If your argument is that after holding a US Masters , OP will not be a legit EB2 applicant, even you are not legit. Go get some education
Looks like you are also a candidate with three year bachelors degree and a namesake masters from US univ that you bought and which put you in EB2.
Legit EB2 = GRE (good Score) + Toefl (good score) + Fulltime MS/MBA + Job in forture 500
Not legit EB2
1. 3 year degree from India + initial application in EB3 that is later converted into eb2 by buying a masters from some shady roadside univ in the US.
2. bachelors + 5 years experience from some software company in hyderabad, as most people from there have at least 10 years software exerience even if they graduated 4 years ago.
I am sure you fall in one of the two later categories.

I applied for PIO card for my son and daughter and both was rejected as both me and my wife are Indian citizens. I was under the impression that kids who hold PIO card need not have to pay NRI fees during college. Is this something true?

Raju,
Thanks for your suggestion. I did query about the kind of advertising that we can do. It doesn't look like we'll get much money. Since most of the people are viewing the forums and forums typically have low advertising rates because people using them tend to be highly engrossed in the topic.
Still thanks for your opinion.
Admin and Eb_retrogression,
Thanks for educating me on the advertising rates. I will try to urge my friends again. Looks like that is the best option.

I am glad my posting did work.
Hello Junky,
sorry to hear that someone has given you a red. I have a question, how would one know if someone had given red? It cannot see it. Thank you in advance.

Fact Sheet: Who's Looking Out for You?
Green Card Visa Numbers Situation
• The GC process involves Labor Certification (2-3 months) + I-140 (0-12 Months) + Wait for priority dates to become current (several years) + security checks (1 month to 2 years) + I-485 processing once priority dates become current (18 months to 3 years).
• Yearly green cards quota for employment based applicants is 140,000. This includes visas for spouses and children. So on an average; it is given to ~ 60,000 families.
• Country visas limit is 7%, with almost equal distribution for EB-1, EB-2 and EB-3 plus any unused visas from other countries. Generally speaking, for countries like India, approximately 7000 visas (~3000 families) were being issued every year in each of these categories.
• It is estimated that approximately 500K+ (yes 500K) I-485 applications under skilled worker category were filed between July 2nd and August 17th 2007. Most of these applications were from people of India and China.
• If you were unmarried at the time of filing, you will need to continue on current status (e.g. H-1B) otherwise you cannot bring your spouse.
• Employment Based Immigration reforms do not find enough support on the senate floors (Failure of SKIL, STEM etc Bills). As a matter of fact, it does not even get enough support to make it debatable, let alone final voting on the bills.
• USCIS is a self-funded organization i.e. it is run on fees it receives and is short on resources.
What do these jargons mean?
• Priority dates (PD) will remain retrogressed for several years.
• Those who could not file their I-485 now will now have to waitttttt…..
• Due to resource constraints, security checks may take years.
• Once PD becomes current, it takes on an average 1 year to 3 years to get approval.
• Endless cycle of EAD renewals and Advance paroles.
• If working on EAD and for any reason, if any of your EAD gets rejected, you will need to stop working, In other words, need to leave your job.
• You need to be in the same position with same job responsibilities for an indefinite time period otherwise you Green Card application will be rejected.
• EADs are valid for one year and several employers (and rightly so) view it as a temporary permit and hence reluctant to hire you.
• Once PD becomes current, it takes on an average 1 year to 3 years to get approval.
• So virtually you have three options: a) Struggle for several years b) Leave the USA c) Join us.

It appears that you are cracking a joke, but I cannot stop from replying to your post. Why are you asking God to save IV? For the things we cannot do or for the things we dcon't understand, why do we always have to bring in 'God' in the picture? Can't we even crack a joke without brining in God?
I am just trying to prevent world war III on these forums. Thats why my request for not referring "God'. We will all be much more happier funnier and peaceful if we try not to bring in 'God' in the mix.
Next thing you will see, someone will post - "God, when will the VB dates move for my category".
.
we know what you two will do after getting your GC/Citizenship..
hopefulgc will join the republican party.. you will join the ACLU :D

Gulti mentality was something that guy(malibuguy) was talking about . Thats what i meant by Gulti mentality . I just started with a simple question "WHATS THE MOTIVATION FOR CONTRIBUTION(MONEY AS WELL AS TIME) FOR PEOPLE WHO HAVEN'T APPLIED FOR GC " !! Was that offensive ? I don't need answers for specific questions. I just need to know what IV is all about ? ? BTW, i have balls to ask anything to anybody if it makes sense(immigration officer is not making rules) .
Then call senator grassley and ask these questions and prove you have the BALLS!!!! Otherwise you know what it means.

Can anybody answer this question - If an employer decides to port an EB3 case to EB2 for an employee not using the experience gained at the job, does the new EB2 role have to be 50% different from EB3 role?

