If you look at what Obama said on Airforce One the other day and the comments now, it is clear that he is not really committed in getting the CIR done this year. Just to pacify the Hispanic community we will probably have some kind of a start and thats about it.
That might be true. But there are many pots simmering in the background, and because of the events of the last few weeks incuding Arizona's new law, there has been a pressure building on the congress and the president.
We can help to continue to build this pressure by calling our senators and forcing them to take up the debate.
This is the right time, if we do not do anything now, we will have to wait till 2012 or 2013.
Please call our senators now.

Thanx for the replies. I have to go to india around august for my marriage. So i thought it might be easier for me to stamp in canada before my previous visa expires. Otherwise, i need to stamp in chennai.
How much early i can stamp my visa 30 or 60 days before the approval in canada. Will i get this info from the US consulate in canada itself while booking for appointment ?

Why did you prefer CP route over I-485? I wanted that way with processing in Montreal but my lawyers recommended I-485.
Although CP is faster and that is whay I would chose but I was told that for CP you have and your family will have to travel to go to consualte which can be expensive. Then there are police certificates that one has to get and we all know how :rolleyes: easy it is to get one in India. Then you have to take time off from you job just for the visa. Also if CP gets denied then the person is stuck abroad but if 485 is denied then there is an option to file a Motion to Reopen.

I have 2 questions ...
I have an approved labor and I-140 with company A. My company has been taken over by company B (Succesor in Interest). I have filed for I-485 on July 2nd (EB3, PD : Nov 2004)
1. Company B did not give my lawyer the employer letter to go with I-485 on time, so my lawyer filed it without it (I understand that employer letter is primary evidence to file I-485) Now company B sent it to my lawyer. What will USCIS do? Can we submit it with the receipt notice once we get it? What else could be done?
2. Do we have to file I-140 amendment with company B, even though its successor in Interest company?

I hope they have assigned visa numbers to all of the cases that received an LUD today, that way even if the dates retrogress all of those applications will be processed.
My friend:
I saw luds on I-485 on 9/29, 9/30 and 10/1 (today). I hope for the best but I fear too for RFE.

I think, if by June 30th if your application is pending, you will get your EAD extension based on this new rule i.e 2 year of PD is not current or 1 yr if PD is current on 30th June. People will start seeing it in a couple of weeks after June 30.
I guess, it makes sense to aaply it now if you can as based on USCiS speed, you will most probably be pending by June 30.

USCIS screwed up my EAD card as well. Instead of my signature they printed my lawyers signature on my card. I double checked a copy of my application and found that it was infact a USCIS error.
My lawyer told me two options regarding the correction of my EAD card.
1) To go ahead now and re-apply for the corrected card without the USCIS filing fee cost as the card contains a USCIS error. This would create a clean application and avoid any potential future issues with the incorrect information. With this application we need to send 2 additional photographs along with the original "incorrect" EAD card.
2) Alternatively, could wait until 6 months from the expiration date of the EAD card and request an extension of the EAD with USCIS filing fee cost and the request for correction explaining the error and hope that USCIS will not make the same error again.
Since I are not planning to use my EAD anytime soon, I opted for second option.

I do not think this is an issue. It is not practical for someone to go out of the country every year just to get a new I-94. Also not everyone may apply for EAD and Advance parole. If a derivate is not working and doesnot intend to work or travel then they do not need any EAD or Advance Parole. Just that they are in AOS is a valid status to stay.
Here is the crux of the matter. If a derivative is not working and does not intend to work or travel, but intends to drive , then he/she should have an EAD/AP(I-94) to renew/apply for DL.
In short, the rules of USCIS allows the derivative to stay legally on AOS without EAD/AP(I-94), but the rules of DMV doesn't allow him/her to drive without EAD/AP(I-94) :rolleyes:

Filing a class action is not a simple matter. A lot of careful consideration needs to be given to the class definitions etc. There are instances where the CA suites are lost because the opponent hits on the technicality of class.
I am sure AILF must be trying to make sure they will not file a case in a haphazard manner. This is just my opinion and I don't have any AILF insider information though.

To the best of my knowledge there is nothing called H4 transfer. The only thing that matters is validity. If her H4 is valid then she is fine. If her H4 is expiring you should apply for extension based on your H1B.

what if the parent is coming to take care of the grandchaild that is just born? I think it is a valid reason. any experiences
My mother in law and father in law never stated that they have a grandkids in US because if you said that most of the time their visa application will get rejected. So do My mother.
If you applied visa for the first time and If you have family member that stay in US for work or have GC according to US embassy the possibility of the applicant to move and stay with their family in the US is greater and that will raise the red flag and most of the time the visa will get rejected.
But for the extension it will be no problem it showed that you return home already therefore there is no intention to stay or immigrate to US.
My brother in law visa application get rejected without any reason, My aunti visa also got rejected, My sister who almost die due too miscarriage and lost her husband 6 month later got rejected as well. But luckily my mother, mother in law and father in law both have their visa approved. They stated
they reason to visit is for pleasure :) and they have invitation from their best friends for visit.

Within 3 years if you don't get GC, he crosses 21 and his GC is delayed and sidelined. It is issues like these that we must fight for. Hi my EAD is expiring on Jan 12 and i have applied for a renewal 120 days in advance. I am worried that if incase my EAD card does not arrive on time, i may require to terminate my employment. My EAD status still shows as Pending.
I also read that USCIS does not do Interim EAD any more due to law changes. Is there any one who has faced this situation and knows what to do?
Do i have an option that i may be allowed to keep the current job and wait till the EAd arrives.
Please advise the best course of action so that i can keep my job and not get it terminated.

I also did the same thing. Do not worry, they will correct it when you go to give finger printing. Or you can call the NSC and update them. I immediately called nsc and updated them. But then i think its pointless, since they will anyway correct all the information at the biometrics. Good luck.

Check with your employers insurance agent. Agents can provide you information on how to split up coverage to get a better deal.
This will depend on your state as well.
If nothing else works, check with your state insurance board, states run a pool for folks who cant join a big group. Being a part of such big group will get your benefits at a marginal cost than what you are paying now.
From experience, being with a small group(insurance group) its very painful and you end up paying a big chunk.
