485 applications come nowhere close to the costs they incur in adjudication. So I don't see the problem in paying a few thousand dollars to get my GC in 3 months. If that is what it takes to get USCIS to allocate the resources, so be it.
I value the timeliness more than the money. I am sure there will be people who would prefer to wait a couple of years than pay the premium (those who just started on H1 or those who are in secure jobs). This is simply giving customers a choice of service levels: think first-class vs economy seats on flights.

Hi guys,
I have recently moved to Houston from Chicago. I am still not completely settled here but understand the importance of making the state and local chapters stronger and bigger. I have sent a joining request to the TexasIV yahoo group and will try my best to contribute as much as I can.
My humble request to all IV members is to please join their own state/city chapters. This is the first step in becoming a stronger "grassroots" movement. We should all try and contribute in any manner that is feasible - time, money, energy, awareness, .....
Finally, my request is for everyone to stay positive, and start believing that getting the Green Card and making this our country will be great; however, if it does not work out, then our skills and competence will be appreciated anywhere in the world, including our countries of birth.

but the issue will not resolved, since no one care except us. CIS said it was FBI's problem and everyone has to EAD,AP renewal every year(over $1000/person). Lawyer also get fat fee on this too.FBI don't care these issues at all, it also good excuse to get bigger budget.
Here is we may can do: Ask CIS issue temporary green card which will be renewal yearly(cost will be the same as AP+EAD) if name checking was pending 6 months or 1 years.
Temporary green card was the same as permanent green card except one year renewal. so we will get green card and INS still get their money.

this bill is not yet dead guys. Dont think Kennedy and friends are going to give up on a potential 20million vote bank so easily. this will be back... Also, the final vote was apparently 46-50. So in the course of a few hours more than a dozen senators changed their vote! This can only be more encouraging for supporters of the bill, they are almost there...

fromnaija is 100% correct. my friend had applied for I485 in new fee structure and he also filed EAD renewal without paying any fee and got approval. In fact, I only suggested him to not pay any fee. When he called USCIS, they did not give proper answer. It is very well written in the instruction of EAD form so I suggested him to not pay any fee and file.
