Dear Ben,
Hope things are going well for you. I thought I'd let you know that I got my
greencard yesterday. It was a very simple and straightforward process.
My company placed the advertisements for my position on February 2nd 2008.After about 60 days of recruiting and getting the papers together, the
lawyer filed an on-line PERM application in May. Since my application was
straightforward, Department of Labor approved the application a month later.
The following week, my lawyer filed my I-140 while me and my wife got our medical tests done. The lawyer compiled all our documents and submitted our I-485 when the I-40 was approved in late July. Fingerprinting followed about 6days later. They say that the final step takes around 6 months but USCIS has done such a good job of implementing the electronic processing that mine took about 2 weeks.
The entire process took less than 6 months.

Although I filed the Labor Certification Application (regular filing) in mid 2004, I couldn�t apply for I-485 in July/Aug 2007 because my LC was still pending at that time. Later in 2007 I got the Labor Certification and in 2009 I received the I-140 approval.
While may case was stuck in a DOL backlog elimination center, many people who started their permanent residency process in 2005, 2006 and 2007 were able to take advantage of the I-485 filing window because of RIR and PERM filings.
I am wondering if I could request USCIS to extend to me the same EAD Card benefit that applicants with a later priority date are enjoying. Is it something I can appeal to an immigration board or to an immigration court? I have been working in H1B since 1999. Would 11 years in H1B (and 3 years in F1 prior to that) carry any humanitarian consideration in a court of appeal?
Could someone please advice?

I am really sorry about your case and feel your pain. Unfortunately, as per existing rules there isnt much you can do until the priority date becomes current.
What you could do though, is to try and get an EB2/I-140 approved and use the PD from the EB3/I-140 ported. Once you do this, you will be able to file I-1485 (since Mid 2004/EB2 is current).
I am not a lawyer and this is not legal advice. Please consult a legal authority in this field for your specific case.

I am really sorry about your case and feel your pain. Unfortunately, as per existing rules there isnt much you can do until the priority date becomes current.
What you could do though, is to try and get an EB2/I-140 approved and use the PD from the EB3/I-140 ported. Once you do this, you will be able to file I-1485 (since Mid 2004/EB2 is current).

No you do not have to maintain H1 status. Why don't you ask your lawyer, why in the world would you renew your EAD if the I485 would be denied if your H1 status went away.
Seriously man your company needs a more informed attorney.
PS: A lot of attorney's are trying to exploit the USCIS memo a few months back to create FUD amongst employers to force you to extend H1 instead of using EAD. Your lawyer is probably trying to get your company to file a new H1b for you. Please remember in such an event you will need to travel out of the country to get it stamped.

My mother-in-law is in US on tourist visa. She will be completing 6months on Dec 28. I need to keep her here for another 6 months or so. If she goes back to India before Dec 28 and comes back again after 2 weeks will that be OK? What is the rule for reentry. FYI she has a valid multiple entry visa. :confused:
This is completely discretionary my friend. In my personal case, I was lucky to have my MIL come back in 3 months and get a 6 month stay while a friend of was not so lucky - his MIL got the duration of stay for 3 months. The officer at the point of entry makes the decision.
The only thing that you can do is give a good plausible reason during reentry and hope that it bodes well with the officer.

I will confirm with Lawyer..if we can file EAD/AP when dates are note current...?

But one thing, you can file EAD/AP paper/online only if you have already filed I485. When you are applying for EAD/AP(after applying for I485), the dates need not be current

I do not agree that money is the only influencing factor, It might be true till the mid to late nineties , but has changed since 2000 onwards.
India has lot of oppurtunities now , the real estate market , stock market have appreciated tremendously , before with 1$ = 45 Re , we could easily buy land or houses easily with cash
But now even with $1 = 50 Re :) we cannot touch land or houses in big / medium cities in India by paying cash , they have become so expensive.
Imagine if you were there in india and bought them at the right time , you will be much better off than the people slogging here.
absolutely true, I know friends who have done exactly that, and they are really well off and in a much better position financially than I thought i could ever achieve if I stayed in India.
But like some earlier posts mentioned I am not sure that it is the money or the exchange rate that is attractive about the US. In that case a I guess we should all be trying for the UK. I think it has a lot to do with the quality and ease of life, the facilities etc.
I mean if it was totally money related then I think nobody would want to stay here for good ( get GC), as he/she would be better off working here for 6 years or so and then take all his dollar savings and push off back to India, multiply his savings by 40 or what ever it is and be real happy that he has a beefy bank balance. If you plan to stay here for life, then whats the point in calculating the exchange rate with Indian rupees and all.
I am aware that as the dollar drops or rupee becomes strong or whatever eventually there will be an effect to prices here and all that, and then quality of life will go down and so on. But i guess many would say i am living in denial, when i say I won't have to worry about all that happening any time soon or maybe even in my lifetime.

