I remember what you are saying but I think that was a one time exception made for spouses of people who died in the 9/11 attacks.
I would never believe I know better than an immigration expert such as Rajiv Khanna. However, this issue became prominent after 9/11 and there were dozens of people whose spouse died in the towers who were in adjustment of status process. They had US citizen children etc etc.
It is my understanding that a ruling took place that in such circumstances the dependent could still stay here and become permanent resident.
I have no links to post but remember this being a hot topic. Maybe a search in the immigration sites regarding this horrible situation.
My heart goes out to this lady and child. Bad enough losing ones spouse but having to leave your home too is just plain wrong.

I did transfer when my 8th yr H1B was pending and 7th yr had expired. Similar situation (but not fired), frustrated with manager who thought I'd never move and could give me all the boring work to do because no one else would do. I managed to find a company who welcomed me, got me transferred and very soon going to start with them.
Please pm me and I can point you to good lawyers, if you do happen to find new employer and move on, make sure you legally go after the one who got you fired, there are several options for you.

What if my I-485 gets approved before priority dates become current again. I understand we can postpone finger printing. But how long we can do that. For example, if priority dates don't become current for 2-3 years, is it possible postpone finger printing for that long? How much risk is involved?

Please use the WH4 form, you can google it and get this form. DOL lawyers are generally responsive and make sure the company gives you thee money.
Always save all your communication emails in your sent folder - and if you are working for a client - your manager signs the timesheet - report to them about this employer - your manager will not likethe fact that your employer is not paying.
When you file complaint uisng WH4 - include all evidences and DOL lawyers will help you with the stuff.

Agree: I also strongly suspect that honoring the RD is BS that USCIS is dishing out. I feel they are selecting cases based only on ND and approving them randomly since all their systems, tracking, receipt # seems to be based on ND and not RD. Historically the ND and RD were only a few days away from each other and so it didn't matter - but thats another fight.
I agree. A current PD only means that a case is ready for review/approval, but the case number denotes the ND, and they are going by the case number/ND. That is why ppl with PDs in Dec 05, Jan 06 have gotten I-485 approval ahead of me.... (where is my bottle of xanax.... ;))

My 485 was transferred and I got the transfer notice (NSC->CSC->NSC). I am a July 2nd filer. Do I have to care about the date on the transfer notice or I can invoke AC21 180 days from the receipt date?

the rule is how damaged the passport is, if the passport has some water spots but most of it is legible then the passport is returned with a cancellation stamp, if the passport got washed in a washing machine and is mostly illegible then they do not return it. Also if the pages are coming out then they can keep the passport and not return it. It is all done to ensure that if the damaged passport falls in wrong hands it does not get's missused.

Billu, don't do that mistake. If they are lucky then they will get in if not then the consulate will simply cancel their appointment and ask them to reapply again. In that case, they will have to pay for the visa fees all over again and go through the entire process. I think you should take this issue to your local congressman and the senator. That is the best solution and I do not think IV will do anything for this since this is completely an administration issue with the Delhi Consulate. Summer time and too many people are applying for the visa and less staffs at the consulate too.
So do not select English and ask for a translator.
Speaking by experience..Delhi/Mumbai always has translators..thats just how it works there..the only way to get an appointment is to take it in English..go there and ask for a translator..no senator/anyone else can help in this matter..it's pretty straight forward..good luck..

Irrespective of whether it affects renewals or EAD, ( irrespective of whether it affects me or you) we should all campaign against this.
If we are too selfish and look for only how it affects "me", we won't succeed as an organization for skilled immigrants.
