I appreciate your enthu to be here even after being greened. (or u got used to be here :_))) We need your experience and support. Thanks.
ah ha.. Got used one way, and it is nice to keep reading things and getting to know problems that are creating day by day.
I must say I passed this stage and got GC last May after multiple followups with local congress man office, sending signature confirmation letters to MANY !!
Green is not the main thing.. we Need RED and BLUE also, only one primary color ( US GC ) does not help in life... :-)

After waiting for 95 days, we got out approved AP's today in the mail. The online status still says received and pending. Me and my spouse only had one LUD and that was on the 4th of September.
Thanks a lot.
GO IV GO.
Congratulations!! I have been waiting for 65 days now. Did you call someone to follow up on your case or just waited till the end?

USCIS should outsource their operations to the Indian Government System. I bet there would be improvements nevertheless :D:D:D
After Obama speech last night, the word "outsource" is probably a no-no :)

HELLO! I hope some of you are working over these holiday weeks. As I get
ready to embed the DAOLOC in the EAD finding aids and work with the Access
database, we need to resolve what we are going to name each image.
Actually, this is already taken care of by the database. The database
automatically assigns a non-metadata encumbered file name to each image.
We (Berkeley) devised this system under Daniel Pitti's tutalage in the
California Heritage Digital Imaging and Access Project. The more we
wrestled with having file names that somehow related to the content or
provenance of a particular item, the more problems we encountered. If you
just enter items into the database, you will have your file names.

Yes I filed with the attorney of my previous Company. I did not change my attorney when I switched employer. I changed after a year and did not do anything as people suggested sending an AC-21 may result in RFE. But not even without that I have got RFE.
I think you can see a sample of RFE from the Original post in this thread.
Did you file originally with an Attorney of the company?
Did you change attorneys after you switched. How did you go about doing that?
If not , your ex employer will get the RFE.

a) you have brass balls. huge ones at that
b) the song "living on the edge" should be your constant theme song and should play as you walk around jangling those big brass orbs. :D
Hats off. i would never have the guts to pull off an international travelling coup like you did, especially post 9/11, especially after the attorney had asked you not to, with an expired H1 AND at the risk of losing the 485....
maybe the song "The Gambler" should play as you walk away and the credits roll...."know when to hold 'em, know when to fold 'em....know when to walk away....know when to run...."
Maan gaye guru. you are my new hero
scaredy cat that i am, i waited 7 years to visit India, and that was just to avoid F1 to H1 and visa stamping (of course this was right after 9/11)
..........because they didn't like the idea of my travelling after filing 485 as my H1 had expired- they were worried the 485 would be considered abandoned if I travelled without parole. I sort of told them I wont so its very awkward now to call up & tell them ' hey guess what-I ignored your advise and travelled and I'm back with my new visa stamp but its too clean for you to see?!'.

one of them (director) got fired last week after working 5 years due to the very reason that his inabilities showed up after change in management.
.That is pretty broad generalization. There are all kinds of folks at all times. I have seen very smart people going back and some mediocre ones surviving the wrath of last lean time.
I think if they survived and now directors, they must be adding value to their company. Or may be at the right place at the right time.

If you are referring to the match found that shows up while giving your finger prints at ASC, I think this refers to the match they found in their own database. Of course they will find this match because she would have given her prints to them at the POE when she last entered the country. So, I would not worry about this. You should be really concerned if FBI finds a match which they shoulld'nt as long as you haven't been finger printed by any law enforcement agency for any reason.
I had my finger prints submitted to and verified by FBI towards the application process for Canadian immigration. Will it have a negative impact towards US GC?

Anti immigrants will have a field day over this.
I can just about hear the headline on Lou Dobbs, "H1bs buying greencards, which should after all be a priviledge and not a comodity for trade on wall street."
AILA will never support this and will matter of factly lobby against it behind the scenes, the more mess and confusion and delays in the system the more work for them. The only reason they support increasing EB numbers is that on the net effect (faster processing vs increased volume of applications) they come out ahead. This is always the case with lawyers, they are exceptional at looking after the interests of their profession and in this case you are asking them to cut the hands that feed them.
All in all, it is a great idea but will never fly in my view and furthermore will be construed in a negative light. It will backfire.

Hi a1b2c3/Others in similar situation [ie. 140 approved and retrogession affected] and tried switching the employers?
Please share the experiences and feedback from others
Thanks in advance
I think you should file your 3 year extension immediately that too in the expedited channel.
That way you can switch over anytime.
Mine is a similar situation.
I got 1 year extension after I completed 6 years on H1. My I-140 was approved and my company filed and obtained 3 year extension.
Now I have new offers and I intend to switch.
I too have concerns about the portability of priority date, whether there would be problems during H1 transfer and so on....!

So you are trying to say that, once my I-140 is approved and I-485 is pending for more than 180 days, my sponsoring employer loses the power to revoke my GC and I can provide an employment letter from the new employer for I-485.
Do you guys really think that the congress is really going to increase the yearly quota of the GC for the Employement Categories? To me it seems like this country is becoming more conservative post 9-11 and is isolating themselves from rest of the world. Based on the current situation it can take upto 5 years for someone like me to get a GC and if this situation stays as is then, I wouldn't mind going back to India or Canada or Europe.

Stay away. Don't make people fool.
You suck money of immigrants. Your name in the evaluation is enough for USCIS to DENY WITHOUT EVEN READING IT.
ALL MS WORD file find and replace with candidates names.
Just to update folks, for 2010 - when properly handled I have seen virtually 100% approvals when there is a 3 year bach + 2 year MA + 5 years of work experience as = MA for EB2. AIME = BA and + 5 years work = MA for EB2. When the PERM requires MA the 3+2 = MA for EB2. A 3 year bach+BED is considered a single source degree for EB2.
The proper reference material always needs to be cited. Anyone in need of information about this email me <she (at) cci123.com>

I heard in conf. calls and also on read on some websites that you can file for three year extension at your new employer also. You would need proof of I-140 approval.

Quite often, PCP will be more than happy to give tetanus shot if asked (I did that). Other's may be more difficult since they may not be in stock. I just said "hey, I think I'm due for a tetanus booster" and they marked my card and did it
Personally, I would avoid getting shots done at the civil surgeons - they are universally more expensive. Try your PCP first, and then try local Public Health Departments / or non profits. A lot of public health departments will have Adult Immunization Clinics (for vacation travel etc) and the cost of shots will be significantly cheaper than USCIS docs.
Of course, doing all of this takes more time. Do you want it done fast and expensive, or cheap and slow?

To the best of my knowledge it is not possible to extend H-1 status solely for the purpose of sitting for the ABIM exam. J-1 visa holders can get extensions of their programs for this purpose, but not H-1's.
That being said, there are a few possible options:
1. See if your current employer or your prospective employer would be willing to sponser you in a research or teaching capacity from June through when you get your license. Note that the position need not be full time.
2. See if your current employer can extend your trainee license , your employment on a full-time or part-time basis, and your H-1 to bridge the gap.
3. See if you can find a part- time or full-time non-clinical job that qualifies as a specialty occupation to bridge the gap.
If your current H-1 is for a cap exempt position, you might be subject to the H-1 cap with a new employer that is not cap exempt. This would mean a start date of Oct. 1st which would not solve your problem for this summer.

It is a shame that a candidate with such a strong profile has to ask his friend to float his resume on this immigration portal. It is absolutely, disheartening for me to see your friend in such a situation. All this makes me think whether it is really worth staying in the US of A in current economic scenario.