I filed my 485 in July 2007 during the brief opening of the dates. In early September my check got cashed and through the photo-copy of the check I came to know the src number of my 485 application. Till yesterday the "case status online" webpage was showing the status of my 485 application as "case received and pending". I have not received the receipt of 485 yet, probably because I have moved and waiting for the receipt notice to be forwarded to me to my new address by Postal Service.
Then suddenly, today the status of my case changed to "Document mailed to applicant". Don't have any clue what does that mean. What document? I haven�t even got the receipt of my 485 yet. Could it be a finger print notice? Or is it a RFE? Or, incredible though it may sound, does it mean they have already approved my 485? Has anybody else also got similar message on the case status online page?

May be govt thinks that we are so small in no that illegal can solve housing crisis easily. We are 500k waiting for GC and illegals are 12millions. They can finish easily all housing inventory.
We claim that we want to start business etcc... Govt think how many will actully start a business ? may be few .. compare to us illegals can start so many small business that may help local community.

Illegal immigrants are much more looked upon for the vote bank purposes. 12 million illegal immigrants must have at least equal number of citizen relatives and they all stand for those illegal immigrants. And all those people's votes count when they are making up some policy. Where as the legal immigrants only have each other(God Bless us ALL). Many legal immigrants who walked the path to citizenship will forget where they came from. Not their fault as people who have got GCs and Citizenship earlier got it in no time. So they don't know that its a big deal of time now. May be we should start gathering support from all those people whose vote can be valuable to the govt and if the govt sees a good number in them, may be then they will start thinking about us to get their votes. My 2 cents.

This is the answer I was expecting from my original post. Do you have any basis to confirm this? At I-485 stage any RFI's raised by USCIS would be on the benificiary not on the company. So we are clean form old company after i-140 approval. I do not expect that the old company will address any answers for RFI's raised by USCIS later.:rolleyes:

This too was brought to our attention from a regular member like you and me, without which this would not have come to our knowledge at all.
So some of the members have taken an initiative to reimburse Aman and other core IV team members with the expenses they have incurred so far towards the administrative costs of IV. Note that the time they have spent and the sufferings cannot be compensated. Let us do the least by atleast compensating the money. Please do not donate directly to IV funds.

In order for me to claim them on my tax returns as dependant, I need to fill w-7 and mail my tax documents to Austin Texas.
My CPA says, i addition to w-7 and passport as attachment, my CPA says that their passporta need to be notarized when they were here.
They already left and there is no way I can notarize from here now.
Indian gazette sign is invalid it seems.
What do I do now? Is it mandatory that we should take notary signature on their passports when they were here.
if anybody has done it differently, pls advise. thanks in advance.

Logically I kinda of agree with dealsnet that "If your PD is current and RD/ND is withing processing times, then the EAD renewal will act as a trigger for I-485 processing(taking file off the shelf or box) and final approval is based on many other judgements as we are aware"
The reason i asked this was, has some cases where PD was current, and RD/ND was *not* within processing times and still a EAD renewal triggered the I485 processing and green card. May be the NSC is ahead of processing times that are listed on the website as these dates are updated once in a month.
Can anyone throw light on the prediction of the I-485 processing times for NSC. Currently at Aug 10th. What it could be in the next month.
My ND is Aug 14th. Hope atleast it moves by a week. I am not sure what the previous trend was.

I don't understand what r they upto and what r we upto. Our parents are not given the visitor visas, we are being charged fee to renew APs and EADs every year which is going to be increased manifold now, our spouses can't work, we find it difficult to travel when the AOS application is under process, we are made to contribute to the social security fund without even knowing if we will ever get that amount back, we are paying heavy taxes and in the end we are hoping for the CIR which is not in sight yet and which mostly talks about Illegals. Shame on them......
