    So many replies to this thread and only 7 votes... Something is not right.. ARe you guys taking the poll on top of this thread.

    Thread is addressed to inactive members and so logically Poll seems to be meant for "Inactive" members. I feel if I am active, I should not vote to that poll because if I am already active so in future "generally" I will remain active.

If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.


    How much time does it take to get this. I am going to be out of country on Nov 4th. will there be any issue If I cannot make it to the finger printing.

    I feel for your condition.I am in the same boat ........

    For question 1- not sure if can apply I-140 from company A even though..employed in company B.

    Question 2- Can apply thru company B thru PERM simultaneously.

    Not sure about these...better contact immigration attorney.

    looks like you got a PM as your answer. Can u share it please. even I need to know if the approved 140 from the previous employer be used with another employer. Can u post as much as in detail.

    My case, current LC replied 45 letter in Feb PD is Dec 2002 (tragedy is it is EB3/India) and current employer is worse than a blood sucking leech(is making me work on Saturdays, leave alone pay me time and half or time, he refuses to pay me saying the project is on loss, but pays the other guys)

    I want to get out of his clutches, he feels I should wash his toilets too for this GC favor..!!

    Actually across the board americans are very concerned about the pouring illegals into USA and they are all united and look forward to Tancredo.
    whether you agree ot not it is true.

    You can yourself see where does democratic party get votes only in the liberal weat and northeast and the manufacturing states of michigan, indiana
    and illinois.

    Not that it really matters but Indiana is a red state. Very rural communities all voting republican.

    Did you call DMV? Did they give you any updates reg. SAVE verification of your EAD?

    I went last week and they had verified my current, soon to expire, EAD card but not my newer card because it's not in effect until November. So they renewed my license until November only.

    Thanks Ab, your post make me realize even more how lucky I am. I was really stress about the H1B..so stressed about it that I paid out of pocket the premium processing fee just to find out ASAP and move on with my life.

    I know that in some area of the country the demand is higher. In Tennesse the demand is high, so high that 2 pharmacy schools just opens "at the same time" this year..of course once they graduate they will flood the market, but for now it's seventh heaven here for us foreigns. It's also important to target the right company.

    -Target pharmcacy won't file for work visa, I had them on my list on interview day, but my chinese friend went and they told her not to bother, they don't do it.
    -Walgreen and wal mart will do it but they wanna send you where they want cz of yur status.
    -CVS and Rite aid will do it and location are negociable

    But I think the bottom line, when you go to pharmacy school here in the us, is to network while in school. Do not wait until interview day to find an employer. That's what I did, I went to interview day knowing that I already had 2 jobs on the table. I would not stress enough to the one dat r still in school in the us, to work on CPT during school, make connection, make people like you and once you graduate they can tell their boss that this one is staying with me in my area.
    My CVS people here are earger to please me, to find me a location that I like, why should they care?. after all I am just another H1B to file for, us pharmd or not. That why I think making connection during school is the key.

    Thanks for replying it in really simple words.

    There is nil chance that premium processing is going to open in near future. So there is 99.9999 chance that this guy will have to return back to his home country.

    (a) If he does not change his employer, he will still be able to keep his green card under processing. Right?

    he can keep the GC going even if he is not inside the US on H1. Its upto the employer to keep it going.

    (b) As per the law, to get new H1 this guy will have to be outside of US for a year. Right? If his green card is under processing will he be able to get a H1B sponsored from the same employer after a period of 1 year? {{ I am assuming here that his I 140 is does not get approved for next 1 year }}

    (c)Another question, if I 140 gets approved in 3 months (less than a year) will he be able to come back immediately by extending his H1 (excuse my terminology if it does not make sense)

    yes, apply for the I-140, getting that approved will lock his Priority date.
    If he ever restarts GC again, he will be 'earlier' in the queue.
    I-140 approval has no bearing on H1-B approval as H1-B is dual intent. Getting a non-immigrant visa for the US could be harder (F1/B1) once he has filed the I-140

    This is really a complicated case and I am just wondering is there any way it can be solved (other than premium processing for I 140 option) I know that he will have to talk with his lawyer. His words "something should be there" to help case like his.

    recapture of time spent abroad might be the best bet (starting from right now, see if he can start working remotely for a couple of months)

    Along with the letter, instead of just asking for the raise in limits and recapture, why not also propose the H1 cap based on country, this will help them to clean up the existing system effectively...

    Hey there,

    I'm going through all that right now. I went to the Driver's License place last Wednesday and it was a pretty bad experience.

    My license expires on 10/6 and my EAD on 11/5. But I already received my new EAD that expires on Nov 2012, so I was hoping that they would give me a new license good until Nov 2012 instead of 11/5/10.

    So I hand both EAD cards to the woman behind the counter and she tells me they can't use the newer card because it's doesn't start until 11/5, which is ridiculous... so she tells me that I have to use my current, soon to expire EAD and then they will give me a license valid til 11/5. Then I would have to go and renew again using my new EAD. SO annoying. So she tells me to sit down that they are running my name on the computer. After a while she leaves the counter and tells me some other woman will call my name shortly.

    After 20 minutes, this new lady calls my name and I have to go through the whole explanation again, and she ends up telling me that I should wait til 11/5 to renew my license. So I ask her, what am I supposed to do between 10/6 (my license exp date) and 11/5? She tells me she doesn't know, to just wait! I ask her if I"m supposed to be driving ilegally to go to work and she tells me she's not saying that I should drive. At that point I'm very upset and I tell her that there must be someone in that building that would know what to do with my case and she says she's the manager!!! Then she says that if she enters my new EAD on the System, that it would be rejected and that I would have to wait 30 days to try to reapply (???). So I told her to run my current EAD instead and she told me the system couldn't validate it either (ARGH!). Obviously, she wouldnt know (or tell me) why neither EAD cards would verify on the computer and gave me a SAVE paper telling me to come back and check again in a week.

