Assuming that 125 K that Jeff Flake obtained are correct then what USCIS projects the backlog to be 250 K by 2009. That would mean that we are distributing 125 K between E1-E5 for all other countries of chargeablity. Does this add up? I don't think so.
We also have to consider CP as compared to AOS. In this case if these numbers were true the DOS would start making the dates current for the overseas consular posts to catch up which is what it currently does anyhow since it doesnt have the right information from CIS anyways...so I have no reason to believe the farcial information that CIS publishes to alleviate any future forseeable pain they will have to endure as the pressure from other areas of congress and public in general start mounting up.
Besides these are the folks who have NO REGARD for law and make and interprete laws per their own terms

New information about NSC-CSC-NSC transfer cases. The infopass IO showed me her monitor where my Priority date has all zeros. She guessed this is why NSC is not picking up my case for approval. My wife's also the same. And sad part is that, they can not rectify this. Only a NSC IO can rectify this if you open a SR. And I know how easy that is - just last week a NSC IO barked at me. Only God can help me now!

Iam one of those unfortunate people whose 485 transferred from NSC>>CSC>>NSC. The above information could be very well true, coz we did not see any approvals for such transferred cases. I had called the Nebraska Service center twice, but was lucky only the second time to get an IO who informed me about the Biometrics not being associated to the 485.
After that there was on LUD on my application on 08/11.
Since that ive been waiting patiently hoping to hear something.But the above information about the PD info having all Zeros makes me worried and nervous about missing the boat.Its been more than 7 frustrating years going through this GC ordeal.I had high hopes when the dates became current. :(

I can't give you a well informed answer. But my feeling is that, based on your PD, this is good news. I know a 485 REF would make a lot more sense. Did you file concurrently?

Sorry for the confusion but I am not on H1B i am on my EAD already for over a year now. In that case, I guess I can be employee of my own company. Plus even if I quit as a CFO, the problem is if USCIS wants they can see it on the paper that I quit the role, so whats the point quitting. I may be wrong but just a thought.

I have not completed my MS and changed my status to H-1B after 2 semesters and since then I am working on H-1B I have almost all the paystubs except the starting three months of H1 when i was unable to get on project which also means that i don't have W-2 for that year, however since then i have all the paystubs and two years W-2, I have changed my employer and now have H-1B valid till 2010 but still I am very scared to go for stamping.
Anyone in this situation and can suggest me what can i do so that stamping for me can be smooth and hassle free.Here again is a gist of case for better suggestions
1)I have bachelors degree in computer science from India
2)I Reported to my Schools International office that I have got a good opportunity in my field so I am leaving F-1 status and also gave her a copy of my H-1 approval
3)Just to be on safe side i have enrolled in one class till october 1 and then dropped it since my H-1 started on OCT 1
4) Have 2 years W-2 and latest pay stubs
5) I have Advance parole but don't want to use it because I am not married and might get problems in getting H-4 for my would be wife
My Worries:
1) Very first question will be why didn't you completed your masters???
2) What if he says he cant evaluate my credentials and ask me to go to home country which will be the most painful thing ever
3 I was once rejected for F-1 and got it next time so he might say that you tried twice for F-1 and you didn't completed your studies???
Gurus Please advise.. I have heard of people hiring lawyer who accompanies you in canada .. how effective is that???
One of my friend was in same situation as you are in now.since he droped out from school from second semister he completed 6 courses (18 credit hr),after he worked in H1 for 2 years he againg joined the same school for an MBA program and he managed to transfer some credit hours from previous courses,he enrolled in most of the online courses offered by the school and finished his MS.
Here is what he experienced at the time of Stamping.
1) Why did you left the school from second semister?
He said he got the nice job offer which he can not turn down
2) Why did he go back to school after two years
He said that he needed the MBA at his current working company to move on to better position.
He got his visa after the W2 and pay stubs verified by the counsler (latest 5 stubs)

I never said i am a rich guy..btw how do you know that non-US born kids of illegal parents go through things that you've mentioned? Last time i checked, they get free education in a public school (with very few exceptions), free health care from ER, tax free income etc...

I was thinking over this for quite some time. Why dont we hire one or two immigration attorneys on a full time basis. And lets start am immigration office where we can have all our immigration works (doubtful) but the future immigrant works ata marginally cheaper rates with high quality of service. If we keep a no profit no loss mantra, it would be helpful to everyone and also it will make this organization very strong.
Lets discuss its relevance? What does the Core think about this.?

My I-485 was denied while I was in process of filing AC21 and G28. I got a mail from CRIS that My I-485 was denied. I want to file MTR but don't know the reason.
If any you have any experience , then please help. Let me know who gets the I-485 Denial mail ; Both attorney and Client or Just the attorney.

thanks for your prompt response. I guess you were lucky that you got a decent IO...chances are one in a thousand that I'd get one. Any thing particular that you asked the IO.
I have taken 2 appointments one for my wife and one for her...hers ahead of me...not sure if they will let both applicants attend at the same time...I need to know if anything particular I shld ask as this was a transfered case just like me (but mine is approved and hers not).

Your employer can inform USCIS that you quit as soon as you got your GC. USCIS will then revoke the GC.
It is better for you to use AC21 and join a new job than quit the day after your GC has been approved. Although many people suggest to wait 6 months, I feel if you quit anytime before 2 yrs, the onus will be on you to prove that you did not intend to abandon your employer - if your employer goes to USCIS and complains. If the company is doing well and they have not treated you badly (for e.g. given you raise, promotion, etc.) - then it will be extremely difficult for you to prove that you are not to blame. After 2 yrs, however, it is up to USCIS/ employer to prove that you intended to abandon employment as soon as you got your GC (if any questions arise or employer complains to USCIS). This is just my opinion - but talk to a good lawyer if you intend to quit as soon as you got your GC.
As far as you breaking the contract is concerned, if the contract says that you cannot quit for one yr after GC - and if you quit, then you have to pay GC costs - then they can come after you legally if you quit and do not pay the GC processing amount. However, if the contract says you must work for one yr after GC and there is no break clause, they cannot come after you legally (except ofcourse to complain to USCIS - in which case USCIS can revoke the GC).
