USCIS has posted a response to the numerous questions about the visa backlog. It's absolutely and without a doubt not even remotely responsive to the issues that were raised in the comment sections:

This is a direct copy paste from normal visa rules, We want answer for Visa Recapture, We want answer for around a million of Legal immigrants who are tax payers here in the USA waiting for just PD to be current for AOS, they are treated like new H1Bs in workplace, and when they extend their visas as per abjudicators fancy they extend it or deny it What is the Answer for that USCIS?? Allow all I-140 approved Employment Based cases espeically EB2 & EB3 to apply for their AOS immeterial whether they have PD current or not.
I hope this is not a copy paste from IV. This looks like a accumulation of all the info discussed on IV. Nothing new.. except we came to know that there are NO Visas moved around EB to FB or viceversa but only the Visa numbers just for the calculation which our pundits already predicted...

The stats doesn't breakdown into how many are from China, India, Philipines and Mexico.
The report does not breakdown based on origin; but it does mention that most of the them are from China and India (and also Isreal, Lebanon and Taiwan).

I was in exactly the same situation as you are. Fortunately there is hope and you and you can get it corrected in your nearest CBP. Checkout this thread for more info:

I have decided not not pursue a job opportunity with a consulting company that had filed my H1B in April 2007. I was eligible to file for AOS/EAD in July 2007 as a dependant on my spouse.! I already have h1 (completed 4 years and have 2 more to go.!) from non-profit org.
This H1 is still pending decision at the USCIS. I only have a receipt #. I have informed the prospective employer of my decision and i have also requested that they withdraw this pending petiton. I have also decided to compensate them for thier expenses (filing fees + attorney fees).
But the employer does not seem to comply and may not withdraw this pending petition. Also does not want give me copies of LCA + 129.!! I'm just trying to keep it clean and hence have written a ceritfied letter to the employer of my decison & requesting that he withdraw the petiton. I am also cc'ing the attorney who filed for this h1..SHOULD i also cc USCIS on this.? How would you guys advice me to proceed.??

I don't think you/your company needs to withdraw the pending H1B , you'll just forget about your pending H1 and once you get your EAD/GC , you can start working if you want to.

Folks, lets focus on the CORE & CURRENT ISSUES at hand. We are all adults and do not need to reference communal and political ideolological struggles that have little to no common intersection with our interests.
The immigration issues are in itself complex. Why complicate it further with references to extraneous events?
Wouldn't it be a better use of time and energy to focus on what we need today?

I don't see the advantage of asking USCIS to change another whole process to allow this to happen. This will delay all other current processes.
In any case, what is the immediate advantage of having US Citizenship in addition to GC? Except may be (the disadvantage) having to apply for a Visa to one's home country when you go to visit (most have no dual citizenships).

lvinaykumar: Get a copy of the FP notice from your attorney, and do a walk-in to the same application support center and explain them that you have not received a FP notice and you are doing a walk-in based on the courtesy copy from the attorney. Usually, Wednesday is a good day to walk-in.

Then you write an invitation letter to your parents (nothing official) and then sign it
send all other required docs
Pay visa applicaiton fees in India
Take an appointment based on your place (in India)

Sometimes - some banks are insured as a part of another bigger bank - which itself is FDIC insured. Those smaller subsidiaries may not always come up in this search tool. But that information (that this smaller bank is a subsidiary of the bigger bank) should be prominently displayed in the bank website. I would personally also call up the FDIC to confirm before putting my money anywhere unknown.

If what i just said is right , and 485 is pending due to County based limitation, then opening this Pandora box is worth a shot !
Who told you that if I-485 is pending due to limited immigrant visas for the beneficiary, it is against the law. Remember, I-485 application is based on I-140 (Employer's petition for Immigrant Worker) and like you said, person is just that, beneficiary.
