Use a competent attorney. Do not try to handle this yourself. I am sure that you have heard of "you get what you pay for"...
BTW, are you one of those cases with a 3 year degree + Experience, working in IT? If yes, the I can see why your I-140 was rejected. Lot of people have had this issue, but I do not know how many have successfully been able to resolve it.

The OP claims his 140 was approved. If they went back and rejected his 140, without request from his ex employer - this would be the first time I am hearing such things happening.

Patton Boggs is a lobbying firm. Not a single person.
IV has it's own lobbyists and has been using their services to get Green Card increases attached to various bills. Good lobbyists cost a lot of money like good attorneys. Though IV has hired the services of one of the top 10 lobbying firms, IV is limited by funds in utilizing their services. Most of IVs funding comes from few recurring contributors and other members who contribute one-time every now and then. Most of the money gets spent on these lobbying efforts.
There is a general tendency here to blame IV for not trying to attach increase in Green Cards to every immigration-related bill in the Congress, or not doing more lobbying. Members who blame IV need to understand the constraint of operating under limited funds and the necessity of making wise investments in only those efforts that are likely to yeild the most benefits like the Admin fixes campaign which has a better of chance of passing in an election year than the immigration-related bills.
If IV had more regular contributing members and more funds, IV would've tried to attach it's measures to more bills and we would've had a better chance of success. But sadly that's not the case. We need to appreciate that IV is doing the best it can under the circumstances.

I agree, FP does not have anything to do with namecheck. I never received my FP for 15 months but inbetween when I took infopass - it was confirmed that my name check was done
I was under the same impression that it was FP that triggered the name check. But this is what the lawyer told them that their names were struck in NC and that is why they never got FP and now that NC is over they received FP notices. The interesting part is that within 3 weeks of FP one person got a notice that his application has been sent to USCISlocal office for further processing which I assume means interview notice in few days.

There is nothing to discuss on this. Just take the cash to any national bank SBI or ICICI or UTI and ask them i want to wire trasfer to US bank account. They ask you to fill up wire trasnfer form by giving US bank accout and routing numbers. They just do it by taking some fee for wire transfer. Thats it. You will get into your US bank account in a day. Thats for sure. I did this number of times. I don't know, you guys make it complex everything, by saying NRE/NRO/RBI etc. It just damn simple, do wire transfer.
I know this is possible although I did not try this. I think you need to get a certified letter from CA. But can you give the money from your account and again have them gift you ? I mean wouldn't the bank check this is the same money that you gave to your parents previously.
Btw, you can get upto $100K from your NRE account without RBI's permission. Also you deposit your Rent, interest etc that you get in India, into the Repatriatable NRO account and repatriate here in USA.

There was no RFE at all . Infact I was following up my case through my congressman's office and we always got responce back from uscis saying it is under "Security review" .
The email says "application denied." if it says RFE , I would not have such a shock .
it was reall gard day for me y'day when I sow that . I was almost on the werge of closing a house deal this month and with this 485 issue , I don' think I want to take the risk of buying the house now.
Though I do have little bit hope if it is because 140 revoke and we can prove the AC21 documents , it will get through .

Shirish has a very valid point. I think it should be six months after I-485 application as pointed in AC21.

Thanks for the reply , let me file the H1 transfer with Employer2 now in "Premium route" with the I-140 approval from Employer1 and see if we get a approval. Once i get a approval , i think stamping it wont be an issue after 7-8 months even thought Employer1 has revoked that I-140 ?
However i want to clear even if the Employer1 revokes this I-140 my PD still remains locked - right ???

No, I-140 must be active in order to extend H1-B beyond 6 years.

I know I am not going to get my GC righ away by attending rallies/meetings and activity's. But there should be an efforts from every one to raise their hand and contribute for the cause. Appreciate the core members and state chapter leaders for your vision and work.
At the same note,I regret for not being at DC after meeting some of the members yesterday.
Before, I have little/no idea of how to approach lawmakers (my idea of meeting lawmakers was like meeting politicians in INDIA, Zindhabad...Zindhabad type), glad i do now :rolleyes:!
Main concern/talk was about not many people turning up with 3000 IV members in the tristate, I strongly believe we can do much better in the number department for the next meeting. Again, not just numbers but with some motivation to take part in the events to come.
I did not like the leaders thanking the members just because they turned up! It should always the other way around, members should thank the leaders for organizing such events. After all it is for ones own benefit, no one is doing a fa�vour to any one!
Come on folks, join ur state chapters.

