One cannot expect their employees to stay with them forever...Remember, most of the states have "at will" employment. It can be started and ended "at will" anytime by anybody for any reason (or NOT).
As to leaving in 3 months, that goes towards business risk. When companies hire new employees they take a business risk of losing them because of things out of their control. That is not and never should be a reason to show the ill intent of not paying the money that is earned.
MN007, your employer is expecting you to stay with him for years to come as he sponsored your H1B(probably your 1st h1b?) but is hurt by the fact that you you left him with in 3 months. He didn't incur any expense to sponsor you, so tell him to get over it (politely) and don't be afraid to standup for yourself if he doesn't budge. You have every legal right to demand your hard earned money. I don't recommend publishing the company's name in public message boards as it can come back and bite you in a law suit.
Go get him and don't forget to post the company's details after you have settled this. You have all our moral support.

what do you mean by TAL? could you give an example? like terms to avoid etc?
@thomachan:
TAL=Technology Alert List (Here is some info I have compiled from different sources)
The TAL consists of sixteen sensitive technologies, listed below. As evident from the list, some of the categories are quite broad and encompass work of a purely non-threatening nature. Additionally, those who work or study in a "closely" related field or one that is categorized as "dual use" may also be subjected to increased processing procedures and delays. The consular officers will determine whether the person's work or school activities fit within the regulated fields.
The TAL consists of two parts: (1) Critical Fields List which lists the major fields of technology transfer concern, and (2) the Department of State List of designated State Sponsors of Terrorism. The first test applies to nationals of all countries while the second test is intended to remind the Consular Officers that applicants from listed countries warrant special scrutiny and are subject to a mandatory Visa Mantis checks.
The sensitive areas constituting the Technology Alert List are:
(1) Conventional Munitions : technologies associated with warhead and large caliber projectiles, fusing, and arming systems;
(2) Nuclear Technology : technologies associated with the production and use of nuclear material for military applications;
(3) Missile / Missile Technology : technologies associated with air vehicles and unmanned missile systems;
(4) Aircraft and Missile Propulsion and Vehicular Systems : technologies associated with liquid and solid rocket propulsion systems, missile propulsion, rocket staging / separation mechanisms, and aerospace thermal and high performance structures;
(5) Navigation and Guidance Control : technologies associated with the delivery and accuracy of unguided and guided weapons, such as tracking and homing devices; internal navigation systems, and vehicle and flight control systems;
(6) Chemical and Biotechnology Engineering : technologies associated with the development or production of biological and toxin agents, pathogenics, and biological weapons research;
(7) Remote Imaging and Reconnaissance : technologies associated with military reconnaissance efforts, such as drones, remotely piloted or unmanned vehicles, imagery systems, and high resolution cameras;
(8) Advanced Computer and Microelectronic Technology : technologies associated with superconductivity, supercomputing, and microcomputer compensated crystal oscillators;
(9) Materials Technology : technologies related to the production of composite materials for structural functions in aircraft, spacecraft, undersea vehicles, and missiles;
(10) Information Security : technologies associated with cryptographic systems to ensure secrecy of communications;
(11) Lasers and Directed Energy Systems : technologies associated with laser-guided bombs, ranging devices, and countering missiles;
(12) Sensors : technology associated with marine acoustics, missile-launch calibration, night vision devices, and high-speed photographic equipment;
(13) Marine Technology : technology associated with submarines and deep submersible vessels, marine propulsion systems designed for undersea use and navigation, radar, and acoustic / non-acoustic detection;
(14) Robotics : technologies associated with artificial intelligence and computer-controlled machine tools;
(15) Advanced Ceramics : technologies related to the Production of tanks, military vehicles, and weapons systems;
(16) High Performance Metals and Alloys : technologies associated with military applications.
An alternative list I found:
(1) CONVENTIONAL MUNITIONS: Warheads, explosives, or other large caliber projectiles.
(2) NUCLEAR TECHNOLOGY: Nuclear physics and/or nuclear engineering used in the development of nuclear materials for both peaceful and military applications.
(3) ROCKET SYSTEMS: Ballistic Missile Systems, Unmanned Air Vehicles, and pace launch vehicles.
(4) ROCKET SYSTEMS AND UNMANNED AIR VEHICLE SUBSYSTEMS: Propulsion technologies, solid rocket motor stages, liquid propellant engines, re-entry vehicles, guidance sets, thrust vector controls, and warhead arming technologies.
(5) NAVIGATION, AVIONICS AND FLIGHT CONTROL USEABLE IN ROCKET SYSTEMS AND UNMANNED AIR VEHICLES: Internal navigation systems, tracking and homing devices, accelerometers and gyroscopes, flight control systems, and global positioning systems.
(6) CHEMICAL, BIOTECHNOLOGY AND BIOMEDICAL ENGINEERING: Biochemistry, microbiology, pharmacology, immunology, virology, bacteriology, mycology, toxicology, genetic engineering, recombinant DNA technology, pathogenecity, microencapsulation, chemical engineering, neurochemistry, pharmaceutical production technology.
(7) REMOTE SENSING, IMAGING AND RECONNAISSANCE: Remote sensing satellites, high resolution radar, imagery instruments, photogrammetry.
(8) ADVANCED COMPUTER/MICRO-ELECTRONIC TECHNOLOGY: Supercomputing, speech processing systems, neural networks, data fusion, quantum wells, superconductivity, optoelectronics, acoustic wave devices, superconducting electron devices, flash discharge type x-ray systems, frequency synthesizers, microcomputer compensated crystal oscillators.
(9) MATERIALS TECHNOLOGY: High performance metals, alloys, and ceramics associated with military applications.
(10) INFORMATION SECURITY: Cryptography, cryptographic systems.
(11) LASER AND DIRECTED ENERGY SYSTEMS TECHNOLOGY: High and low energy lasers, directed and kinetic energy systems, optoelectronics, optical tracking, high
speed pulse generation, magnetohydrodynamics.
(12) SENSORS AND SENSOR TECHNOLOGY: Marine acoustics, optical sensors, night vision devices, gravity meters, high speed photographic equipment,
magnetometers.
(13) MARINE TECHNOLOGY: Submarines and submersibles, undersea robots, marine propulsion systems, signature recognition, acoustic and non acoustic detection.
(14) ROBOTICS: Artificial intelligence, automation, computer-controlled machine tools, pattern recognition technologies.
(15) URBAN PLANNING: Architecture, civil engineering, community development, environmental planning, geography, housing, landscape architecture, urban
design.
If possible, try to avoid these terms, but some of them are so common I think it might be difficult to avoid. I work in biotech and nothing I do was on either of the two list.

