DC-MD-VA chapter ?
Yes that is a good idea. We are already doing this in Tri-state and would be better to have one for each state for Senators. For house reps, they mostly prefer meeting their district residents.
Some states may not have a chapter yet, if so please mention and we can create a new State rep, based on volunteers there.
ImmigrationVoice.org - Immigration Voice State Chapters (http://immigrationvoice.org/index.php?option=com_content&task=view&id=72&Itemid=52)
the material for the meeting is available with StarSun. Once you get an appointment you can contact her to get the presentation and other information. when you meet the law maker, you are going as a representative of IV, not as an individual, so other people can pick up where you leave as part of IV, and with a common agenda.

I have heard this POJO method to call USCIS. Can someone explain what is this method and how to use it. Also, can we summarize a list of questions, one should ask an Immigration Officer while on the phone.
There was thread (http://immigrationvoice.org/forum/showthread.php?t=18581) in past and "googler" had some some nice info on that regarding how to reach IO's. Can you tell me what is "POJO" method??

paper filed @ NSC

ND - 10/29/08
Strange thing is I have received the receipts for both myself and spouse but the checks are not cashed ??

Sorry to hear your situation. There are many of us in the similiar situation. As some one already said, you have your PD locked and try to get through these difficult times now.
Besides, if your wife's boss is a control freak, she might want to see whether she can file complaint with in the org anonymously (most companies HR have such number) and an investigation goes on with out issues. If he/she has too much power and ou dont think she will be heard properly, You can talk to DOL.
The fact that her boss is egyptian is redundant. There are control freaks in all nationalites and races.
I am confused.
Your I140 Mailed Date : 04/11/2007
I485 Mailed Date : 02/07/2007
How is that possible? Can you really file I485 before !40?
If that is the case then I think you have solved all our problems especially OP.
Let us know how you did it so that others in this problem can file their I485 before filing I140/

American people needs to be educated about H1B and GC retrogression. The only way to reach out them is with American news papers and TV channels. CNBC(bus) is followed closely by those people who are interested in economic affairs, both global and local.
We need as much support from these channels when you have the likes of lou dobbs going all over the negativity of H1B program when the benefits of H1 program far outweighs its disadvantages.

sorry to know you are in the mire of retrogression like the rest of us.
EB3 ROW is quite backlogged so your 2007 PD is a while away yet.
sit back and enjoy the ride :-)
no not really...welcome to iv- where we do not accept status quo.
since indiana does not have a state chapter, please join the IL chapter,
anilsal will be glad to guide you through the hoops.
please join us on the call on sunday, you will hear how iv is working to ease retrogression for all of us. If at all possible, plan on being in DC on 9/18 for the first ever rally by legal skilled workers to highlight our problems.
we are very glad to have you!

I am very confident if you take at least one infopass appointment for every week of August, u will get approved. I think u r more or less through. U just need to keep bugging USCIS every now and then - tht way they may look at your file before ppl who are ahead of u in the queue.
I had a Infopass apt this morning and the IO told me that my name check was cleared. My PD is Jul 2005 (EB2 India). 140 approved 18 months ago. anyidea I get approved in August?

On the side Note..
My Desi employer does not show me the real PO ( Purchase Order ) whereas at the same client other an American Vendor does show the real PO to their employees.
Is there any DOL link about it to share PO with Employees. ?
Thanks
Let me guess, you are on 80-20 arrangement. That's why he doesn't want to show you the "real" PO. So he will give you 80% of his version of the PO rate. If you are FTE, he doesn't want you to see that he is making a profit of $60/hr from you. Otherwise you will ask for a raise.
I don't thin there is a regulation/law that requires your employer to show you the PO. However, the way consulting works, it would be ethical for the employer to give you the copy of the PO, more so when you are on % basis.
It is pretty easy to judge an employer in the beginning asking him if he will give you copy of the actual PO, even when in the pre-hire stage. If he agrees, make that part of the formal joining or acceptance letter.
Other consulting companies are learning fast from Desi cos. They are just a few steps behind desi cos for taking advantage of their immigrant employees.