Few months back, 2 DMV officers gave me a tough time in CT. I wrote strong complaint and got a reply that, it will be allright if I go again and I went for the 3rd time and got it without hasstles.
Here is what happened
Dear Mr. XXXXX,
This reply is in response to your email of 5/20/06 in which you
describe
the difficult time you have had in obtaining a CT license. Please be
advised that if the documents are not acceptable when you return you
may
ask the Sergeant or Supervisor to complete a form for 'Review of Non-US
Citizen Documents'. In this process copies of your documents are
forwarded to our Branch Operations Division for further review. You

be notified of the outcome by mail.

them. My company sends me on work assignments to various clients all
over the United States. I recently started on a work assignment at
Pitney Bowes located in Shelton, CT. All this while when I am in United
States, I have worked in the states of Georgia, New York and Washington
and have obtained drivers licenses from all these states. I have
maintained legal status and always carry my documents whenever I
interact with a govt agency like DMV.
From the time I have started my work assignment in CT, I have
approached the DMV twice. Both the times I was turned back saying that
my documentation is not acceptable.
First experience:
DMV, Bridgeport, CT:
Issuing officer wanted a document from my employer that says that I
am still employed with them and have not switched employers. I asked
the
officer polietly if there is anything she is expecting to see in the
document (in terms of information like kind of work, nature of work,
place of work etc...) and she was very kind in explaining to me that
all
she wanted to know was if I actually work for the employer who holds my
visa. I told her that I will come back again with the letter.
DMV, Hamden, CT:
After obtaining a employment letter from my employer I chose to go
to DMV, Hamden, CT because it is close to my home. The issuing officer
looked at all my documents and then told me the employer letter was
unacceptable because it is generated by a computer. I asked him what
document is he actually looking for. He said he cannot accept a
computer
generated document. I was confused. Then he showed me my employer
letter
and told me he cannot accept it because it is printed from a computer.
I
told him it is generated from the computer so whats wrong with
employment letter generated from a printer connected to a computer. I
understood what he was trying to say. He just had concerns with the
validity of my employment letter.
Nothing wrong in having concerns about validity of employment letters.
He was just not able to express that to me. As I have the habit of
carrying all my documents, I showed all my legal documents like LCA
(that I am working in Shelton, CT) , my h1b documents etc... to make
him
comfortable of the fact that my employment letter is indeed valid. But
at this point he just did not want to listen or see anything instead he
kept arguing that this is CT and rules here are different and he would
not see any documents or papers and he only wants an employer letter.
And I told him that is right in front of his eyes. He says he cannot
accept it because it is a computer generated document.
Then I asked him what he really wants? He argued that he wants an
employer letter that is not a computer generated document but a actual
document. Then his collegue came to his resque and told me that he is
actually looking for a document that explains clearly the reason I am
in
CT and details of my work location from my employer etc... I asked him
to write it down in a piece of paper what he actually wants. His
collegue wrote down in a piece of paper that an employment letter
stating my work location as Shelton, CT is what they are looking for
and
I can get my out of state license transfer once I have that document. I
wanted a official letter from the issuing officer stating what they
really want and they were not willing to give me that. So I asked him
again what he wants next time. He said he wants a letter from my

visa holders is to actually ask for recent paystubs and w2 forms. These
forms have employer names and if any H1b visa holder. If the issuing
officer has concerns with documentation validity of a h1b visa holder,
then the best thing would be to have a employment background check done
or look at paystubs and w2 etc... Or specify what kind of letter they
are looking from an employer so that they can be convinced that the
candidate is a valid visa holder.
Though I will be going back to the DMV sometime next week with letter
they requested for, I felt it is my duty to suggest to DMV a good
source
of validity for h1b visa holders.

The Employment Based Immigration section explains how they will make a task force to prevent illegal workers from being exploited. I don't see anything for legal EB workers other than this 5 year thing which will start counting after this law is passed. :mad:
