Is it ok to have a gap between H1B expiry date (say July 31, 2008) and start of EAD (Oct 1, 2008) when a person is in AOS?
I would think it would be okay since AOS is a status (not EAD) which you maintain. EAD just allows you to work for anyone (but not maintain status. For status you use AOS/485)

My employer started the recruitment process and they have got 4 applications for the position advertised. Experience required was MS+0.
Does anyone know what are the effect of having 4 applicants. What is the effect of this to obtaining the labor certification. Is getting more applications a bad situation for me?
I would really appreciate if someone could comment.

Between 1999 there was a scam company run by a Mr. Reddy (jr.) in Bay area, CA. His dad was arrested on charges of murder, sexual exploitation etc. minor girls from Andhra pradesh. Mr. Reddy (dad) is in prison now at CA and the junior is still a fugitive for the charges of abusing H1B and GC privileges, "importing" labor from India on H1B visas and false GC promises etc. So, the "few" numbers may actually grow if these incidents are not highlighted in sites like IV.
Just a little advice... Its a sad fact that of the total of 2.3 million Indian Population in USA.. we have few people like Mr. Varanasi and Mr. Nick Mandalappa (Cybersoftec) who bring a bad name to the whole community...

That is beyond my knowledge. However AFAIK, if this is your first H1 stamp (changed from F1 or L1 etc) , you must get it stamped in your home country.
If it is a second onwards H1 stamp you can possibly do it in any third country -- though third country stamping always carry some additional risk

If you do not have a valid H-1B visa (that is, one that has not expired) stamped in your Indian passport when you leave the US, then you require a transit visa (DATV) to connect through Heathrow.
Even if you plan to get your H-1B stamped in India on this trip, a transit visa is still required when you are leaving from the US since the exemption is for those who have a valid, non-expired H-1B visa in the passport.
Even if you have an AP, a transit visa is still required since AP is not in the list of exemptions.
Note that only diplomatic and official passports from India are exempt. These are different from the ones we typically have.

I brought my fiancee from over sea. It was good in the beginning. But it is very bad now. She is very abusive in her words. She goes around telling lies to make other people feel sorry for her. She says I beat her and abuse her everyday, all lies. She tells me she goes to work. She make calls and some guy would would come and pick her up. She has been gone as long as 2 months. Sometimes she tells me she is coming home, then she would get home a day later or 2-3 am in the morning. I asked her she would get angry and says she is working. She wants to move out, she says my house gives her headaches and it feels like prison. She keeps asking me about her immigration paper work, she threaten me about taking half of what I own if we get separated.
I am so emotionally drained with this girl. I am so stressed, I can't sleep and it is affecting my health and work.
When she arrived, I did get marry with her in court. But everything else, paperwork that is, is not done. I did file for the change of status, and an interview date has been set for next week. What should I do? Help this girl? Kick her out? Have her removed? Continue with the paperwork and bite my tongue for 3 years then get a divorce? What can I do? My gut says kick her out now. But my heart says help her to the end. What can I do?

Well, legally you do have to divorce her to get rid of her. You may have to consult a lawyer if you want to be safe. You maybe at fault even if anything happens to the girl accidentally. I would say first protect yourself by discussing your position with your attorney.

Lets figure out those small things that can happen in the near term. May be that brings more happiness in the short period than eyeing for the whole turn around of the retrogession. which doesn't really seem to happen before the presidential election. Lets be practical about what are the most important concerns of the community than trying to absolve the system of all problems.
I guess we may also need to think from the bottom up with small things than from top to bottom of getting rid of whole retrogession which doesn't appear to happen in the short term. This is not to discourage people from working on ending the retrogession but just to be practical enough to solve the immediate problems for the community.

Sorry if I have confused you on this.
My company is paying the green card expenses. I have agreed to join the company based on this. However they did not mention that I need to pay the gc expenses if I leave before a certaion point. Later before filing GC they asked me to sign this. As my H1 was already beyond 6 yrs I had no other go. but I tried to convince them that it was not discussed at the time of appointment. My employer agrreed that it was not discussed however CONVINCED me to sign the agreement in good faith. Now my case was delayed beyond resonable time limit. My colleagues who applied got the approvals two years back and I am still waiting. Now my question is since the "good faith" is all gone, can I leave the company as soon as I get my GC?
Will I be obligated to pay the expenses since it was not discussed at the time of joining?

AFAIK, Texas doesnot have any state taxes.

But he is working and staying in NJ, he needs to pay tax for NJ. It has nothing to do with employer's location...its about your income.
