Can you get AP when you are out of status anytime during your stay in USA, if you get AP can you travel outside USA and enter back using it.

Your question is not clear. you need to provide full information. Have u visited outside US being out of status? How long was that and reason?

Hello,
We have our 485 interview's next week @ the Baltimore Field Office. My PD is current for EB-2. My case is pretty straightforward so hopefully should not be a issue.
Would appreciate any comments from folks in MD who have been interviewed @ the Fallon Federal Building in downtown.

Particularly - can they approve our cases right there & then.? Will they stamp our passports for approval since PD is current for January 2011.? Can there be any issued with visa number not available, etc. ?

Any advice is appreciated.

My employer mentioned that my job description is Senior Analyst in the application. Does that mean I have to be a Senior Analyst till the time I get GC ? Cant I take up another job like Architect ?

Also, for 140 application do I have to sign on any PERM labor related document ?

Folks,
If your petition has been physically "Mailed" to the Atlanta Service center . Do they give you a tracking number . Can such cases be viewed online on the website http://www.plc.doleta.gov ? How much time does the Atlanta service center take to acknowledge the reciept of such application ?

I am on H1B and my wife is in H4 here. She is a nurse and can apply for the AOS before Aug 17 .But she does not have all certificate that makes her AOS approved at this time. We hope that we can obtain the certificate (Visa Screen certificate) by the time the RFE comes. But it is a 50-50 chance only. So what could be the best option for us and consequences of each.
My case (h1B)
1. I also apply for AOS with her so that I can get aGC along with her but do not use the EAD .
2. I apply for the AOS later but before her AOS approved.
My wife case (h4)
1. Apply for the AOS but do not use EAD
2. Apply AOS and use EAD.
Also do you know around when the USCIS issues RFE once the application is recieved?
I really appreciate your advice in this.

we are on last stage approved i-130 USA citizen for married daughter.
because we overstayed in USA since 1996 here do we have to leave country since we applied only in 2003?
this would be a disaster since we have nobody in Italy that con support us until get a waiver from USA counsolate....they said about 9 months if everything is ok...
my only hope is that a read something about cancellation of deportation and adjustment of status here in USA no needed to leave country...how dangerous can be to start this process, wile waiting for last stage of i-130?
i have good business, house, cars, furniture here and always paid taxes. 2 USA kids. thanks gimme hope

Hi,
I have been searching in the inernet for quite some time and looks like
the following questions are still not answered properly. So any of you here who actually used the AC21 in the past can answer the below questions and it will help lot of people on this board.

1) When the employee don't have I-140 receipt number and I-140 approval copy , is it okay to use AC21 after 180 days ?

2) Do we need to have I-140 approval copy for the EAD renewal ?

Hi All,

I got F1 VISA for X University and then I transfered to Y University.
Now I have lost I20 for that X University.

I am filing for H1B now and I am supposed to submit all prior I20s.
What would be the potential problem if I do not submit the I20 of X univ?

Is there any way to retrieve the I20 from the university?

I know that the EAD card comes directly to the applicant and not to the attorney.

What about RFE on EAD? Does that too come directly to the applicant?

Pls lets know when you get your EAD. It would be interesting to see how long it takes with this avalanche of EAD applications

From Matthew Oh's website, sounds like labor sub will be history from next week.

What are people's guesses on how many of the BEC labor certifications will be rendered effectively useless because of this?

Also, does this mean it will be more straightforward to port PD after I140 approval (because the old employer has no benefit to revoking I140 anymore?)?

I signed an employment agreement stating that if I had to leave my employer before getting my Green Card that I will be liable for all the fees pertaining to the Green Card application which my employer has been paying for while I am been employed by him.

I have heard that an employer cannot hold Green Card fees over an employee. I also believe if anything, the fees owing should drop according to the length of time that the employee has worked for that employer.

I have been with my current employer for 4 years now and I wish to leave him but I do not want to pay him for the Green Card fees as I believe that should be a business expense to him.

I would just like to know what are my rights in the above case
