Hi!
since some people were enquiring about lawyer, I am throwing name of my attorney, Mary ryan ... just in-case you are window shopping. Actually it's my company's lawyer, but found her to be exteremly reasonable and gives sound advice. Her office is located in baltimore, MD and practises under "Taylor and Ryan" She actually avoided me from falling into the trap of Counsler processing during last years july filings. I was gunning for it, as it had been my impression counsular processing is faster, especially since I had no fishy deal in my EB2 work history. But her advice saved me and thankfully, I am enjoying EAD just like you all. She might be pricy ... but that's for you to find out.

This bill only takes care of illegal immigrants' kids. There is no justice to law-biding, legal immigrants whatsoever. Worst, it will mess up the legal immigration again as all the previous amnesty has done. No legal immigrants in their right mind will suppot this bill.
The bill in itself is a form of amnesty, no matter what you want to call it. It only serves those politicians who see votes as their sole mission without any single consideration of the country. It will generate more fees for those lawyers. It will encourage more illegal immigrants, esp. those who use their children as their excuses for their own irresponsibilities and put more children in danger. It's a slap of face on those who follow the laws and whose children are suffering as much as, if not more, due to immigration delays.
In a country which prides itself as law and justice, it's really a shame and outrageous to see those law-breakers/criminals playing victims and taking advantage of the system. What a joke! If you really think about it, it's absurd when illegals talk about family value, contribution to the country, a better life, etc.? Think about it, folks! Don't we, legal immigrants, have family value, make contribution to the society and want to live a better life too? The only difference between us and them is that while we want all the good things, we do that following all the rules and they don't give a s**t about laws. Illegals only think about themselves and always try to take shortcut, taking advantage of others. The mere fact that they are here illegally and let their children go through all the danger of illegal immigration has said enough of them. They do not have good moral character already and should NEVER be admitted to this country.
As for us, it looks like we will have to fight for justice ourselves. If we don't, nobody will.
Sad, sad. :(
World is zero sum game. Might is right in politics. Either you shaft others or get shafted...
I guess skilled immigrants will get shafted.

There is a saying that Mangoes don't drop off the tree by reciting Mantras. [/B]
And problem is that mangoes are banned to be imported from Asia ... You should have written "Apples" in place of "mangoes"... You scared me:D

Unfortunately for oldies like you and me, porting is mostly done by folks with later PDs. So it would still take 6 years for me to get the GC.
We will see more numbers in coming years, lots of folks are porting to EB2 from EB3 category. I am interested to see how this number looks like in next may / jun.

I was thinking, in the world of Americal law (legal language), do they have something like STAY? I think that is the easiest way to go, something which would immediately disapprove the VB updates in july.

Nothing worry. My wife also got a new H1B to start from october 2007, she got her approval on april 12th 2007 ( fastest i guess after all the lottery fiasco but she has a US master) and now we filed our EAD in june 1st 2007, so we are planning to use just the EAD and not H1B

I am very happy to report from the Indian American Forum event in Cambridge, MA. The core members might send a report about the event, but let me tell you that we have excellent people as leaders of IV.
I am very impressed with our fearless leader WaldenPond. I can say IV is well connected and know the right strings to play to get the music. From now for me it is a question of how soon.
Folks, I request you to take this as an attestation from someone who has seen the leaders in action at the event. Please believe in this group and provide the supported needed in cash or kind.
I am going to send my second contribution now.
Thank You..waiting to hear more ...

I heard that you need paystubs for changing H4 in USA also. I am not sure. If that is the case then you need to go back to India and get H4 stamped. Once you get a job you can again switch over to H1b. It is highly riskier to be on bench without pay though many people are in that situation.
hii
I entered US with a H4 visa which was till June 2007.and then applied for my H4 extension

You CAN switch from EB3 to EB2.
How do I know? I did that sucessfully.
You have to file an amendment to your original certified I-140. Note that the original position mentioned in the Labor certification petition should be consistent with EB2.

