Lots of people here don't understand that there are so many americans ( include immigrant americans) who make there living just based on importing H1B workers. If the govt wants to stop one H1B they are going to stop one local from getting their paychecks. It hurts us temp immigrants but it hurts the local twice as much. By sending home every H1B one another local who was living as a parasite is going to lose their job.
These H1B jobs are mostly outsourceable. The smart businesses know how to start shops in other parts of the world and keep making money. In the long run everyone is going to do better than were we are now.

TSC claims to be processing AP within a 90 days timeframe, mine has already be 95 days and not a single LUD yet!! When I called the IO, he said it is the average time frame and in real time it could be a lot delayed as there are numerous applications pending! They are currently done with June 20th cases completely...
This is insane, if they know where they are at, they should have posted it correctly in the processing times link ..they are misguiding us and causing a lot of unnecessary tension! I will have to cancel my airtickets as I dont think I'll even have a LUD in AP before Nov 3rd!!!

My case is reverse. My wife and son's GC got approval on 15th aug last week but mine is still pending. I called USCIS to get info on my case, IO asked me to take INFOPASS appointment. It seems INFOPASS guys will have more information than USCIS customer reps.
I am planning to take INFOPASS appointment once I get physical cards of my family.

Isnt there a minimum wage for each job class/type, that is mentioned on your LCA ?
You cannot make the arguement that as a computer programmer you are fine as long as you get 3x what a McDonalds employee gets.:cool:

Personally, I don't think 3 times the prevailing wage makes sense to me. I don't remember my LCA amount. I know I make more than it but doubt its 3 times (could be, have to check) that. Then again it might depend on the field. I have seen in some fields/employers LCA amounts are usually very low compared to the actual wage. If things are tightly controlled in Europe such that the prevailing wages are a true reflection of reality, how many foreign workers can claim a salary 3times that? So, I think they will probably require 3 times the equivalent of US minimum wage, to prevent "cheap" labor.

I have been in Australia for the last two years on account of a job-related posting of my wife down here and we applied for Aus perm residency as a back-up to the US GC (though fortunately we got our GC during the last months of FY2007-08, through CP). Here are my 2 cents related to Aus immigration and the country in general.
The application process is relatively straightforward and can be self-sponsored, especially if you have the requisite points which is easy if (a) you have the 'in-demand' skill sets (which can be found at the immigration website ), (b) are younger than 35 and (c) score high on the English language test (ELTS). Note that both you and your spouse will have to sit for IELTS.
The one bothersome aspect is that unless you have undergrad degree from US/UK/certain other European countries, you need to undergo skill assessment, where you have to write a long essay about your skills and qualification and have it endorsed by the relevant licensing authority in Australia. It is not a biggie, but just a pain to write all that stuff.
Immigration process is easier if you have a job offer and the company sponsors you - I have known instances where such cases were approved in 1-2 weeks (one friend was going to work on something related to Australian defence and he was approved in 2 days!!), or if you are a physician/certain other skills working in non-metro areas. In some states, especially Victoria, the state can also sponsor you, but I dont think it makes the process much faster and there are requirements to stay in the state for 2 years.
Regarding our own experience, we applied with my wife (an Engineer) as the principal applicant last year around April/May. We had enough points and everything and we used an immigration agent - however, we are yet to hear anything positive. This January we got an e-mail saying that her profession had been put on a fast-track for approval, but still no news and it is getting close to an year.
My own idea is that given the recession, Aus immigration is in no hurry to approve cases now. In fact, they have recently cut back on the number of skilled-immigration approvals. A year ago, everything was fine, and due to the mining boom here, demand outstripped supply for all kinds of engineers, both IT and non-IT. With the world economy down, jobs being lost here - the situation has changed. The Australians are much more protectionist than Americans, and are very wary of foreigners taking their jobs in this economy. I work in the academia where it is different, and my wife works in non-IT (Mech Engineering) sector, so I am not totally sure how the situation is in IT, finance, marketing etc.
To summarize: compared to the US GC, the application process is easier, wait is theoretically shorter, but be a little careful in this recession economy and make sure there are jobs here before taking the plunge.
Btw, our cost was about Aus$5000-6000, including the immigration agent fee. Plus it was about Aus$700 for the IELTS tests for both of us.
Although you did not specifically ask, regarding life-style in Australia: the people here are usually very laid-back (work week consists of 37 hrs, with defined tea breaks!), love to be out in the beach or bars after work and drink beer/wine (yes, the stereotype is somewhat true), but they are usually efficient in what they do. The pace of life is certainly different from the US. However, cost-of-living is slightly higher, especially since you are pretty much forced to live in the major cities, where real estate is quite expensive. It was through the roof last year, but it is starting to fall a bit. Grocery items are usually almost double the price, gas ('petrol') is significantly more expensive, and car prices are laughably high ( you will find most people driving smaller, fuel-efficient cars). I would say that cost-of-living is slightly higher than major US cities like Boston, SF, NYC etc.
Overall, we have enjoyed our stay in Australia, but will be going back to the US (yes, even in this economy) because I still feel that even now, the best future prospects are still in the US (or perhaps, India). The mining boom, fulled by development in India and China, has been a major pusher of Aus economy, but IMHO, they do not have much to fall back on e.g Biotech/IT - Singapore, China and India will probably beat them in those industries. But that is just my own opinion. YMMV.

What does everyone on here think about sending flowers to the Congressional Hispanic Counsel members ONLY and publicize that event like we did last year.
The message is clear. "Please stop ruining our future to save yours." (or something much more refined).
Clearly the CHC is like the "Great Wall of China" right now, when it comes to provisions for Employment based Legal immigrants.
2 Dates come to mind. Labour day and Aug 15th (The Indian Independance Day). I know that IV is not just an Indian organization, but the worst affected category IS Eb3 India and to an extent Eb2 India as well. Besides the flower sending idea also comes from a Bollywood movie.
Ofcourse everyone can participate in this campaign, coz everyone will benefit from the campaign if it is successful not just Indians.
Just a thought.

`(d) Notwithstanding any other provision of law, except for provisions relating to revocation of citizenship under subsection (c), individuals who are not United States citizens shall not be denied the opportunity to apply for membership in the United States Armed Forces. Such individuals who become active duty members of the United States Armed Forces shall, consistent with subsections (a) through (e) and with the approval of their chain of command, be granted United States citizenship after performing at least 2 years of honorable and satisfactory service on active duty. Not later than 90 days after such requirements are met with respect to an individual, such individual shall be granted United States citizenship.
`(e) An alien described in subsection (d) shall be naturalized without regard to the requirements of title III of the Immigration and Nationality Act (8 U.S.C. 1401 et seq.) and any other requirements, processes, or procedures of the Immigration and Naturalization Service, if the alien--
`(1) filed an application for naturalization in accordance with such procedures to carry out this section as may be established by regulation by the Secretary of Homeland Security or the Secretary of Defense;

Nope. Mine also missing that stamp. Other thing is even on the old passport the stamp it used to read like "ECNR Stamp required except for several countries (including the US)". So I think it does not really matter for the people who are in the US.
