If you don't have revenue, then financial statements from banks, venture capital funding agreements and OEM agreements will work. The company simply has to prove that they are in a position to pay you. Revenue numbers don't mean much. Remember that a company can have revenue but still is not be making any profit.

One thing I have not been able to understand re: RFE and ability to pay etc. is
if cash in bank is good enough or if revenue/profits are important as well.
THe startup I am considering is still in the phase of developing a new product (hence no revenues) but have a good amount of seed money in the bank.

- which company/product will be around for the next 6 years? Is your division making money or losing? Is it growing or are people leaving? Does it have an offshore office where all the growth is happening?

I am getting a raise fo 20% over my current salary.
Workwise:-> The new offer seems little bit better than the present one
The title itself is good " Internet Architect" for the new offer.
Benefits:-> They are kind of comparable
Growth:-> Difficult to answer but the present company is into Telecomm Technology and new offer is from a company into financial services. I am into core IT infrastructure. So the probability of my job getting outsource is more by my present employer rather than by my new job offer. Both company has quite a bit of growth left in US sites.
One more thing:->
My family ( wife + son ) is kind of well settled in our current place, so moving them would be a bit painful for them also.
Also, I kind of like my present job because of few reasons:
1) I am well settled in my company; people recognizes me for my abilities here
2) My family is well settled
3) I am in San Diego and I love the weather here. My new job is in San Dimas which is a bit hot w.r.t. San Diego

Thanks for posting this. I am one of those who got an incorrect receipt date on my 485 receipt notice. I called the customer service back in october 2007 and was told there is nothing they can do about it. I am going to email/call again to see if they can fix this.
My I-485 app got transferred from TSC to NSC.
Original TSC RD= 7/2/2007
ND= 8/23/2007.
Transferred to NSC RD= 8/29/2007
ND= 3/2/2008
I called USCIS this afternoon and this CR takes all my info, asks for my zip, and then says-
"Oh based on the info you gave me and the system says that your application will be processed after 425 days. There is nothing more I can do about this application at this time�
I told her that NSC is already processing application for 3rd August 2007 and there are certainly not 425 days between August 2nd and August 29th.
Then she takes my info again and says- "Yes it will be another year and a half till they look at your application�- and mumbled something about FBI not giving them the info. �Your app is only a year old, there are people who have been waiting for 5 years, so don�t expect your application to be processed"
I asked to be transferred to an IO - she refused and said take an Info pass if you have any more question and hung up!!
So I guess the next month PD being current doesn�t matter........I have to wait another 425 days*sigh* :confused::mad::(:eek:

Sorry to hear your situation. If you dont mind me asking which company were you working when they laid you off? I see lot of this happening in Bay area companies especially the ones dealing in Banking and Finance, are you from Etrade? A friend of mine is also in a similar situation as you.

You can keep both EAD and H1. Lawyers are advising to keep H1 valid as long as possible. This would allow to re-enter the country without the need to use AP.
how can one keep both? As per my understanding, If you are on h1b then you are not using ead isn't it? As long as you are on h1b the same rules that apply to everyone on h1b holds good...if you have applied for ead and ap then, it is helpful only in a situation where your job is at risk...in this case, since you have ead you can switch jobs with ease...provided you apply for ac21

Even though you have AP - the passport remains with US consulate until they reach a decision - could you explain how your friend made it possible to enter US without Passport ?
You can ask for your passport and come back for visa stamp when they finish the processing.

despite all comments here, i suggest you do it. remember that only those people who faced problems would come to this forum to talk about it... for every one person who faced problems there might be 10s if not 100s who went through it alright. i have changed employers on ac21, my new employer's lawyer sent USCIS a letter without my authorization that my new employer will take responsibility of my 140... uscis obviously confused, sent me an RFE asking for the evl again while acknowledging that my lawyer's earlier letter did not address all AC21 requirements (they spelled that out). I responded with the help of my new employer and all is well. no rejections, no NOID no nothing... all safe and all well... i am considering from a long time and now currently seeking to move to self-employment using ac21... i dont see major risks...

I will have to relocate to a different state. My GC has not been approved yet and I'll be using AC21. The new job is in the same area as my current job. Both my current employer and the new employer are Fortune 100 firms.
I am in a dilemma because my PD is EB2 India Feb 02, 2005. It seems to be very close to being current right now :o .. My I140 was approved in Nov 2007 and I485 was filed in Aug 2007. I think that my current employer might revoke the I140 if I decide to leave.

Let us see how many are willing to contribute after filing 485. Even then people will say they are short of funds even $100 because they have filed 485 and spent everything on attorney. All these days they were cribbing that nothing have been achieved, now they will say that it is not because of IV. Some will say, now filing 485 is not enough for me, I have to get EAD and use AC21 portability so that I could earn more and then I will THINK to contribute. If they use AC21 then they will say, I want my spouse to work on EAD so that I will be financially sound to contribute to IV and it goes on and they will never contribute for ever.
Did anybody think of giving a treat to the CORE team?( I am not exactly sure how many are almost full time working employees of IV, without getting paid).

The NY consulate received my passport on Jun 6 2008 and I got my passport back on Jun 21 2008 through US Express mail. I tried to call in between but none of my phone calls or email were answered. I looked up one of the consul generals online and directly called him and got my passport info with tracking number. He was very nice, polite and helpful. I recommend you using express mail because its got a tracking number and you know when and where your passport is. Good luck!

My H1 and wife's H4 is up for renewal this Nov. Ours will be the second 3 year extension of total 6 years. I have some queries:
1) As our I-94 will get expired in Nov and we do not receive approval (but if we have the receipt) before Nov, do we have to leave the country?
2) We applied 485 in Aug. So do we get 3 yrs of extension or 1 yr? Because I heard that after you apply for 485, we get only 1 yr.
