Hi,
There is a chance you may get extension of stay (new I 94), please note that the process is not certain.
I did not get extension approval for my parents.
Let us say for an example, my parents came to US on 01 Jan 2003 with a 10 years visa, up on entry they got 6 months approval to stay, that is till June 30 2003. Please note that this visit was the second visit to US, the first was in 2000 for 6 months.
In March 2003 we decided to request for extension of stay, as per conventional knowledge, we should not make the extension request too much in advance, it is recommended to apply 30 days before you permitted stay ends.
Applied extension on 01 June 2003, the USCIS may take 2 to 3 months to process those application. There is a website where you could monitor the status, every day we used to monitor that and found on 10 Aug 2003 stating that the extension is rejected. On 16 Aug 2003 we got a letter stating that extension is rejected and it is out of status now. Please note that there was no clear indication when the out of status time started, it is a big mess. I do know if an application is pending, it is legal and it is in status.
As per the law, if a visitor is out of status even for a day, the 10 years Visitor Visa is invalid, and could have issues for the visitor's GC process.
Only good part is, in most of the cases they do not invalidate the Visa. I have noticed in many cases the visitors had to apply for a new 10 year visitors visa and that was a big mess too.
The reason why I had to write the long reply is to give our IV members a chance to take an informed decision.
My take is, I would not recommend the extension process to any of my friends.

You start working for your new employer after you receive the copy of H1B transfer receipt.
Try to collect the below documents from your current employer;
1. LCA Form 750 (pre-perm) or 9089 (perm) & approval page

So I had to tell him and now obviously he doesnt want to co-operate. I will try to reason with him again but considering the worst case can we proceed without these?

Police Clearance is required from both US and India. Do not submit your application with missing items as that increases the processing time exponentially. Getting your police clearance from India i.e. applying to the nearest consulate doesn't take half as long as it takes FBI to send you the clearance. I am in Los Angeles, applied to the consulate at San Francisco and got my passport back in 3 weeks. On the other hand FBI took its sweet time and it was almost 3 months by the time I received the clearance from them.
Regarding adding a spouse later on, that can surely be done. I got married after my application had been submitted for almost 8 months. It was a pretty simple process and the whole thing was completed in about 14 months, meaning I got the medical papers in that time. Hope this helps!

My I140 was applied in August '08 by the company's lawyer and the company then changed the law firm. Employer & I signed the transfer form and the new Lawyer requested for all the I140 related documents from previous legal. The previous legal has not provided the I140 receipt notice or any status so far.
Now, the new legal is suggesting that the only option we have is to apply for new I140 and request to transfer the previous I140. Not to mention, this lawyer is expensive and I have to pay the fees. It’s strange that they can request for transfer of I140, but cannot ask for the receipt number from USCIS.
Employer is certain that the I140 was applied by previous legal as the check issued for I140 application has been cashed by USCIS.
This is the fist time I am hearing that a lawyer is refusing to provide the information of 140 to sponsering employer. This is ridiculous. I-140 is employer's property and lawyer is working for employer. I guess, there is something else that you might not aware of. You should try to have a conf call between u , lawyer and employer and find out where is the issue.

Hello IV gurus, this question may have been asked before so apologies.
I am now past the 180 day filing period for 485. Also, 140 has been approved too. Now assuming I get laid off in the next few weeks - can I take some time off (meaning can I be unemployed)? I dont intend to travel outside the US and I also have EAD and AP in my hand.
- Can I be unemployed for the next few weeks/months without impacting the processing of the case? Of-course, I intend to be employed when the actual 485 gets approved...which given the current VB dates will take a few years.
- Can I continue to keep applying for EAD and AP even if I am unemployed? Meaning, can I pay for it on my own without my prior employer coming in the picture?

I understand where you are coming from, but I think highly skilled refers to tech skills as opposed to English language excellence. :)

This is basic English stuff - Everyone knows how "meeting" should be spelled as even if you are not very good in English speaking. Or how about House Warming . These things are too basic and do not need anyone to have excellent English.

I have an approved labor and I-140 with company A. My company has been taken over by company B (Succesor in Interest). I have filed for I-485 on July 2nd (EB3, PD : Nov 2004)
1. Company B did not give my lawyer the employer letter to go with I-485 on time, so my lawyer filed it without it (I understand that employer letter is primary evidence to file I-485) Now company B sent it to my lawyer. What will USCIS do? Can we submit it with the receipt notice once we get it? What else could be done?

Pdakwala one of the co founders of IV has been working with the channel to make sure that there is coverage of the challenges we the Highly Skilled Legal Immigrants are facing due to the present outdated immigration process.
My wife and me both Highly Skilled Legal Immigrants will be a part of this documentary. What I intend to do is ....to send a detailed document to the producers mentioning three points so that they have a clear understanding of the contributions we make and the issues we are facing
1. The economic and cultural contributions the HSLI's make.
2. The Competitive advantage this country will lose if it does not make immediate amendments to the broken Immigration process.
3. Debunk some myths such as H1's dont pay tax, H1's take away jobs etc

I have heard from a couple of folks that they have met some senior senetors like Bob Dole and have influnced INS to speed up their case of GC processing. Is this true ? .
If this is true is there a way to stop the influence by senetors so that these everyone gets a fair chance of getting their GC.

I am moving this weekend.....I have heard that USPS will not forward mail to the new address and hence I need to use Ar-11 to change address
My wife and my EAD's were mailed Nov. 27 and should arrive in a week I guess. however I will not have keys to the mailbox then. Rather than change address immediately with USCIS can I just have USPS hold my mail for a few days. That way my EAD wont be sent back to USCIS.
Will this work? Or do I have to bite the ubllet and change my address and have my EAD returned to USCIS and wait till they send it out again.
Please advice

My case is NSC-CSC-NSC. i-485 applied in NSC in July 07, transferred to CSC for data entry, transferred back to NSC in 2007. Welcome email received today.

I set myself a deadline of March 2007 for any reform to be passed so I can atleast decide to go Home for good, folks do you think SKIL will get passed before that ?

Sorry dude/dudette, dont mean to make fun of you but the only thing that we are ALL sure about is, that NO one knows if and when any kind of relief will come. Forget when the SKIL bill will be passed, right now we dont even know when it will be tabled or IF it will be tabled AT ALL.
A personal opinion: I feel, it is HIGHLY unlikely that Skil bill will be passed by March 2007. But that is MY opinion.
