I read through some of the 148 comments posted. It explains the sorry state of affairs and the understanding of the common people. Most of them don't understand what the topic is and lot of comments on illegal immigration. Sheer ignorance is unbelievable. Time to educate these folks.
I have seen a couple of sane voices though.
I agree with you priderock. The comments are so IGNORANT and stupid. GC seems like a lost cause now with such a restrictionist sentiment in this country. The falling dollar, the rising trade deficit, the ignorance of people and it seems to be becoming more socialist

I work for my company in city A. My GC application is in process (I-140 is approved in EB2 category with a priority date in Dec 2007 and I-485 has not been filed). I have received admission to a top 10 business school in city B (in another state) for a part-time MBA program. I wish to relocate to city B to pursue the MBA and still be working remotely in the same position for the same department from our company office in city B. Once the GC is approved, in say 2-3 years, I would relocate back to city A and continue in the position that the GC was petitioned for.
My management is in on board with the plan but our immigration attorney is recommending against it claiming that there is a huge risk of GC denial. Her argument is �The GC application is premised on the fact that I intend to work for my company on a permanent full-time basis in the position and at the location described in the GC application. I must maintain that intention throughout the GC process. By relocating to pursue an MBA, it looks like I don�t have that intent and USCIS could use this as a basis to deny my GC.�
I desperately want to attend the business school in city B but not at the cost of risking GC. In order to make this decision I need to assess the risk involved. Please help me in estimating the risk!

If you see the way things are moving, no one can completely eliminate that possibility (of EB2 worldwide retrogressing as well).
ImmigrationVoice is working hard to solve this problem for all employment based categories by supporting measures that aim to increase the overall EB quota. High skilled people who come to this country don't have to go thru' such a long wait.
Immigration voice's efforts will go a long way in solving the problems.

Yes, H1-B renewal application will not be abondoned when the applicant travels on AP while it is pending. This is what Rajeev Khanna told me.

Recently I got a RFE for medicals. Everything is clear except the TB test
My TST test showed 10mm induration. Subsequently I took a chest x-ray, a while back the clinic called me saying they are looking at the results and they are not conclusive. Apprently radiologists have recommended a CT scan. The doctor says he would not want to take a CT scan, he would rather recommend me to the local county health clinic for confirmation.
1. I have only one week to respond to the RFE. What should I do if I do not get the response from country health clinic in time?
2. What if they recommend further tests, whose results would be known after the RFE response date. What should I do then?
Pls advise, I am confused

August 03 2007 USCIS Receipt date update from Nebraska has Typo. It has menioned 07/112007 instead of 07/11/2007 or something.
If anyof us submit an application with minor error like wrong check amount USCIS rejects the application instead of giving RFE, however, when USCIS issues updates with Typo it covers itself with the another update or doesn't bother?
I think, appilcants are at the descretion at the hand of USCIS?

Hi,
I recently graduated from a MBA program and have found a job with a top Management consulting firm, very interested in it. But, my I-485 is still pending, nearly 3 years now(I-140 approved). Not sure what my options are, would like to use EAD/AC21, but jobs are different (am a business systems analyst in my current role).
I will also be speaking with my immigration lawyer, but would appreciate your response/advice.

Thank for positing information about lame duck session from Mathew Oh's site. However, this is not yet a confirmed report yet. The current situation is that everybody is waiting for a decision on the length of lame duck session. If the leadership (in the congress) decides to do 6 weeks lame duck session, in that case we will get an appropriate vehicle for our provisions. But if the Senate/House leadership decides to do a 2 weeks lame duck session, in that case there would not be any bill.
We have a plan and we are on top of things. Also, please know that with your support, Immigration Voice is also growing stronger and we get more update info. But acting prematurely would not help in anyway. Webfax is a very important component of IV�s efforts. IV (and other like minded organizations) are all keeping our fingers crossed, hoping for a decision for a 6 weeks lame duck session.

If you quit this job and find another on AC21 portability both of your i-485 is valid. Even at the time of GC if you have a valid job on Ac21 portability then no problem.
The problem occurs when USCIS issue an RFE to get more evidence to see if he is still a dependent. They may ask for join bank acc or house on both name or marriage certificate and proof so on to prove u both are husband and Wife...
If thier is no proof to provide this then his i-485 will be denied along with EAD and AP.
I suggest you to think over this comely. You can even pray to god tell him what u are undergoing now. And from my heart I suggest u to please stop applying for divorce. May be u can live separately for a while that will give some time to settle down and wipe out the bad moments between you two. And some time later I assure you both will live happily together.

I submitted labor certification in 2004, EB3 have been waiting since then...in the meantime my husband and I are separating. I was the primary on the green card case.
If I quit my job, is he gonna loose his EAD, or the EAD remains valid until the validity date?
Does he have options to still keep the green card case open under his name?
I would appreciate any input. My personal life couldn't weather the long wait, but I am really worried that he would loose all his papers if I quit.
It would be great to know what his options are.

Hi Guys - had a quick question and wanted to put to out to the forum guys for inputs...
I am with company A on H1B and filed my GC through company B ( Labor approved EB2 2006/I-140 approved in june2007) filed for my I-485/EAD thru company B on July 2nd ,received my EAD last week.
Since my H1B is expiring soon I wanted to work with company A on my EAD,would this cause any issue's,my title with company A is different from what I filed for my GC through company B.
I do understand that I am not obliged to join company B untill I receive my GC as it if filed as future employee,my question is do I need to file for any AC21,or am I fine working on my EAD for company A now.

You can work with Co.A on EAD, but its safer to wait 180 days after I-485 receipt date. Just let USCIS know that you are using AC21, so that there are no issues later.

Even otherwise it is like that, Whoever is Permanent resident have to pay tax if you are working in US, and you cannot remain out of the country for long, I think more than 8 months. So this is not a new thing.

I'm a US citizen, a senior consultant who often works as a 1-person company (S-Corp).
My brilliant girlfriend from Bangalore, who works as a IT Project Manager, is arriving (on a 10-year B1 [business visa]) March 27 to stay here (NEW BRUNSWICK, NJ) and build a future with me.
QUESTIONS:
Is the B1 any use in getting an H1-B?
What's the best way for her to get an H1-B? Apply immediately to NJ firms when she arrives on March 27?

If you are a US citizen and if you plan to build a future with her and the best approach is the get K1 visa (for the fiance/fiancee of citizens). its valid for 6 months and its immediate. Then if you marry her, you can apply for her immigration as spouse of US citizen. While her application for greencard is pending, she can get EAD and that would allow her to work.
This is THE BEST route for US citizens who want to plan a future with foriegn born individual. You can talk to an immigration lawyer to confirm this.
Visitors visa is a non-immigrant visa and she is bound to be having "non immigrant intent". If she applies for H1 after coming here, it might run into some scrunity and inquiry. It would cost to reply to that inquiry.
Secondly, if she doesnt get H1, but even gets married during her B1 stay, it would still run into some scrutiny by USCIS as they might think that she had immigration intent all along and circumvented the long immigration process by entering on B1 and adjusting status to H1 etc or getting married.
You need to be careful before planning all these steps and get paid legal advice otherwise you will run into nightmares of epic proportions.

Visitor visa, cause they want to make sure that u are self sponsored, have enough propertly etc in India to return....if u send sponsorship docs or support docs they think they will not return
