I am in boston area & if we are planning for a rally count me in.
We should try to find roughly how many can attend IF we plan one. I can ask around 35-40 friends.
In some other thread I read,
test101, hebron & Munna Bhai are from boston area and have all shown interest in attending the rally.

I am no longer in the race. My race is over. But to look back here is what we did
a) Visited Washington DC , mostly on our own expense
b) Organized numerous meeting in NJ to increase the awareness
c) Coordinated DC rally
d) Handed overthe fliers at the India day parade urging people to come and help.
e) On the negative side for few , I also participated with few others to make all IT jobs, zone four.
What we were trying to do was not only for oneselves but ourselves. Unfortunately, the awareness is just not there. Ideally, I would have expected people with later priority dates to be more active but they are not . Almost all of "active" us had PD from early 2006 or earlier and most of them EB2. Now guess what, we are done and we could have been a great and powerful organization, but for your support. Hence, I have issues with the folks in our community for the following reasons
1. Not looking out for themselves.
2. Expecting too much from one group/persons and not taking inititative themselves.
3.Not educating themselves on what is the difference between legal /law and administrative rules, DOC VS DOL VS USCIS.
4.Not being able to analyze what can be done or cannot not be done.
5.Just being afraid to even talk to a lawmaker.
6.Asking those who take inititatives do things with an authority as if we were paid to do this on your behalf.
7.Not realizing how much your are loosing or can loose because of your precarious situation.

Nobody wants to contribute any money and wants it all free. They will pay lot of money to lawyers though.

Hi I am currently on H4 and I got the H1 approved effective from OCt-08. Since the market is bad I still did not get the job and hence I do not have any pay stubs.

My opinion, its one of the stupid move to change jobs now. Going to contract from FT that too you have a better salary....
Whatever it is at this point they is no point in changing employers. Who cares whether it is microsoft or google doesnt matter....get your GC and your freedom and do whathever you want.
Wait for 2 more or even less yrs at your present company as FTE.
Joining consultancy at this stage is inviting troubles. Never trust any consultancy...they say 1000 things before to get in once you are in....everything is under they control...you are a pet....

Practically the I-140 PP does'nt help everybody. But it helps people like me who are now zeroing in on 6'th Year.
Only with this kind of thing, i can get 3 years extension , otherwise with 1-140 being stuck, i can get only 1 year extensions which is bizarre.
They practically thought every possible scenario and selected few to help them
The guys who are whining, they will leave their employers once -140 is cleared since they might have got 485 in the last year open gate.
There are lot of things in you and your family that might need to pay attention to get things done right way.
Dont point Fingers at USCIS. They are hearing us. They have to go by whats defined to them as regulations.
We have lot of things to do on our side too before whining at someone.

I have checked with my OB/GYN and he said it's absolutely fine and coming to the insurance part, If I go into preterm labor in India, we could afford those medical expenses so even if insurance doesn't cover that should be Okay.
The reason for visitng is both my husband and I lost jobs, I want to take a break and visit India while he still continues his search, if something turns up before june that is even better. I'll checked with Indian airlines whom I am intending to use for travel and they seem to allow uptill 36 weeks...
My main concern is issues at port of entry....

Sorry to hear. U ask someone from India to get a letter from the hospital abt ur father health and fax to u. Then take that to local office. They will issue 30days AP. Last yr i did it for my mom. While going plz fill all the AP application as You use to do normally and take with you.

But if I talk to him before, does it not give them an indication that I am plannig to leave. I am not really planning to leave, but would like to keep the options well planned just in case. I wish I could discuss with them, however would like to know what are my options.

I have a valid passport issued by Govt. of India.
I believe that if I have a passport issued by India, then I do not need a transit visa. (if flying by British Airways) - Can someone confirm that for me please?
I am planning to fly British Airways.
I do not have a valid visa, will be getting my passport stamped when I visit.
I have my EAD and AP.
The British government website for transit visas has quite a view exemptions. I just want someone to let me know that I should be ok even if I do not have my H1-B stamped.

HI Guys,
I got an RFE for the photos even though I have E-Filed. I am not sure why they have requested for photos. I am done with Bio-metric appt and Have responded to the RFE with the photos today. Waiting for the response.

You can use a previously approved I140 for a new case BUT please let us know that this is not applicable globally.
a) If you refile a new petition from the same company, you have no problems as your old labor still is yours.
b) If you refile from another company and if the previous company uses up your labor and files I140 for another person, the I140 date is no more yours.
c) If you refile from another company and if the previous company revokes the I140, the date is gone.
My company is planning to move me to another location and I fall in category (a) as of now. When I came to know about it , I did get the idea of jumping ships and keeping my PD but soon found about (b) and (c) from another lawyer. Maybe I'm still wrong.... Can someone confirm if (b) and (c) is correct interpretation on my part ?

She is NOT out of status. H4 is not tied to any employer, it is linked to H1 status only. As long as H4 I-94 date is not passed, she is in status. She can file H4 extension anytime before I-94 expiration date. All she needs is, your latest H1 approval notice.

I have already written a letter to the investigative services. I sent them a nice polite letter. When I called them, they acknowledged the letter and made an effort to track the documents they never received. In our case, our documents were either lost by the DMV office or never sent. Finally, they gave up and asked us visit DMV office to resubmit documents. Hopefully, it works this time. I'm going to wait until June to see what happens. If nothing happens, then I'll probably write a letter to the commissioner of driver services.

But once GC is approved with an employer, you need to remain with them for some time otherwise you will have the burden of proving, during citizenship, that the GC application is not a fraud. How long you have to stay with the employer is not mentioned and might be considered case by case. Some attorneys like Murthy suggest to stay for at least 6 mo. Some think 1 year is a safe period. But I have never heard of a citizenship case denied because of this.
Besides to answer OP, in my knowledge such agreements in which there is no fixed time is defined (like 12 months) are not valid. check with attorney. One my friend was in similar situation that he can not move till 2 years (if and) when he gets GC. He checked and lawyer said it is invalid and just a scare tactic. He moved on with AC-21 almost a year back and no issues so far.
so speak to a good attorney and enjoy freedom!

I don't think these big guys will read the letter and I don't think there will be a big chance to meet them face to face either. But if they receive more letters concerning the same issue, things might change.
I have noticed from the replies to my letter (and fax) and also those of the members on the forums that mostly we get a very standard letter reply letter associating our Green Card/Retrogression issue with one of the following
1. H1B increases or
2. Illegal Immigration.
This is probably because the staff never reads most of our letter fully. They just glance and when they see it is about immigration matters, they associate it with one of the above.
It is very important for us to differentiate ourselves from the above issues, esp. illegal immigration. So, I believe that the best way for us is to try to meet the senator/congress(wo)man in person and try to educate them of our particular efforts and situation.
