Ragz4u,
Asking to recapture 90K unused visas will get our PD's near respectable dates and will also help Schedule workers. This is probably the least we can ask for ?
Just a thought
But the fact is that even if we get one provision in, that will be a big big win for us. Please read my previous post in this thread which details why this task is so difficult.

94 days and waiting. I just wanted to check, what are my options? I have travel plans for the month of November and my current AP expires on October 5th.
If anyone can suggest something, that will be great.
After waiting for 95 days, we got out approved AP's today in the mail. The online status still says received and pending. Me and my spouse only had one LUD and that was on the 4th of September.
Thanks a lot.

:mad::mad:It is amazing while people on group have started thinking about renewing EAD/AP. I,m still waiting for my EAD to come despite of calling customer service and visiting local USCIS office and getting SR generated.
I filed everything in july (I-140,$85,131,765) I have not received EAD yet.
After 60 Days of SR I received letter from USCIS saying
" After doing research on my case they found that my case needs further review and I should wait for 6 months before calling contacting uscis office"
My Question is
Is any one had similar experience? please post here or it is normal/common.
What next I can do ?
PD Sept 2004
I-140 pending
I-485 pensing
EAD pending for self, approved for spouse(Oct 16,2007)
AP approved for both (1/11/07)

Milpitas , CA 95035
Main Phone: 408-262-6242
When:

Also its not a requirement to have your original receipts when you come in to U.S(Please check murthy's articles on this). Most of my friends travelled into U.S without receipt notices. So you should be fine if you travel with a copy of receipt notice.
Not true. Current regulation DO say original receipt is needed. Whether USCIS enforces this or not is a different matter.
This text can come in useful to send to your lawyer if you ever need the original notices (planning to change employers, hence change lawyers too etc)
See the exact text of the regulation:
http://immigrationvoice.org/forum/showthread.php?t=12930
Anyway, here's the law (copy-paste) from the Code of Federal Regulations[Title 8, Volume 1]:
(C) The travel outside of the United States by an applicant for adjustment of status who is not under exclusion, deportation, or removal proceeding and who is in lawful H–1 or L–1 status shall not be deemed an abandonment of the application if, upon returning to this country, the alien remains eligible for H or L status, is coming to resume employment with the same employer for whom he or she had previously been authorized to work as an H–1 or L–1 nonimmigrant, and, is in possession of a valid H or L visa (if required) and the original I–797 receipt notice for the application for adjustment of status.
---------------------------------------------------------------------
To get to this law (pasted above) in the Code of Federal Regulations[Title 8, Volume 1]:
1. Go to the Code of Federal Regulations main page: http://www.gpoaccess.gov/cfr/index.html
2. Type in "8CFR245" in the Quick Search box.
3. On the results page, #25 will be "[2006] 8CFR245-- PART 245_ADJUSTMENT OF STATUS TO THAT OF PERSON ADMITTED FOR PERMANENT"
4a. Click PDF and go to page 506 (pg 12 of the Adobe reader) and see section (C), seventh line from top for the law quoted above.
4b. If you don't have a PDF reader, click the TEXT and when the browser opens, search on "(C) The travel outside" to get to the law quoted above.

Can you please provide the address again for those of us who may not have the original letter that came with the ITIN number with us.
Thanks
The IRS has multiple ITIN units with separate jurisdiction areas, therefore it is important to address your correpondence to the specific unit that issued your ITIN to get faster response. Here's the address for the Philadelphia unit.

My wife had the same issue 2 year ago. Couldnt start a project coz they needed SSN for background checks. I contacted the Congressman's office and they inturn called the DHS and SSN office and made the SSN office talk with DHS. That speeded up the process. Hope your brother will get it soon... I know the pain.

this is a bill that will never pass..
how will they ascertain the duration of stay of an illegal.. will they do carbondating and travel back in time..
I am not aganist illegals and the human factor here.. but there must be a differentiation between ppl who walk across the border vs. ppl who dont ..
I will be a million $ that this bill will be trashed...
CIR is only for makku's not for EB..we are screwed if this bill passes..
I also read that section twice and I believe that is applies to anyone who has been here for 5 years - it does not distinguish whether legally or illegally.
There is nothing in the bill that increases employment based immigrant visas; even getting a non-immigrant work visa would be tougher than it currently is.
Most of the provisions of the bill would favor family based immigration.

Not sure if Michigan Governor will consider out of state letters as you guys aren't impacted by state law.
Can Out-of-State (OOS) residents also participate in writing these letters? I am from Florida and willing to write letters (hand written) to address listed in your template from my end and wasn't sure if I give my Florida mailing address would make any difference..
please advise!

Hi,
If you don't mind, could you answer a couple of quick questions;
1).We are asking for "re-issue of passport" when our existing passport is near to expiry?
2).Sending in application thru mail or handing it in personally, both options still require us to fill out the "online application" mentioned on the consular website?
3).The address that we want on the passport (as asked in the online form) is our US address?
4).What documents did you send for "proof of residence"?
5).Were any of these notarized?
6).For "Porfoma Verification" question 11 and 12, are we mentioning the original date of our leaving India the first time and consequently the number of years that we have lived in the US?
Thanks in advance.
1).We are asking for "re-issue of passport" when our existing passport is near to expiry?
Not really sure. When I did, I chose "New Passport" (this is back in 2006 thru paper, which says New Passport after 10 years)
2).Sending in application thru mail or handing it in personally, both options still require us to fill out the "online application" mentioned on the consular website?
YES. Now it is mandatory.
3).The address that we want on the passport (as asked in the online form) is our US address?
Only US Address.
4).What documents did you send for "proof of residence"?
Utility bills, electricity, gas, water
5).Were any of these notarized?
All of them :)
6).For "Porfoma Verification" question 11 and 12, are we mentioning the original date of our leaving India the first time and consequently the number of years that we have lived in the US?
Honestly, I don't know what change this is going to make. But I put the the date I left for US and said stayed for 6 years, eventhough I made 3 visits to india inbetween.
*** Remember to keep your OLD PASSPORT all the time you travel back to India. The POE Officer took a deep look when he saw my new passport issued by DC Embassy, when first time I went back *** (May be because all passports issued in India now have electronic printing and from DC they wrote by hand and huge stamp says WASHINGTON DC)

I dont know whether IV would be able to move something on this issue. A lot of states are now issuing the temporary or non renewable lisences. Each time the visa is extended we have to take the whole test (computer and driving) to get a new lisence. I called the official (DMV) and he said that since the lisence is a non-renewable one, on expiry we essentially dont have a lisence to renew and that is why we have to retake the whole test. He said that this seems ridiculous requirement but that is the way it is now. Since this is a state issue I guess as a group IV members cannot do much either. We just have to prepare for the test each time.
We may need to start a campaign and contact pro immigrant congress men/woman and block this at federal level. Otherwise this discrimination will continue. Just debating over here wont help and someone needs to bell the cat.
Thanks

BTW, if I were you, I would also send in an EB-1 (extraordinary ability) petition. It's a little bit of a crapshoot, and people can get approved for one and denied for the other, with no trends behind the reasoning.
On July 2nd, the NSC received my I-140/I-485 concurrent filing EB-2 NIW application.
I just read in www.immigration-law.com this statement in the summary of the USCIS announcement:
"USCIS will reject EB-485 application with a labor certification waiver EB petitions ( such as EB-1, NIW, etc) concurrently filed with the I-485 if the priority date is not established before end of July 2007. It is thus extremely important for the labor certification waived I-140/I-485 concurrent filers to immediately file I-140 petition first before the end of July 2007!!!!!!!! Please use e-filing."
To date, I have not receive any receipt notice from the I-140. Does anyone know if I should re-file the I-140? Is anyone under the same situation?