I applied for my EAD - paper based filing at Texas Srvc Center. They generated the receipt # on March 5th 2009.
When I enter my receipt # online, I get the message that I have entered a wrong receipt #. The same thing happens when I call in. The Customer Rep cannot give me any further information either.
Anyone else faced this issue before?

You can get a SSN if you provide proof to the SSN office that she requires a SSN for applying for the course / exam as per thier requirement. You shold have a official letter from the organization that SSN is required. I used to live in PA and my wife had to have SSN to take her BAR exams, i showed the requirement letter from BAR council and they gave it to her.
My wife also needs SSN to take teacher certification in Illinois. It will be very helpful if you could share the process with us.
Thanks

For canadian medical, they do only chest X-ray. If you already did medical for US green card, use that to save the cost. For canadian medicals, they will do HIV, TB and health check-up, which we also get done for US medicals.
It will help in saving you money if you cna get a report from the doctor with whom you did your US medicals.
If this helps, I will request you to help IV with the rally. Any kind of help will be appreciated.

I am not sure what the underlying intent to open this thread is but still want to point out that
You are contributing because you are hoping to get something from this vs. donation will be a gift for charity and IV is not a charitable organization.

I have few questions as I am totally confused with if's and but's while filing taxes.
I thought some of experienced guys in this forum can share information on these. I want to know about these as I do not want to make mistakes while filing taxes. As of now I have files taxes through a tax consultant. So, I have not made any deliberate mistakes.
1) What if I transfer money to another persons , say for example to my brother, account in India? Should I declare that account and the amount in it. I have sent little bit of money now and then to support my family.
2) What if you have deposited money in NRI joint accounts with a person in India (again that could be my brother)?
3) what if a person has property purchased with inherited wealth or transferred to his name? Some of you guys said that we need to declare them too or else the goverment would find them. How US government find them if we have not purchased with US earned money (meaning not finacial transactions exist for these kind of wealth)?
1. If it is gift then you do not need to. So if you state that money belongs to you then you may need to show that amount and need to pay the taxes on the interest paid.
2. For the joint account you need to pay the taxes on the interest on your part.
3. If you had asset before coming to US that is not an issue even if you declare. But if you are earning any income on that you may have pay the taxes for that.

The employer is extremely shrewd. They have fraudulent policies and procedures. They said that they are not required to provide me an experience letter. They will take 3 months to provide you with your 1 month salary. They took a sweet 60 days to provide me the last but one paycheck(I called them for that like 100 times). Now, they simply don't send my last paycheck. Please refuse to deal with them at any cost like vermin they are...
I know this person - I think it is a lady. They cater to a lot of companies in Buffalo, NY. Yes, they are a slack - heard horror stories about them

I found the following instruction from the FAQ on the checks for 485 and other forms.
One of the points it tells is "No numerical numbers whatsoever should be written or printed in spelling out the amount alphabetically" while making checks.
However in my case I think I did not follow this.
For eg. in case of 485 where I have to write the amount in words , I wrote it as "Three Hundred and Twenty Five And 0/100 Only".
I have been following this for practice all the checks I did last 7 years here and never had a problem.
Will USCIS reject my check and 485 Application.
Experts please help.
How do everybody usually write this?

"In writing filing fee checks, you should follow religiously their instructions of writing checks. Otherwise, the filing will be rejected for the flaws in the filing fee checks. Here are a few rules: (1) Date must not be a future date; (2) No numerical numbers whatsoever should be written or printed in spelling out the amount alphabetically; (3) Make payable to the Department of Homeland Security; (4) Signature should not be missing; (5) No corrections are allowed. Any minor correction will be tossed out as invalid checks not by the banks but by the USCIS; (6) In memo section, case type, petitioner/applicant name, and "A" number, if any, should be cliearly and legibly written: For instance, for I-140, must write I-140, xyz company, on behalf of John Doe, Axx xxx xxx. For I-485, write I-485 plus finger print fee, John Doe, A----. For I-765, write I-765 (C-9) [If employment-based 485], John Doe, A----, and for I-131, write I-131, Advance Parole, John Doe, A-----. If you do not have A number, you do not have to write it. Make it sure that you keep a photo copy of the checks."
