I am EB2-I I-140 Approve, Priority Date of June 2009.
I have completed 6 years on H1 and recently got 3 year extension till Sep 2013. I am working for a small consulting company and the salary is also decent.
However, I have got a great offer, not much salary difference, but the location is in the city where I have lived earlier and I would love to go back. There will be about 50% travel involved though... With my current company I have to move from city to city after 1 year or so... The new job I have is the kind of profile and work which I love.
Do you guys think If I change this job, will I loose my priority date. My new company may not start GC processing right away as I join. They may wait one year before they file the new PERM and I-140. Will I be able to retain my priority date. I am trying to negotiate immediate GC filing but as of now they are saying they have to wait one year.
Guys please suggest what you think.... Is it too risky to change my job at this point.. Will I lose my priority date.

Will your old company retain your approved I-140? OR will they revoke it. There are some confusions in this area as far as retaining the PD is concerned. Some say that if the old company revokes your approved I-140 before your new company files for new I-140 then you loose the priority date. Some say that even if old company revokes your approved I-140 then the USCIS will consider your old priority date unless USCIS themselves cancel the approved I-140 on the basis that there was fraudulent filing by the old company. I will suggest speak to an attorney for clarifications and then decide my friend.

"U" doesnt mean that you can apply for i-485. You can only apply for i-485 when it is "C".

Like all of you guys on this forum, I am absolutely stunned by this new F^&*%&(%^G bill. I believe that the root of the problem is that, no matter how hard you try to explain our situation, unless those congressmen could experience by themselves the precarious and highly stressful life of the legal would be immigrant...they will never get it.
They just don't see a problem because...we are legal!

I'm planning on traveling to Delhi end of next month. Have been on EAD since Nov 2007, so will be using AP. This is my first time using AP, so I don't know what to expect at all. Will be travelling from JFK most likely or EWR (prob not).
Please share your experiences? I'm used to traveling on H1b and for me that was always good experience.
1) What documents should I keep with me when traveling?
2) What type of questions to expect at POE?
3) how long is the process at POE? What line do you stand in?
Please provide your recent experiences since we all hear about not great experiences lately....so wondering what it's like.

Illegals are a potential vote bank for these politicians so they win by sheer numbers. Look at them, they are estimated to be ~20 million in number even though reporting shows 12 million. Compare that to EB based legals whose numbers might be ~1.5 million.
In addition, maybe they have no shortage of 'high skilled' workers and do have a shortage of 'low skilled' workers. What makes you think good education and playing by the rules is valued everywhere? Why do you think we are not in our own country?

People like you encourage many of us. I do not have the money, but I will be there as well (WHATEVER IT TAKES).
We need to pull together to make this happen. We need to STAND up for ourselves. None else will!!

Option 1 is dumb. Just use EAD.
Could you please elaborate why option 1 is dumb? What if the husband's AOS is reject for some reason. Won't the wife be left without any status? Whereas if she already has H4 then she won't be out of status just like the husband as he has H1-B. Correct me if I am wrong.

My visa stamping has expired in 2008 and my Passport is valid till Nov 2009. I got a renewal till 2012 but I didn't go for stamping yet. I also have a EAD. Would I be getting a 10 year extension of passport or only year if I apply now. I probably have to go to Newyork consulate(not sure if this impacts the renewal period of passport). I read in one of the forum that with out stamped visa we only get 1 year renewal of the passport. Is this true? Any input will be appreciated. Thanks!

I applied for EAD on June 16th 2008 using paper filing to TSC.
I received EAD today Sep 2nd 2008.
Current EAD was set to expire on 10/4/2008
USCIS gave me a 2 year EAD.
But EAD starts on 9/1/2008 (expires in 2010)
Which means they ate up 1 month and 2-3 days.
Calling USCIS does not help.
They simply say that you have to file EAD again if you want a correction.
The issue is, I am not going to do that for a simple measly 1 month loss.
Above is for your information.
If you have any suggestions, you are most welcome.
Update: You think all these REDs interest me?
Looks like the 90% of people are here not to contribute or talk, but have lot of time, instead of coding or doing QA for their companies.
Anyways, the idea of creating a post was too give information and create a sensible discussion.
One single thread is not going to add up a lot in this database full of too many redundant threads.
The best way to avoid this is to use an approval system for creating threads.
Anyways I dont think this site is useful for a lot of intelligent end users.
Its best for newbies.

I'm out of the US and got the 485 approval today. Will be traveling back on Saturday - so let's see what happens. I'll provide an update. I have my AP.
Lawyer says there shouldn't be any issues.
If you are outside US and GC gets approved then you can use the AP to come into the country... If you were in USA when card approved your AP is invalidated.
You should have no trouble coming back but the other case is different...

Ok, I just got the RFEs from my lawyer:
For my wife, it just appears she needs to update her medical examination results. The civil surgeon forgot to put the date for the lab test they did that proves that she is immune to varicella.
For me, we need to provide additional confirmation of your current employment, and employment history with my current employer.
I have not ported my case from another employer, else they have asked for more proof.
I've attached the 2 RFE for those that are interested... hopefully it might help someone!

I have spoken with my lawyers, does not look so good, we have stallmate between the Repubblican and the democrats. It will be difficult, the problem is the provision for the 12 milion to go back home.
The Dems does not have any interest to push for the skill bill.

However, that said, remember that it might be 2009 before the blue card is a reality. The blue card is aimed at future immigrants.
If I were 10 years younger, fresh from a good graduate school, with plenty of job offers, knowing what I know of the GC mess, believe me, I would be giving EU a serious look.
In the professional environment, the language barrier is not as high as it is commonly assumed. We have plenty of German, Swedish and Icelandic colleagues, and they all speak excellent English. English is commonly spoken in the professional environment, especially in multi-nationals in the EU.
So yes, there will be an exodus, though you and I will probably be stuck battling here :rolleyes:
