you can get the transit visa at the dubai airport. just ask at the customer service booth. they will guide you to a travel center, where the person making the hotel reservation will sponsor the visa for you. The hotel actually sponsors the visa. it will all be done in less than an hour.

Not true! I have S-Corporation without GC. Actually you don't need even filed GC to start S-Corp, all you need is social.
You are right, I confirmed this with IRS. Who can be more accurate than IRS :). So yes you can register S-Corp on EAD or even if you are on H1B.

I-140 Approved 2 Years back and received "I-140 Intent to Revoke" last week from USCIS.
In the letter they mention that " In year 2006 I failed to provide Client letter during H1B Visa Interview at US Consulate".
Real fact is I never attended US Consulate for H1B Stamping in 2006 or after.
So, what are the options for me (Appeal/MTR)?
Can I take Fulltime Position with other company in this situation by using my EAD?
what are the sucess rate on my case.

Check out Fedex tracking number one more time if that was actually delivered on or before Aug 17. If it is your lawyer should have a print-out of that and send it along with your 485 application to USCIS with a yellow sheet mentioning it's a re-submission.

Hi, as per my thread title, I was wondering if I have to use my lawyer for the EAD renewal process. I am confident I know what/where/how to file the application and the materials necessary and because I am a little strapped for cash I'd like to do this on my own without having my lawyer do it and charge me for it. Bad idea or doable, what do you guys think? Thanks!:)

Hi Pappu,
Along with the letter, instead of just asking for the raise in limits and recapture, why not also propose the H1 cap based on country, this will help them to clean up the existing system effectively...

My PD is January 31, 2005 and my file is at a local USCIS office after doing an interview back in May. The officer didn't approve it then because... well I have no idea...
The last I heard from that office is they're waiting on a visa number...
Do you guys think the Nov bulletin could show a measly 30 day move?
Looks like from the table below, in 2006 it moved a couple of months in November, but in 2007 it didn't move until January.

I spoke to an IO at the TSC a couple of weeks back when my PD became current. I had called to check the status of my application ...the IO mentioned that my namecheck was pending so my case wouldn't be adjudicated. However, the IO mentioned that because of a "pilot program" my case could be adjudicated if my namecheck was clear. I quizzed the IO further, she stated that only applications with current PD are considered for this "pilot program" where 140 and 485 are adjudicated together.
I gather the impression after talking to the IO that I-140 applicants whose PD is not current is not hurt or delayed by the PPP, instead applicants whose PD is current tend to benefit from this program.
I hope this is true, but if it is....then why do we not have any approvals for July 2007 concurrent EB3 filers whose PD is not current.

What happens when you port the EB3 I-140 date from the same employer to EB2 140 and if Eb2 140 gets rejected at 1-140 stage can the approved 140 under EB3 can be continued ?
in the nutshell, your old EB-3 I-140 is not getting affected in any way by the new filing. As far as USCIS concerned your PD is not ported until your I-140 is approved and not used until your I-485 approved, in this case either EB3 or EB2, whichever comes first timewise.
So it's the way to go.

I feel 'people not donating' is not directly connected with money. For example lets aasume tomorrow USCIS opens up a premium service for 485 approval saying you pay $50,000 and your 485 processing will be completed within 6 months and this queue has unlimited visa numbers. Will people not pay 50K and get into that queue? I would say 50% of IV members would pay and make use of that.
The point is not about affordability.

Does anyone know if it mentions in any of the US consulate in India mentioning that the primary H1b stamping is not required but just the I-797 of the primary is required for the H4 stamping. I can't find anything on the internet. anyone has any links.
It is a fact that you do not need your spouse's H1b stamped for your H4. I have confirmed this with a lawyer and know several people who got their H4s stamped in India.
My advise to you:
1. Do not go to Canada or Mexico: as this is your first H4 stamp, you should go to India.
2. Take all the documents needed for H4 stamping AND all the supporting documents that your wife would need for her H1 (assume that she is coming with you for H1 stamping). Take everything (short of her passport and original I 797 of course!) with you.
3. Always tell the truth to the consulate and do not volunteer any information. Just answer what they ask.
4. Chances of any troubles with your H4 stamping are extremely slim.
5. Hope you mother feels better. Try to get to her ASAP, and don't worry. Everything will be just fine.

Do we need to notarize any documents??.... there is confusing information on the website. one line they say need for EAD and the other line they do not?

AP is only for travel. What is your status? H1B or EAD. So as long as you have a valid H1 or EAD dosent matter when AP expires or the I94 based on AP expires. Technically if it says "AOS" on I94 it expires the day USCIS makes a determination of your AOS case.
I have H1 and expired I94 based on AOS. Asked attorney and he said if you dont plant to travel dont renew but keep in mind it takes a couple of months to get AP renewed.

My understanding is with I-485 Pending status I can live here legally. Valid AP is required only at the time of trvelling abroad. AP need not be maintained continuously.
Can someone please clarify?
