My question was replied in a very clear way by Sonal L. Mehta Verma and I (because of my lack of knowledge) still have some doubts.
My situation in a nutshell is: I am about to start my 7th year H-1B, my 45 day letter EB3 RIR was replied three months ago and I want to use EB2 because in worldwide is current so that I could file I-485 not too long after filing for PERM EB2.
Now EB3' I-485s are being accepted for PDs of Oct 2001 so with my PD of Feb 2005 I expect my I-485 to be filed end of 2009/ or start of 2010. I am decided to refile EB2 so my question at the Conference call was, (in case my employer is ready to spend time with the newspaper ads and filling the forms) if it was convenient to refile paralelly to my EB3 process another EB2 PERM or it was better to wait that I-140 is filed and approved and then restart with PERM EB2. The answer was that I should first get my Labor approved (EB3 Dallas BEC) then apply for I-140 and after I-140 is approved (and while I wait forever for the I-485 turn) to file at this point for EB2 PERM with a new labor and once it is approved I file for a new I-140 recapturing my PD of Feb 2005.
Now comes what I do not know about the process, when do I ask to recapture my PD of Feb 2005? The moment I file the second I-140? (at that time I plan to file concurrently I-485) or do I mention that at the I-485 filing? or do I mention taht while filing labor certificate under PERM EB2?
My immigration lawyer says that he filed EB3 because my position didn't require extensive experience but since I was promoted this year to a managerial position he says that now it fits BUT I cannot recapture the EB3 original priority date with the new EB2 PERM because my position description has changed! He explained that it is not possible to recapture a priority date for a different position which requires more years of experience when the original priority date required less experience and wasn't managerial (is this true? :rolleyes: )

On the side Note..
My Desi employer does not show me the real PO ( Purchase Order ) whereas at the same client other an American Vendor does show the real PO to their employees.
Is there any DOL link about it to share PO with Employees. ?

I am currently on H1-B status (never used my valid EAD). Therefore I have the option to leave on my valid H1-B handing in my I-94 and return on whichever option i chose to enter (either AP or H1-B) without invalidating my I-485 Process or abandoning it.
i dont think u can choose whichever. i think AP is abondoned if you leave before its approved. i vaguely remember something on the AP receipt notice or AP form intructions, about this. make sure you read the AP receipt notice and AP filing instructions, thoroughly before leaving.

Its the law dude for the employer to send you your W2. If he does not he is breaking the law and you can report him to the IRS. I am sure if you tell him this in a nice way he will send it to you by overnight courier :D

It is Cumulative Demand Prior To CY-2002. I.e. before Jan 1st 2002 and up till Dec 31 2001.
No it does not include 2002. For 2002 look for "Cumulative Demand Prior To CY-2003".

It is not a good idea to open an S-Corp. If you want an incorporation a C- Corp is a better Idea. An S-Corp is basically for citizens and has a lot of legal implications. A C-Corp is much more flexible. The best is an LLC. You get tax benifits and your liabiality is limited with an LLC. But if you intend to hire other people a C-Corp is your choice.
Why did you choose an S-Corp over an C- Corp? Any particular reason?
1) And 2)- NO
3) Keeping the company on Zero revenue is going to cost you. You have to pay yearly taxes. For e.g, in NJ you will end up paying $750 for state taxes and another approximately $140 in annual reports etc for a company with no revenue.
It might be a better idea to cut your losses and open an LLC.
I started an C-Corp 2 years ago. What ever the company earns remains in the company, I am not an employee. This is so I don't invalidate my H1. I can now work for my company though, since I have my EAD.

You are only good as the attorney representing you. So don't look for cheap and inexperienced attorneys. I burnt my fingers and that is my sincere advice. I fought a state agency on their intepretation through a top law firm and got what I wanted. Don't hesitate to believe in yourself and your idea.

I advice you all to walk in to ASC locations.
I went to one ASC location as walk in. They asked me to go District office where I already tried with an Infopass appointment.
Then I tried at another ASC office, and pleaded them saying my dates are current, take my FP, then I can get my GC. That officer is nice, he took our FP and they were cleared and sent to USCIS yesterday.
I will say, try in at least 2 ASCs at least twice at each ASC. Infopass is waste.
I went in the morning around 8.30 and there were only 4 people for FP and that officer took our FP after 40 min phone / PC communication.
Good luck to all.

2.) At Port of Entry, flash the card ! so the PoE officer will
void your H1-B and your spouse's if on H4

Hi guys,
Right now I've my flight booked for 18th. But I was wondering if I change my flight to 16th (sunday) and come there, will I be of any assistance to the planning, etc.? I am not a state chapter leader.
Again this can happen only after I get my leave approved, and I get a reasonable flight price. Also if I can come, is there any way for me to share hotel accomodation with others?

So this takes us to my original question. What exactly is the advantage of applying for EAD for primary applicant. If to change jobs, you can transfer H1, right. But this occured to me as I was typing. With EAD, you can work for any employer, even the ones not willing to sponsor H1s, right. I guess that is a big advantage. If anybody else can think of any other advantages, please list them.

secondly, thank you everyone for the information! this helps a tremendous amount. I've schedule an appointment tomorrow to talk to a USCIS representative, thanks for that advise. I'll save the rest of my questions for them :D
