Hi,
I recently completed D160 form which is now the new system of adding and filing application for B-2 visa.. I have read at many places that in case of "In-Laws" wife should sponsor all expenses and stuff like that. Now as I need to fill I 134 and I don't know who should sponsor them as I am on H1 but my wife is currently a homemaker and she is on H4 visa. So should I use her name on I 134 or my name?

One can have any number of H1B's but at any given time only one employer can employ you.

You can move over to B and then if you are not satisfied, you can move back to A. but remember you can move back to A only if (H1B with A is not expired and H1B with A is not withdrawn)
As of I learned, a person can have multiple H-1 jobs and H-1 visas and work on them concurrently. But at every job they must be working specified amount of time and be paid accordingly.
So employer can have job A for 20 hours per week and job B for 30 hours per week, and legally receive according salaries from both employers. But not with H-1B transfer, but with concurrent filings.
The other my concern is if an employee may come back AFTER working for employer B. As far as I know he can stay (continue working) with employer A even if H-1 transfer is approved, but I am not sure about him being allowed to come back after working for employer B without additional transfer application. Actually I have already found a position, that since employee WORKED for company B he has completed the transfer and now moving to any other job requires another transfer application and 2 paystubs.

No video on the Digilux 3, Nik.....and.....it only shoots RAW + a Jpeg...or..... a jpeg only. Since I always shoot RAW, seem like a waste but the LCD can only read JPEG.

Sorry guy... you want the benefits and privileges of US Residency/Citizenship but don't want to live up to the obligations of a US Resident or Citizen (said obligation applies to all US PR's or Citizens without discrimination). No sympathy for you there...
If what you are concerned about is living abroad, and if you are an Indian, get OCI. You'll get the same privileges as an Indian except gov't work, running for office, and some farm properties.

There are rumous only about the S.1085. democrats are trying to push that as a peice meal relief. along with Dream act and Agjobs amendments.

The total number of H1B workers do not make up even 0.5% of the US Workforce but to hear the howl and screams it sounds like they H1B's have flooded the market and if only they could be kicked out, good old days of 14,000 DJIA and 700K for 3 bedroom ghetto shacks will return with all their glory.

why did he have to wait for 6 years to file for labour, he could have done it well before right?
Waiting for 6 years to know this is very tragic. Run your situation by a lawyer (not your company lawyer). You may find some workable options. Good Luck.

But since CVS is a 'for-profit' company it may not qualify....
This is where it get tricky. pharmacist are NOT CAP exempt because they are still pharmacist out there practising pharmacy with a bachelor (Rph). So, in the eyes of immigration laws it's like pharmD r not a doctorate in the same title as MD. The way out is to go hospital or academia.

Being on H1 and not paid even for 1 day is considered as "Out Of Status". I think you should talk to your employer to pay you back wages and then convert back to H4 to make sure you are in valid status.

the certifying officer thought my inhouse experience is similar
to job requirement. I have accumulated 5 years experience from the
same company (50%) rule. I have to re-advertise to file new perm
since recruitment is 180 days old.
H1 is till June. Lawyer wants to start fresh perm. I do not have time.
if premium processing does not start I will be screwed one more time
again.

EB2 is current for ROW. can I stay in work permit in the country..

My application has always been with Nebraska service center from the beginning.. I have always used Nebraska to file/renew my EADs, advance parole..
I think you should put down the service center you used for renewing your previous advance paroles and EADs? ..
The best thing to do is to ask your lawyer or other people who have also originally filed in California Service center.. about what they did.

The employee may already be in the United States in a nonimmigrant visa status such as the L1A visa or one of the E visa classifications.

I saw my EAD status - Approval notice sent. What does it mean? does that mean I will receive my EAD card soon ?
I have a question. I see the above status for EAD online. While I have received my EAD 4 days ago, my wife hasnt received yet.
Interestingly, i have recieved my biometrics/fingerprinting appointment, while my wife hasnt got that either.
Anybody experience this behaviour? Any reason why this could happen?

I agree..but legislation is long term away...this govt has its hands and feet tied...so no hope until next jan/feb anyway...the least we can do is try and create noise..
On Legislation, look at how they twisted and turned the 180 day pending rule for FBI backlogged application in their favor by coming up with processing times..extended till next year June..basically they said...great ..new legislation..we will implement it next june if any of u guys are around to check...
I know ombudsman and all that is a farce...but atleast if 1000 people ask the same question someone will do something...currently everybody filed in July 2007 and Aug 2007 are totally backlogged...it used to take about 2-3 months to process an I140 - even if they received double the applications it shud not take so long...plus TSC has implemented this pilot plus program which binds both the 140 and 485 together..so no 140 gets processed at all...heck what legislation can u come up with stupid methodologies like that ?? - the best thing wud be for AILA or someone else to stand up and say..enuf is enuff...we want audits on USCIS processing and they shud be subject to individual performance reviews and be questionable and answerable on each and every case...lets push for accountability...more than anything else..
