Yes, thats my understanding too. Once you use your EAD/AP you are leaving your H1-B. Atleast thats wht my lawyer told me.

On some of the above threads, It is being told that If you and family have pending I-485s and

As I understand this is probably wrong, for spouse to apply and work on EAD, PRINCIPLE APPLICANT NEED NOT HAVE TO APPLY FOR EAD AND WORK ON EAD. As per my Knowledge principle can continue working on H-1B even if spouse start working on EAD. Even my attorney, through him I applied for My spouse's EAD, Advised me to Continue on H-1, so that something negative happen on Our I-485's she can come back to H-4.
(I am still in first yr of H-1 B and my I-140 is already approved and I-485 pending for almost 4 months)
CAN EXPERIENCED MEMBERS CLARIFY ABOVE ISSUE, as some of the replies on above thread are confusing in regards to Spouse and principles EAD and H-1b status.

Guys Here , Now that most of us will be filing for I-485 I would like to know what to expect once it is filed. I am applying for EAD and AP also.
Can any one let me know on what further communications we get from the USCIS and what my attorney gets. Really appreciate if some one could direct me to a link on the process. Thanks a lot. Sorry for starting a new thread if it was already posted any where. I did a quick glance but couldn't find something similiar (I MAY BE WRONG). Thanks
1) Expect that your checks get cashed by USCIS
2) Expect to see some no. on the back of your check(you can track it online if you sent ur own checks)
3) Expect your attorney to get a receipt notice from USCIS
These are few things that you should expect in near future(i'd say in few months).. Later other things will come in picutre... FP, EAD, AP, etc etc...

There is a tiny possibility that they will use the reason of left over numbers to make all employment cases current for August.
Why?
Because if they had left the July bulletin as is, half a million people would have applied for 485 before July 30 at the lower filing fee resulting in a loss of millions of dollars to USCIS.
By postponing this activity for a month, they stand to gain big bucks.

I also got the same status for me and my wife's 485. When I called the USCIS, they said that they just sent a notice saying that my 485 has been transfered from Nebraska to Texas.

But the problem is there is no LUD after Fp, so I dont know weather the FP person has keyed in all the information.
Still have not received EAD, will wait till next week as it will be 60 days over then will call USCIS and ask for any update.

the environment at work has not been good lately. so I started looking for another job because I had a feeling that they might fire me. I finally found another job in the same field and I gave my 2 weeks notice this past Monday to my employer. today my employer informed me that they don't need me anymore and they don't want me to work for the rest of the notice.
what should I do?? is that going to affect my immigration status?? do they have to pay for my plane ticket back home.
I am not planning to go back home and will start my new job soon.
please advise what I need to do :confused:
Since you had Applied I-485 back in june '07 and your I-140 Approved you can start your new Job using AC-21. Hire a Competant Attorney and Do the paperwork if possible.Make sure the New job falls under the Same or Similar Job Profile. All the best in your new job!

May be this demand-supply thing

The expense for I-140 must be paid by the employer. Not by you according to the immigration law. Tell them and show the details, if they want to sponser you.

Share views of the attorney about UE Benefits. As far as we know it is only for GC and Citizens - That makes sense also. You can also open service request to expedite EAD approval process but sometimes this has no effect.

I can't wait to share this my dear IV friends, I got a CRIS notice today Sunday, that "Approval notice sent". To be very honest this is like green card to me, as I can invoke AC21. Also, with God's grace I've couple of offers in the pipeline, only to be delayed due to I-140 status.
On December 12, 2008, we mailed you a notice that we have approved this I140 IMMIGRANT PETITION FOR ALIEN WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.
I really thank each one of you and wish you success in the immigration process.

Now, while going through my H1 approvals, i came across something that seems a little wierd, but i have emails from those days to tell me that i was in clear legal territory. however, given that i have this rfe, i want to run this by you gurus...
i was with one of the big indian IT firms when i came to US. my first h1 approval expired on Jun 2004 and the next one from the same company was valid from the very next day to nov 2006. However, I applied for H1 transfer in nov 2004 (got receipt notice in nov2004) and then started working for a desi consulting company in Dec 2004. The H1 transfer approval came along in Feb 2005 with "approved from" date as Feb 14 2005. So for the period between Dec 13 2004 and Feb 14 2005 when I was working with the desi consulting company based on a H1-Transfer receipt notice, what is my legal status? I know for sure and have emails from the employer confirming that it was ok to work on a receipt notice without actual approval in hand... but my memory fails me for now... so, how is this supposed to work? any ideas?

existing employer becomes the sponsor of the GC? He has already changed employment during the GC process. Now if he changes employment, I wonder why it is going to be an issue, as long as the field remains constant.

I am a postdoctoral fellow with a PhD from India. What would be the best route to get GC for me. After consultation from lawyers I got extremely diverse opinions. One lawyer advised me to apply in EB1 after I get a permanent job, another thinks I have a strong case for NIW EB2.
I am confused whether I should petition under NIW EB2? Anyone around here who did NIW? How much time and cost does it take?

Are you sure your lawyer did not make any mistake and requested only a 1 year EAD. Did you read all your forms he sent?
Unless you ask for a 1 year EAD or do not send all information needed in the form, they will issue a 1 year EAD only.
Did you also met this conditions
- Pending I-485 Application (Quote Receipt No)
- Approved I-140 (Receipt No)
- Priority Date Retrogression (Country of Chargeability and EB category - quote latest Visa Bulletin dates)
