AILF's Legal Action Center has a class action lawsuit completed and ready to file against the Department of Homeland Security and the Department of State for their unlawful actions in the I-485 / Visa Bulletin mess. The government improperly denied tens of thousands of intending immigrants the opportunity to apply for employment-based visas known as "green cards."
Rumors continue today that the Administration will be announcing a decision regarding their proposal to resolve the crisis. The most recent rumors indicate that the announcement will be made today. However, there are widely varying reports on what the proposed solution will be.
AILF will review any proposals by the Administration to resolve this issue, and will determine the best course of action in light of those proposals. While we remain hopeful that the Administration will take the actions necessary to avoid the filing of the lawsuit, further delays or incomplete solutions will compel us to move forward with litigation.
We thank the hundreds of people - intending immigrants and their lawyers - who have contacted us to be plaintiffs and support the litigation. I have used AC21 twice. I did send a letter to USCIS for my first move. i have not sent any letter for my second move. Most of the attorneys i consulted are saying it is not necessry to file for AC 21 unless you feel the employer can jeopardise your green card.
There is no rule for filing AC 21. If you get an RFE, they will request the specific document they need. If you are following the rules, then you should be able to provide whatever they request in the RFE.

My situation:
I have I-485 pending at NSC EB3 category with July 2007 filing date. My I-140 is approved. I am planing to quit my job and get a job in different job qualification.Hence cannot file AC21.
My wife got naturalized and after researching online, I made a decision to file new 485 with I-130,I-864 and I-131. My AP based on employment based 485 is expired and hence I applied for new I-131 through family based thus saving money.
I did not apply for I-765 (Family Based) as I had an active EAD untill 2012(Employment Based).
I am to quit my job and afraid that my I-140 (Approved Jan 2008) will be pulled and hence my I-485(Employment Based) will be denied/revoked. Since my active EAD is based on the employment based 485, it will be unusable/revoked as well.I do not want to invoke AC21. For this reason, I want to file EAD based on Family -I-485.
My question is :
1) Can I file for I-765 based on pending I-485 (Family Based IR1).
2) Since they required to submit the last EAD issued - which in my case is employment based EAD expiring in 2012, The chances are USCIS will deny it or am I to do something differently?

If your current H1 is already expired, it is better/safer to use AC21 and join company B.
else get hold of reputed lawyer and transfer H1 to comp B.

I am not sure I understand why would you want to do this? You are on EAD, correct? This already gives you the right to work for any employer; getting an H-1B would be a step back in this regard. Am I missing something?
I am interested in changing from I-485 EAD to H1B. My reason being I want to change my work and get a different position. does anyone know what is the procedure?

You are not mandated to report on AC21 (job change) so my advice is not to report it till USCIS ask's you.
For address change. Yes you need to report that. But if you can retain your current address for just this one month and perhaps commute (fly) to your new job you can take a chance. Just my advice

My wife is currently on h4. She has applied for H4 to F1 trasfer i539 application with university A in May 2008. She is currently enrolled in University A on H4 as her application is pending. Now she got admission from a better unversity (starting Spring - Jan 2009) and she wants to join this university. What is the process to transfer her university given her i539 application is still pending (and probably remain pending till early 2009).

I have been trying to get visa appointment dates for my parents at Delhi consulate but no luck. Dates for Hindi are even more difficult to get. Are there any specific days/dates/times when one should try? Any input is appreciated.

An L-1 work visa is issued to an executive of a company that has worked with his/her company outside of the USA for at least one year. Dependents receive L-2 visas and a spouse can apply for an EAD. Trouble is, if the exec is laid off, all of the dependant visas immediately expire and both the exec and his/her spouse must leave the USA!
Any ideas how to alleviate this issue? Getting a H1B visa is impractical since they are so scarce.
Also in this case, is the exec's employer liable for relocation expenses?

Hi,
I got my EAD renewed recently and by mistake I have interchanged my First Name and Last Name in the application. I received an approved EAD card also with the First Name and Last Name interchanged.
I noticed the problem only when I went to renew my Drivers License.
My questions are
1) What is the process to get the names rectified on an approved EAD
2) If I leave it as it, will it create any issues.