How to get google gadget to track you case status portfolio (per pappu's Q). I tried it yesterday and it was very nifty. You can add it to your iGoogle page and it shows the number of days since the Last Update (LUD) and not just the date of LUD - on a case by case basis. It's definitely easier than manually logging into USCIS's website and more reliable than automatic email updates which doesn't work all the time (Now only if there was a Yahoo Desktop Widget...):
http://www.google.com/ig/directory?synd=open&q=case+status&btnG=Search+Google+Gadgets
By the way, this gadget is provided by imminav.com, also a very handy website which collates all immigration forms and tracks number of case updates every day.
Do you know if imminav.com get's hold of the userid and password if someone uses the gadget ?

Yes employer can revoke 140 at any time.
If the employer revokes 140 after the approval , it doesnt matter and while approving 485 USCIS will ask for an employment verification letter.
If the employer revokes before I-140 then I think with the new employer u need to start the whole process and u have to use h1 transfer
My suggestion is hang with the employer for another 6months and meanwhile ur I-140 will get approved. Then u are on the safe boat.

There are number of our members who are raising questions about when this bill will become effective. Here are some pointers to that. If there are any errors in judgement please let us know
Senate expects to complete it's vote before Memorial Day
Within a week the members of the House Senate Conference Commitee will be announced
The Conference Committee Report should be ready in another 2-3 weeks
The Senate and the House will have to individually vote and approve the billl that comes out of the Conference
All this could mean that it would be end July before the President signs it. Even after the President signs it, the law would not become effective immediately. As per Section 401 of the bill, Any regulation that would increase the number of aliens who are eligible for legal status may not take effect before 90 days after the date on which the Director of the Bureau of the Census submits a report to Congress. This Report needs to be submitted within 90 days.
There is some doubt with regards to whether it will be applicable for our provisions also or not. If it is applicable then it will be 6 months more before our provisions become effective.
All of this is only assuming that there are no further road blocks and everything goes smoothly. That is a pretty big assumption if you ask me.

I am not sure about what you mean by "reveal why it is pending" when we are talking about background check.
If your case is pending from long time and your dont know why its pending. You might ask congressman and he might help you. In case if reason is back ground check he will tell you its pending because of backgournd check. He wont help you more in backgound check.
If you already know that your case pending because of background check and if you ask congressman to help in this. he will not help you and wont reveal any extra detail to you. In my case I knew that my case is pending because of background check and I asked congressman to help in this he didnt help me at all.
I read many forums on background check and all threads are describing the same.
gc28262 was merely trying to help. You don't have to be rude to him/her. You are the one asking advice on a public forum and you want disclaimers from a person giving you suggestions ("When you write your answer or question please always add that it is your assumption or its your understanding on this point.")

IA stands for Initial Assessment, it means u passed the important initial assessment, it means u r so close to getting the approval, the remaining steps are mostly routine.
You may find in the letter them saying "please note that while an interview is not necessary now, we may request it later", it's unlikely, but they like to cover their bases

Thanks guys. but My attorney (Fragomen) will be pissed if I tell them this because they didn't like the idea of my travelling after filing 485 as my H1 had expired- they were worried the 485 would be considered abandoned if I travelled without parole. I sort of told them I wont so its very awkward now to call up & tell them ' hey guess what-I ignored your advise and travelled and I'm back with my new visa stamp but its too clean for you to see?!'. I do have a copy of the visa page and the I94 looks legible so I was thinking of just sending those to them and taking care of the visa situation myself if possible. I will be contacting the Indian embassy in Chicage to see if they can issue a new passport. So no one has ever washed their passports?

ivar,
Not to push on you. I hope you sincerely get the credit you are looking for.
But logically thinking i think the whole idea of doing this is to stimulate the economy. So if you ask me than Only people who buy homes after the bill is passed should be eligible for this credit, for 1 year after the bill is passed.
This way lot of people will actually buy homes to qualify for the credit and thereby helping the economy. And rules out people lucking out and getting the non refundable credit.
But again realistically looking, With home prices predicted to continue to crash, Not sure how the 8K credit will make up for the equity you will lose in the house if you buy today.
I totally agree the plan is to give a boost to new home buyers in this year. But according to the earlier plan i think anyone buying a home after April 08 was eligible for the credit of $7500 which need to repaid in 15 years. I am just annoyed because they changed the date of the original bill.
Recession is being officially declared from December 2007 so anyone buying a home after december 07 has to get credit this would have been Fair. My home value has already gone down by almost $10000.
The confusion is this new bill replaces the original bill or is in addition to the original bill.
Thanks,
R.