    So in a couple of days I'll be going back and see how it all continues.

    VERY FRUSTRATING.

The immigration policy this country adopts would determine the future of this country. The only solution to deal with the labor crunch is to allow more employment based immigration.
    Every year, thousands of students from various countries come to the United States to pursue higher education. In a fairly large number of cases, the universities and various endowments provide financial aid to these students. It would make sense for United States to make an effort to retain this talent that has been educated in a large number of cases by the American taxpayers. It is a reality that the talent is sorely needed. Abolishing the country limits on the employment based immigration would make it easier to retain this talent and help ease the skilled labor crunch.

    3. Debunk some myths such as H1's dont pay tax, H1's take away jobs etc

    This is just blatant disinformation on part of anti-immigrant troglodytes like Lou Dobbs et al. American companies are desperate for labor and the labor deficit is going to grow. If immigrants do not come, American companies would go where the suitable labor is. America would lose the job and derivative economic activity of the job. The only way to avoid is to allow more immigration.

    Hi techskill: I have asked this before in this posting to someone else. Was your medical exam complete in all respect? My wife's was not as she was pregnant then. The Doc didn't administer one shot.

    Also to all of us whose files seem to be in the strange NSC Examination room: Yes, the Infopass IO told me that my case is all set. He didn't say if it was deficient in any way. I was just wondering if any of you guys have any such deficiency like medical?



    Yes. Our medicals was fully complete. Correct me if iam wrong, wouldnt they send rfe if our medicals r not complete?
    They would have sent the rfe by this time. Does our PD needs to be current to send an rfe?
    It is USCIS we talking about,even that might happen.

    The normal practice is, take a letterhead from the company and then get your collegue or manager to sign it. Believe me, 100% people do that. If you have offer letters etc... from your company, scan the letter and use photoshop to create a letterhead and write your own stuff, if for some reason your collegues are scared to sign any document (which happened in my case), get it from someone who was working in that company and left the company. If that also does not work out, just get a friend to sign it.
    The reference letter need not actually be on the company letterhead, your friend can use his present company letterhead or the letter need not be on the letterhead, it can be on a regular paper that is notarized.


    Well I would take this as last resource. It is your legal right as per US law to get experience letter from your employer. Good relation with HR can make the issue smooth. If nothing works, above is the solution :)

    Since your W2 shows wages less than the prevailing wage and the compony is showing loss, the only other option to explore is look at the companies net assets. You can find this number from the companies tax returns. Your lawyer should be able to access this and if the net assets are greater than or equal to the difference between the actual and proffered wage, then you should be ok.

    I am quite certain that my company has negative net assets. Some colleagues close to HR told me that my company might be in debt. This is just hopeless for me now. I have to accept my fate and move on. Maybe I am not destined to stay in the US after all.

    Hi,

    My PD is current for more than 2 months. Below are the actions I have taken till now and still no approval.

    1. Created SR on 3/3/2011.
    2. InfoPass on 4/19/2011. Not much info was obtained. Only stated that my file was last touched in Jan 2011. It was the same time frame when I had my AP renewal done. Provided NSC follow up email address.
    3. Email sent to NSC follow up on 04/19/2011. Received a response on 04/21/2011 with the following
    "Service records indicate your file has been assigned to an officer. I am unable to predict when a decision will be made on your application or when you will receive your Permanent Resident Card. If you have not received your document, a decision or other notice of acti ison within 30 days of the date of this response then you will need to place a Case Status Inquiry by phoning 800-375-5283. "

    Not sure what i need to do next and why is it taking so long. Waiting very patiently but getting anxious now.:confused:

    Any suggestions/help would be highly appreciated.

    I forgot to mention my 140 was approved last year and I'd like to keep my H1. The new company can do H1 transfer.

    You are set - after 180 days ask your new company to do the h1 transfer. Also make sure, you send a new employment verification letter to USCIS and change your attorney by filing new G28, if required. Good luck.

    What happened to all the donors this month? Under 15% donated so for in August.. In July there was a mad rush for all to get a DONOR status due to a RED HEADLINE and every body thought the green card is hidden there. Come August and all the DONORS are not to be seen anywhere.

    I was a regular donor and was changed to Sr. Member as did not sign in for monthly contributions. Did many signed in for monthly contributions ONLY for ONE month?????

    I think IV need to change it�s policy of donation on Cause Bases instead of monthly contributions. I am and will be available to contribute for Cause Bases instead of Monthly contributions and just to get a DONOR STATUSr.

    Any thoughts as to how can we improve our donations??

    Hi,

    My Labor was denied in 6th year. I have my 7th year extension in couple of months.
    My employer doesn't give much details of why my labor was denied. When i insisted them the reason for denial they said that they just got a letter saying that they are already US Citizens available with that skill set. I asked them to send a copy of the denial letter but they say that that letter also has other case numbers which they filed and don't want to reveal them. Is that believable?

    I said them to file appeal so that the case would be in pending and i can apply for 7th year extension. They said that its an no objection denial and they cannot appeal the case. Can it be true?

    Now i am even not sure if they applied for Labor. I need to get some proof from them. For what document can i ask them for this? What should i do in this situation?

    If you visited india/your home country in these six years, you can recapture those dates. It might give you couple of months. In the mean time, if your PERM approved you are good. Check with your employer how much they are willing to help.