You are absolutely right. Thanks for correcting me. Its a really stupid law...I hope the officers are not very strict with this.
You are absolutly incorrect. Unfortunatly most lawyer or their web sites do not explain the limitation of "parole". Because most of the CBP at POE are flexible; that does not mean that the law is flexible. This is what the instruction for AP in the form.
"Advance parole is an extraordinary measure used sparingly to bring an otherwise inadmissible alien to the United States for a temporary period of time due to a compelling emergency. Advance parole cannot be used to circumvent the normal visa issuing procedures and is not a means to bypass delays in visa issuance."

So basically it was technical issue??? ... if someone heard what was going on in the senate and what the arguments were against this waiver please post...
May be the senators thought that it would increase the budget size or something???
My interpretation: the vote was not on Cornyn's amendment; in response to a Point of Order raised, there was a motion to waive the Budget Act for Cornyn's amendment (the Budget Act requires 60 "Yes" votes to bring to the floor amendments to appropriation bills); if 60 senators had voted "Yes" (and agreed to waive the Budget Act requirement for Cornyn's amendment), then a vote on the actual amendment would only have required a simple majority. But because only 55 voted "Yes", the amendment failed to obtain the waiver; it was out of order because it did not qualify as an amendment to this bill.
Because 40 Dems voted no on the waiver does not mean they are opposed to the amendment; they just did not want to vote on this amendment on this bill.

Franklin got her gc. She is still such a motivated member. IV is fortunate to have her. I didn't intend to defend her, she is more than capable to do that on her own. Just wanted to add this information because that makes a sea change in raising the level of conversation on this thread.
The contrast is amazing, people who are stuck in the system are not as involved, while members like Franklin and Aman, who have came out of the "limbo" still want to help others.
Now I am more shocked than ever at her level of energy at the rally (which I personally witnessed) I am sure she has been doing a lot more behind the scenes as well.
Those who have done nothing but visit this site, need to look at folks like this and get some motivation and step up to the plate.

[QUOTE=sri1309;...Isnt it a shame that a greencard holder cannot get his wife immediately wheras H1s and others can. They have to be told very loudly... .[/QUOTE]
This favours temporary workers on H1, L1 etc. An H1/L1 spouse can move to the US easily, but not that of a GC holder. If you want to bring out this "discrimination", that would mean to discontinue H4 visas, as seeminlgly it is a discrimination against a GC holder. Is that you are looking for?

Low Expectations for Obama’s Immigration Speech The Washington Independent (http://washingtonindependent.com/90677/low-expectations-for-obamas-immigration-speech)
President Obamas planned speech on immigration reform tomorrow has been lauded as indication of a renewed commitment to immigration reform, as have his meetings early this week with advocates and the Congressional Hispanic Caucus. So what will the president say? Unfortunately for reform advocates, not much thats new: Obama is expected mostly to retread familiar ground on the importance of passing comprehensive immigration reform, rather than offering specific provisions hed like to see in the law.
States arent waiting for reform NPR reports that 45 states have introduced more than 1,000 bills and resolutions relating to immigrants so far this year and polls indicate that most Americans support Arizona-style laws to curb illegal immigration. In theory, the issue should be resolved at a nationwide level to prevent harsh laws from driving illegal immigrants into other states. (Theres some concern that the Arizona law is already having that effect.) But no Republican senator has emerged to back a comprehensive bill, and with midterm elections in sight, rounding up votes for a controversial topic might be difficult before a potential lame-duck session

The whole Insurance investment depends on the persons needs and investment capability. If you are market savvy you would take a term policy for the insurance and invest the difference between the term life policy and whole life policy premium and get a better return when compared to a whole life that on average has given a return of 8-12%pa.
That apart Prudential has a term life policy where you get back the complete premium paid under this policy at the end of the term. say for a 30 year term you paid a total premium of 30K in 30 years,, at the end of 30 years if you are still alive you will get back the 30K.. and if you are still healthy and need a policy at that time you can buy a whole life policy with this 30K which approximately will cover you for about 120K -150K assuming you are about 65 at that time..

chandrajp, many times it's not because of rules. It is common courtesy to go to a cafeteria if one is available. Smell of Indian food in general (it's a fact not criticism) may have a distracting effect in a work location so it should be eaten in a cafeteria (if available). Also, we need not emulate other people's lack of courtesy and do the same thing (like some people quoted Americans eating burgers in their cube). If we have the option, we should eat in the appropriate location.
In addition, with respect to discrimination, I do not condone it at all but we need to do a reality check for ourselves as well. I have never worked in India since I left the country 10 years ago but my friends working in India have told me how their managers have humiliated them by speaking in a regional language in meetings that they didn't know. So wherever there is a difference of culture, language etc., unfortunately human beings tend to behave the same i.e. discriminate against others who are different from them. For example, how do we explain the 'Fair & Lovely' ads? It's blatant discrimination based on skin colour.
Discrimination should be done away from every aspect of life.
