I have some questions with regards to my wifes immigration status. She was previously on H-4 visa (valid till 2009) when I was with employer A. She then applied for an H-1 which started from October, 2007. She started working on a project from November. The project lasted for couple of months. During that time, I transferred my H1 to employer B. Since January, her company has no projects for her and she is not working. But they had been asking her to sign leave of absence and providing partial pay stubs (one week in a month) since then. Now she wants to transfer back to H-4 status and we are planning to file for a change of status from H-1 to H-4. My questions are:
1) Are pay stubs of current H-1 employment required while filing for change of status to H-4?
If yes, will it be OK if she just provide a partial month pay stub for last two months and rest of the days, we can show it as absence of leave due to some reasons? This is to avoid large amount of taxes which we have to pay in order to get the pay stubs. The employer is ready to provide other papers required to prove current employment with them. (Like offer letter and other stuff)
2) Can she go back to India without change of status and stamp her previous H-4 and come back to US on H-4? The problem I feel with this situation is that her H-4 was approved when I was working with employer A but currently I am working for employer B. So does that mean that she has to apply for a completely new H-4?
3) Can we go to any other country like Canada, Mexico, and Bahamas and get a new H-4 stamped for her? Or it has to be done from India? I will also get my H-1 stamped the same time.
4) What are the documents that will be required to file for COS using form I-539 and how long it usually takes to get approved?
5) Can she travel to India while her COS is still under process?
Do I need a lawyer for the above process? I have previously applied for her change of status from F-2 to H-4 by myself with no problems. If a lawyer is required, can some one please suggest some good contacts in DC area?
Sorry for too many questions but any replies to my queries will be greatly appreciated.
Thank You

The reason I gave was financial loss. I said I'm the only bread earner in the family with a dependant wife and daughter.
I called up thrice, since the first two reps did not even open a SR. The third person was good and he transferred me to I guess a level II rep. She sent the expedite request.
..and this is just what I'm thinking that, it all happened due to the expedite request. It's very much possible that it could have happened on it's own..
Good luck..

As far as I know conversion from H4 to H1 comes under cap unless you are in one of the exempt categories.

Hi Folks,
My PD got current at today's Visa Bulletin. Presently I live in SF City, California but we are in the process of move from California to Texas. We will be finally move to TX during Sept-2007. My questions are:
1. Can we move from CA to TX after I-485/EAD/AP is filed from California?
2. We do have a PO address is Texas now and have an apartment in CA for next 5 months.
Do you recommend to use the Texas PO Box address instead of California Apartment address for USCIS I-485 application such that we can avoid the Change of Address with USCIS later?
3. What are RISKS of moving from state to state during I-485 process? Did anyone do that in this forum?
Please advise - thanks

The trend evey year is most approval coming from TSC not NSC. Why can't we suggest to close NSC so that all the approval could come from one place.

Great Idea. Since this is Saralayar brain child, let us all nominate him/her to lead this venture , while us IV followers pursue more servile task's like trying to recapture visa numbers, get multi year EAD's and basically save our B*^$'s.
If this venture is a success Saralayar will be a citizen in a year (along with a few side kicks that are backing this new citizenship concept) or so and then he/she can push congress to pass the other minor legislation that will bail the rest of us out.
Can you stop your f*** mouth?. Are you educated and have ethics?. If you do not like this idea get out of this thread. There are people who give good suggestions and welcome this idea. I am seeing all your posts in this forum. You are a bullshit guy by nature. Get lost.
IV admin, please ban this guy (supplychainwalla) from all the forums. we do not need such perverted broots in the high skilled forum.

I think those who are eligible to change to Eb2 should start immediately. In any case Eb2 was much better in past and it will be in future also as all the other country quota EB1 and Eb2 will automatically come to EB2 India and China every year. All the Eb3 should wait 10 years or hope for some law change.
I need to go to some place where I can spit out my frustration. This is just not done. Completely unfair.

I'm ready to file AOS, while filling in the forms I realized that I have just one more page left in my passport which is valid for another 7 years.
- If I get a "new booklet" from the Indian Consulate, does it come with the same or different passport number?
- If it has a different passport number, does it affect the AOS application once the AOS has been filed with the previous passport details?
It does come with a new passport number. Also if you have current valid visa in old passport, you always have to carry both passports together. Your new passport will even have a note saying that you traveled earlier on a previous passport. Also the number of your new passport will be noted on your old passport.
I do not think you will have any problem due to applying for a new booklet. Passport is an active document and subject to ongoing changes.
You might want to confirm that with your lawyer though.

We need to maintain calm in these testing times... Not just for evey member but more so for people who are in the Core teams and doing the day to day activities behind the scene,,,,
We all know we cannot have all ~9000 member working on the issue simultaneously....too many cooks will spoil the broth....so lets play our designated roles..Right now every non core member should just contribute - even $20 is good enough...Imagine $20 * 9000 = $180,000....which could almost match our all time collections yet....
I again request folks to play their role in this moment rather than just sitting idle and waiting for something to happen.....

hi there,
Just wanted to post that my husband and I finally had our embassy interview for our greencards and are back in the states approved and very happy!
Our interview appointment came very quickly, within 3 weeks of the March visa bulletin. I wish you all the same fortune and hope that the priority dates open up considerably for you all.
My best.
