So that clearly shows that the I-140 was revoked and same day they denied I-485.

Thanks I read thru it but the blog misses my scenario when you have applied for 485 and you got EAD/AP. I am assuming AC21 would be best option.

Reid has threatened to fillibuster Frist's bill if it has no provision for Amnesty and guest-worker program.
If he sticks to it, Frist's bill may be a failure.

Yeah, I also saw another post about dealys in Canadian embassies. But what makes you think older H1B approvals have more chance of delays?
It is true that this is not confined to India. Couple of my friends went to canada for stamping and they faced weeks of delays there also with regards to PIMS. On an average they had to wait 5 weeks for the stamp.
I know of a friend who went to Mumbai consulate and it took him just a week. He recently had received his 3 year extension based on I-140. So its just not consulate and it has to do with when your H1 was approved. I think recent approvals take less time. Not sure if this is correct.

When you filed your H1-B extension in May 2006, what was your date of pay stub you submitted along with your H1-B extension? I will try my best to help you.

I did file for EAD renewal on June 23rd. My PD was current from June 1st. I did call June 30th by POJ method. The IO told me my case taken from the shelf and it was at IO table for review. My case was approved on July 7th. So I believe EAD renewal brought case my case pulled from the USCIS black hole shelf to a table. If your PD date is not current, this will not help. If PD is current and your RD is before the published process date, they will think to approve your case, when they look your file for some thing. Otherwise it will remain in the shelf. That is why the random approvals coming from USCIS. They do not do FIFO rule. Need luck and some kind of triggering.

Are you sure, they are going to pay you less than in LCA? If yes take one check with lesser amount and complain to labor dept. Also move your H1B to another company. They can't complain against you. They breach the agrreement with you and labor dept for the salary, if they cut your pay. So you have a case against them.
If it is yearly rate, he can pay you $1 for each paystub after the amount mentioned in the LCA. He need to pay you for 12 months.

Hi All,
My Current Situation: I-140 approved -Jan 22, 2009 with company B, 7th year of my H1 ending July 2009, Current company B applied H1 extension, But denied based on Old "Company A" I-485 - which is denied (June 26th 2008).
Looks like USCIS didn�t considered my current company�s approved 1-140.
Right now, I applied MTR (appeal) provided all documents.. like approved I-140 copy, LC copy and previous H1 copies.. etc.
*Usually how much time they will take to respond this kind of Issues.
And also at the same time... can I file another H1 from New Company.. for example. ( my client) while this MTR is in processed.
Please give me your valuable advice.

I worked for one of the worlds largest Telecom companies for more than 5 years and got i-140 approved under EB3. I was already qualified to get an application filed under EB2 based on my prior REAL work experience but as a policy , the company did not do any EB2's.
At my next job at a wireless startup, my i-140 has been approved under EB2 though i am still struggling to get my priority date adjusted. Both these jobs were with real companies ( NOT BODYSHOPS ) . Can you tell me why I should not be able to port my priority date.

Based on my research, it would be in your best interest to adopt the baby asap and bring her/him on H4. If not then it takes two years to get the Green card later for the baby.
If you get the child on H4 then you can file for I-485 as soon as your PD is current

If you have a family emergency, forget about the GC. The recession does not seems to be ending soon. Its going to take a long time. Once it bounces back we don't know how many years its going to take to recover. People have lost ther homes, unemployed and in deep stress. Its not worth it to stay back while you have a family emergency. GC should be secondary. You are hardworking, sincere you will find a job anywhere.

Thanks for your response. When he was on H1 he was on vacation outside US. Can he recapture that time along with the 6 months he already has? that should give atleast couple of months more.

The "forced focus" button is under your right thumb as you are shooting, right next to the auto white balance. it looks like three horizontal dots. You can use the button to toggle through auto, left, center and right focus points.
White balance button, point at something white, press WB button with thumb and press trigger. A little awkward, but I got used to it.

WOOT! Thank you. That helps a bunch. I think the more akward thing is to have to roll the dial to the correct focus point while holding down the force focus button. This weekend I think Im going to take a trip to one of the wild animal parks here in Oklahoma. The one I want to go to lets you play with a baby tiger, lion or bear for 15 minutes if you give them 25$. I think it would be cool.
