I just now called TSC and spoke to IO, nice lady, here is what happened:
I: Wanted to know my status as my PD ( Oct'01 - EB3 - India) is current and RD is also current ( Though I know its going to be current by May 1st)
IO ( Nice Lady): Its pending, thats what I can tell you right now,
I: My RD and PD both are current, is there any thing else you can tell me.
IO: All the cases for 2001 & 2002 are pending for adjudication, and your is one among them. Officers will be making decision on these cases with in 30-90 days. Your case is not yet assigned to any officer. If you want, I can send an email to Officer to look into your file.
I: Is there anything else you can tell me
IO: Thats all I can help you with today.

You can go back to your previous employer and work for them until the validity period of their petition. The catch being that you have to always maintain your H1 status i.e. being employed. So as long as you were employed and paid for entire duration you can move back to original petitioner ... unless they have revoked their petition.
You can also move to EAD, if I-485 is denied then what are the chances that a H1 extension based on that petition is also revoked? Also, if your I-485 is denied, you will file MTR.. and as long as that is pending you can stay in the country.

They are the largest lawfirm in USA and I am sure thousands of our members will be their clients and not just you. Likewise there will be other big lawfirms (not Indian lawfirms). I am amazed that people here do not even have the courage to go and talk to their lawyers and employers. We need to blame on ourselves for our sufferings.

For me the more pertinent questions in that time frame are:
1) Will there be a lame duck session, and do we have any chances of visa recapture in that.
2) Will there be any overflow from EB1 and EB2ROW to Eb2I as this will be the end of the 1st quarter.

If you plan to mail the documents, be careful to read the instructions. I just applied my passport to Houston CGI and misread the instructions saying it would take 10 days. It takes 10 days if you got your passport from the local Indian consulate in US but if it was issued by Regional Passport Office in India, it would take six weeks.
They have something similar to Tatkal where you can pay 90 dollars and get it faster. How faster, don't know.
Once you have submitted your application, you are at their mercy and Houston seems to be worse than Indian regional passport offices. Their phones are constantly engaged and they barely respect you when one calls them. You have no way to upgrade.
If you have the time and proximal to an Indian Consulate, I would try going in personally and get the work done.

I received RFE e-mail today morning from NSC ,but wont know the nature of RFE until I receive the letter from USCIS.
Ours is the EAD online renewal filed on July 02nd 2008. RFE is only for my application, nothing yet for my wife's EAD application.
I am surprised your PD is current and why USCIS is requesting evidence for the EAD? instead they should process your I-485 and be done with it.
anyways USCIS processing has no logic sometimes, or may be the EAD department dont know whats happening is adjustment of status department.

If you look at what Obama said on Airforce One the other day and the comments now, it is clear that he is not really committed in getting the CIR done this year. Just to pacify the Hispanic community we will probably have some kind of a start and thats about it.
That might be true. But there are many pots simmering in the background, and because of the events of the last few weeks incuding Arizona's new law, there has been a pressure building on the congress and the president.
We can help to continue to build this pressure by calling our senators and forcing them to take up the debate.
This is the right time, if we do not do anything now, we will have to wait till 2012 or 2013.
Please call our senators now.

I am thinking of waiting till the end of this week and ask my Attorney what is his suggestions on 2nd time filing of I-485.
Does any one know if the I-485 applications mailed to USCIS thru USPS and reached on July 2nd has been rejected.
I would like to if anyone whose I-485 app reached USCIS on July2nd is planning to send for the second time.
I filed on July 2 W/O employment letter. So I asked my lawyer about file a 2nd application since now we have the letter on hand. His respondes on filing another application is negative. He said it will yeild confusion. Hope it helps.

you do not need to have a H1 or H1 visa stamp when you return from canada/Mexico provided that you are returning back to USA with in 30days and do not apply for a visa abroad and you have never been out of status. My case is NSC-TSC-NSC. I-485 applied in NSC in July 07, transferred to TSC for data entry, transferred back to NSC in 2007. Card production ordered mail today.
Hang in there and open a SR if you have not done it yet. I think it helps. I opened one on 7th and got approval on 9th.

in my case, other than current employer, I only have worked in one company for 3yrs. the experience letter neither has appropriate jobtitle nor did it talk bout nature of work. the HR promptly refused to reissue any modified empl letter (even tho the company is big sized and i had genuinely worked there and gotten awards etc etc). My lawyer asked me to get 3 notarized coworker letters stating nature/duties of job, in what professional capacity and which client accounts i had worked on. i got those from excolleagues and thankfully LC and 140 (eb3) went thro wihout rfes. However i dont know if i just got lucky or did they read/believe the coworker testimonies.. :)

It's good to see any movement on the stalled app. Its not a bad sign. My case was moved from VSC to TSC around the time the government had to respond to my complaint. I've got the second FP notice as well. I am not sure what it means in your case. The messages you should look for are "duplicate notice has been mailed to you", "approval notice has been mailed" or "card production ordered". I would not get excited about other notices.

A week ago I got mail that My case from is transffered from NSC to TSC, I called my layer they said it has been put in intial review from approved I140, which I verified by online status. Yesterday i.e. 26 April I got another email with RFE on I-485, at the same time I-140 status was also changed specifying withdrawal notification. How do I know wether I-140 is withdrawn by my emplaoyer. I filed AC21 exactly 4 month after joining new company. I am with the same Lawyer who has originally filed my all Labour, I-140 , I485 ect. Though he is my privious employer Lawyer also.
As far as i know, I140 can only be withdrawn by employer.

I did make a photo copy of the EAD. I did schedule an appointment with info pass on Monday. I'll see how it goes. I'm hoping I do not have to wait anther 6 months. I'm worried with all this fiasco it will take long to correct the mistake.

There was a mistake in my EAD card once and called USCIS & my lawyer and both said I have to send the original EAD card with new filled & signed EAD application (I-765) and all supporting documents (EAD application I-765 & supporting documents mentioned in I-765).
I took photo copy of my original EAD (that has error) before sending it so that I will have proof of their mistake and also wrote cover letter about the mistake USCIS done (I even kept a photocopy of my EAD card and circled the error and asked them to correct it so that it will be easier for them to find the error).
I sent it to USCIS i.e. the entire package and they verified all my details and realized it is their mistake so they sent me the new card with proper details. Since it is their mistake they didnt charge me. If it is your mistake then they will ask you to pay for the EAD i.e. EAD processing fee (if you made mistake like any typo you or your lawyer did in your EAD application you have to pay).
so dont worry but you will have to wait for atleast 10-15 days to get it corrected. so call them and your attroney and get the details and send it to USCIS soon. but it is important to take your EAD photocopy before you send it and keep it in your records. also follow up and send it overnight through fedex/ups/courier for safer/quicker delivery of your packag and you can track too. good luck.