My earlier H1 visa lapsed on 30-Sep-2009 and H1 extension is granted only from 01/13/2010, which means, i don't have any extension/visa approval for the period from 01-Oct-2009 to 12-Jan-2010 on paper. Is this a reason to worry? Will i be considered as "out of status" for these 3.5 months? Will this be a problem when i go to India for stamping? Will this be a problem when green card processing happens in the future?
Note:
1) The extension was applied before 30-Sep-2009
2) A correction was filed by my employer to make this change in my extension period, but USCIS replied back saying that
"Dear Petitioner:
The following is provided in response to your inquiry sent to the xxxxxxx Service Center on April 19, 2010.Your case has been reviewed and it was determined that the final decision rendered on your case was accurate. No correction wil be made because the start date on the petition was given from January 13, 2010, due to change of employment condition within the same company: xxxxxxxx"
If you did not have valid I-94 or the case was not pending, you are accumulating unlawful presence. Since its your employer's mistake and USCIS is not ready to correct the approval date you are already in trouble. Consult with an attorney as it may affact your future GC process as well.
If you didnt have I-94 for those period and its more than 180 days you might be subject to 3-10 years ban to enter the US. I am not trying to scare you. If you didnt have I-94 and not able to fix that issue...you are in serious trouble.

Hi,
I have been struggling with my Employer from the begining of GC process. My labour was filed on May 2007 and got approved on August 2007. My Employer kept me waiting until Feb when it would have been expried otherwise. Now he says he has filed my I140 but does not provide me any evidence. I have following questions and would appreciate if you can provide me your insights:
1) Is there a way for me to find out if my I140 has been filed. Can I talk with INS and find out about this or even get the receipt number.
2) Can I file my own 485 ( as I am current ) with out the knowledge of my employer ? Is so what all do I need.
Thank you all in advance.
Did you sign the papers for I-140?. You need to sign the original form and without that your employer can not file the I-140.

ragz4u,
Thanks for the update. All the core members deserve a breather (a long one). Congratulations to the core member (my guess is Shiva a.k.a. admin) who had a baby. All your healths and personal lives are more important than the Green Cards. Also, we cannot afford you guys falling sick at crucial junctures in this process.
Don't worry about the comments made by some members. As you can well imagine everyone is losing patience in this process. But we all know that IV is there for us.
We can and we will WIN!!!

Thanks! I get that feel too, atleast for now. But I am also worried if this mistake is later on identiied by USCIS, then will it work against me and deny my 485 / EAD.
So I seeking some wisdom in this forum. Are you suggesting they will not come around and tell that you should have informed us of this mistake.
Notify your lawyer. Since all EB category is Current
File your I-485. Also request USCIS to port your EB2 to EB3 along with the letter stating you attempted to correct it while your I-140 was pending.
In any case don't delay your I-485 filing. Good luck

i went for stamping in india in Feb'09. Mine wasn't in PIMS. They said that my visa is issued but will get the PP with stamp after PIMS clearance and it might take upto 2 weeks. but luckily i got it in 3 days.
those whose I-797 was approved around the same time when PIMS was introduced ( i think Oct'07 ), should be careful about this.
i read somewhere that, they messed up initial data transfer during PIMS launch. so the I-797s that got approved around the same time are more likely to be missed. mine was approved exactly in the same month PIMS was implemented and surely it wasn't in PIMS.
funny story now ( but painful then )..
i was aware and prepared for this when i went for stamping. i was at the window of initial screening officer. he took my dox and verified in their system and started writing 'not in PIMS' on top of my app. i was looking at it and i said 'aah! is it not in PIMS?'. he was surprised ( that i knew about PIMS etc) and gave me a look. now, i told to myself 'dude! shut up' :D
minumum precaution u should take is, take the visa appointment on the first couple of days of ur visit, to have buffer for PIMS.
but, i read, there is another type of delay that's the nemsis of pink 221(g) or something like that. this is for people who work in sensitive industries like defense, biotech, chemical etc. that surely take a long time, coz they need clearance from washington.
