Dear Members,
We are working hard to assist our members coming to DC for the advocacy days. Many members have been helped by local DC members by providing accommodation in their homes.
We are trying very hard to manage the high expense of this event ranging from booking a conference room in a hotel near Capitol hill, printing and buying bulk media drives for each meeting, organizing a press event to Congressional reception expenses. Our budget is $50 thousand dollars for the entire event and we are struggling to meet this goal. Our minimum budget for these events is 50K budget. At this time we have received around $7,500 dollars as contribution from IV members, and we wholeheartedly Thank every who has contributed. But we need everyone to step up to the plate and do their fare share. We have a tough road ahead and we need every one to help for their ow cause. In the past IV Team had spent their personal resources to get the effort going and have our voices heard. We are all working hard to organize these events despite some of the core members already getting their Green card holders. It is now up to each member how valuable they view this effort and can stand up for themselves. Each one of us is participating this effort for own self rather than doing any favor to others or to IV. Please donate generously for this event so that we can make it a success..

Some members have approached us seeking help in their tickets. We are not in a position to pay for travel or arrange buses for anyone. We would like to help them by starting this thread and urging other members to donate their skymiles to others that are coming.
Please post on this thread if you are willing to donate your skymiles. An IV representative will keep a tab on all skymiles and connect both the donor and recipient after verifying that the recipient will be coming to Dc and using these skymiles only for the advocacy days for himself.
We have a member from a state where we do not have many members and needs American Airlines miles. He would need more than 1 lakh miles. There are a few more in our list.

Even my Lawyer did not file for EAD/AP along with the 485. I have sent all my applications along with my 485 to the Attorney and they chose not to file the EAD/AP along with 485 during the fiasco. Later yesterdsy they filed my EAD and AP .They said if you have proof of delivery of 485 (Tracking number signature of FEDEX :PDF file) is enough as a proof of delivery.
I wud suggest that you ask them for Tracking number of your application and send it.
If they insist on not giving it to you , Then wait until u receive the 485 receipt and file it on your own. Do not disclose that you intent to file for EAD /AP . You can do it on your own.

Hi,
I am on H4 and my husband's company has files H1-B visa for me in 2007 quota. Will this file considered as H4 to H1 Change of Status case or fresh H1-B case?
And normally how long time its takes to get approval for H1-B? My company files H1-B for me in April so when (around) can I expect H1-B approval?
Because I am planning to visit Canada but somebody told me that if I am in US on H4 and H1-B is filed then I must not leave US till I get H1-B approval.
Please help me if you have answers of these questions.

The law specifically states that AC-21 kicks in 180 days since I485 is FILED. You can not change jobs before that and count on approval.
not true. You can keep changing jobs, in fact you dont even ever have to work for your sponsoring employer. GC is all for future job.
Now, they are 2 options here. If the USCIS sends a query for a new employment offer letter, you are in trouble. At that time they will figure out you changed jobs before 180 days. However, this is not legally permissible and they can figure out something was wrong when you apply for citizenship. The fact that your company did not cancel you I140 has NOTHING to do with it. Even if your company cancels 140 after 180days since I140 was filed, you are still entitled to your PD established on I140 stage. However, the 180 days after I485 is filed is hard written law and one should be Very careful when changing jobs.
Also, the fact that you changed using H1 does not make any difference.

Alanita - Rip off and bad Travel Agent. Never book tickets through Alanita. Recently I have booked my tickets through Alanita Travels and cancelled my trip. Adult 2 tickets, Children 2 tickets. They charge huge cancel or date change charges, even though airlines or Sabre system offers it free of cost or less charge.
In general for cancellation or date change airlines charge max $200. So online portals like makemytrip.com or orbitz.com or <airlines>.com charge extra $50 in addition to airlines cancellation fee. But Alanita travels charge $375 for cancellation or date change.
If you argue with Alanita travel agent regarding these ridiculous charges, they will threaten you like go and get it done with airlines (because they know you have to go through travel agent).
I have chosen Alanita, because they have offered $17 less then makemytrip.com. Beware of this Rip off Travel Agent - Alanita Travels. It is very common for us cancelling tickets or postponement due to immigration, job or health reasons. Consider cancellation or date change charges seriously.

These days I go to all kinds of travel websites and try to compare the prices and try out different days and tweak the search to get the best price and buy online.

If you are flying from a major city like New York or LA or Chicago etc where you have lot of international Airlines operating directly, you can try the airline website itself. But before that, check the price in websites like, travelocity.com, expedia.com, kayak.com...after finding a good price thru one of these websites or any other that you know, go to the airline website and check the price...usually they would be little less.

If you dont go for 3 yr extension, you just end up paying them more. What do you get?
Also dont count on your 2nd conclusion that PD is yours to keep forever. If your employer revokes I-140 then there are some situations where you can lose this PD.

In my opinion, you'll need the renewed H1B stamped on your passport in order to get the new dates on your I-94 (also, check that your passport doesn't expire before your H1B does). I would recommend an appointment at any of the consulate to get the stamping done.

Thanks very much ... does it matter whether you get the I-140 by LC or EB. My appointment letter and contract stated that I will have to be responsible for all immigration costs entailed in adjusting my status.
But if the immigration law (that requires that employers pay the cost of I-140) says otherwise, then that could be a useful course to pursue...I thought that stipulation was only limited to labor certification.

I think u guys can make a quick trip to Canada/ Mexico and on your return, u will recieve a new I94.
