I wish they did the horizontal spill overs more often than just the last part of the fiscal year. This would balance out the work load for them and we can see steady movement of dates.

there will be 2 copies,
one orig that has I94 etc , which we use to take for stamping or other official attachments.
the second one is a copy, my lawyer regularly sends this one for every extn i go thro.
it says:
"Courtesy copy: Orig has been mailed to - <lawyers info>
This document informs you about the action that has been taken on this case"
but for I94 section, this second copy will have everything ditto just as the orig...

Instead of waiting for the core to respond, why don't we get the ball rolling.
We could informally atleast meet up. We could take it a step further and then work with IV core to meet our Senators and Congressmen/woman.
If this sounds like a good idea lets pick a date and a location.

* Who are ineligible to extend their H-1B status under section 106(a) of AC21.
the second bullet-point there refers to the 3 year extension that you get once I-140 is approved. 3rd one refers to the 1 year extension you get if PD >365 days old. So if your PD is >365 days, you are not eligible for PP of I-140

If job position demands + 2 years experience (And it looks like the same), you application will be submitted under EB3. Now EB3 does not necessarily bad with comparision to EB2 as far as GC process is concerned. It all depends upon when you file and at how USCIS take processing approach in coming years. During the year 2004, 2005 lot many EB2 files were processed fast under OLD labor approval system and 485 processing system and now it seems that in coming months more number of EB3 files will be processed. So do the careful research about deciding the catgeory with keeping current 485 processing trend in mind. That to say if youhave liberty to convince the employer as per your need. If you do not have any option then it does not matter, employer will decide the category.
Now EB3 dates are in 2001 where as EB2 dates are in 2004. That makes 3 years difference. These differences will go away unless all dates become current again .

I am on an H1 here and both me and my wife have Indian citizenship.
We are now looking to get an OCI for our 5 months old son (US Citizen)..but strangely saw this on the Indian consulate website... CGI SF Contents (http://www.cgisf.org/contents/view/47)
Q 6: Are minor children whose both parents are Indian citizens eligible for OCI?
Ans : No.
So did something change in the last 5 years or so ?
Our elder kid was born here in 2005 and we got her an OCI for her when she was 1 or so..

Now, they have announced that OCI and PIO will be merged. So, talk to the SFO consulate to find out the latest rules.

1 question -- how many valid days on your visa is required to come back to USA?
Say, I've current visa stamp (from old company) till June 30, 2009 and I've new H1 B valid till Nov 30, 2009. If I plan to go to India from May 1, 2009 to May 20, 2009.
Can I still enter USA as there will be 40 days left on my old visa stamped on my passport and new H1B I797 having end date of Nov 30, 2009? or do I've to restamp my passport for new visa?

I have also re-scheduled my wifes FP appointment about 2 weeks ago and have not got the new appointment yet.I did mention in the letter what time frame my wife will be unavailable. I talked with USCIS customer support and they said that it might take couple of weeks to few months to get the next appointment.

Went there are 8:00 Am, doors open at 8:00 for that office. There is a separate Infopass lobby, where I was the only person waiting. IO called my name, went to window. When asked mentioned here for processing update on my case, as I am current (PD 04/2006, RD 07/02/2007) EB2- IN. She verified the info typed something after a while said NC and FP clear for myself. Said TSC has a lot of apps and that (quoting her verbatim) "Your application is probably in a box in a corner that has not been touched yet. Last time they accessed it was Sep 07" that was probably when my FP came back. NC cleared 07/20/2008. She supposedly sent an e-mail to someone at TSC about this. I think she actually did. She took a memo type doc that had numbers / e-mail ID's on it and typed something for a minute. I asked about my spouse NC. She first said she needs to be there, then looked at me, checked something after enetering A# off her receipt and said " same as you, she is all clear and should get approval with you". I asked so is the next step, assignment to officer for adjudication, she said yes. I asked if visa numbers are still available or is the FY quota over. She smiled and said, hopefully they will pick up your app early next month, else visa numbers will not be available for a long time.
I personally think she was extremely helpful and kind, seemed to understand the anxiety of the applicants, and really surprised me with the e-mail to TSC, which was way more than I had hoped to accomplish

One of the reasons for careful inspection of the PPD site, and clear distinction concerning swelling vs. induration is that we have found many Applicants from India, Sri Lanka, and other areas of South Asia who exhibit either a swelling or a positive reaction. A POSITIVE REACTION MAY ALSO BE THE RESULT OF PRIOR 'BCG' VACCINATION IN THE HOME COUNTRY. BCG IS 'BOVINE CHORIONIC GONADOTROPIN' and is frequently administered in those areas as a preventative. BCG will CROSS REACT WITH THE ANTIGEN TO TUBERCULAR ANTIBODIES AND RESULT IN A 'FALSE POSITIVE' RESULT! Tell the Civil Surgeon if you have had BCG Vaccination in the past.
Today, if such is the case, we recommend to the Applicant that they undergo the IGRA tuberculin test rather than the PPD. IGRA is more advanced than PPD, and does not cross react with prior BCG vaccination. IGRA also eliminates the need for a return visit to inspect an examination site. Thanks for the information. The only thing is that I cannot stay here without an income. So I think I will make an appeal and leave US as soon as possible. Don't want to accrue unlawful status/presence. I read somewhere in this forum that there was a guy who filed an appeal and at the same time filed a new H1 in Premium and got it approved with an I94. So I wanted to ask more people if that is the norm or an exception. I've had a similar experience recently.
Chase Bank denied my loan (used car). But a local Fifth Third bank approved it with a good rate (4.34% for 3 yrs).
So the key is to go to local banks or credit unions.

Easiest way to handle this is to file the tax with H&R Block.
Just approach them with last pay check from your employer (which can indicate approximate total annual income) and explain them about your efforts to get the W2.
They can prepare the SUBSTITUTE W2 for you and IRS will then screw your employer for not providing the W2.
In my case, my previous employer failed to give W2 until March 31 (I called him 20 times and each time I was told that concerned person was not at the office).
So I approached H&R and prepared substitute. But when I was about to file the returns based on it, I called my previous employer and told him
"If you are not providing W2, not me but you and your company will be in trouble, because IRS will ask you the reason."
I received W2 through fax in next hour!!.
So keep trying and then approach H&R

It seems if you have a lawyer, nothing to worry. If you mail by yourself, do mail through US post office.
