    My second 140 may be approved by this month end.. Neb-Nov. 08-filing... i am hoping i will be able to port my PD..to 12-05

    Now..in case i lose my job... and since i am in my 9th yr-h1..which expires may-2010..

    suppose ..i cant find a job ...and if i have to leave US.....(but my employer agrees not to cancel my 140)
    a.) what should i do to retain my GC process?
    b.) How do i switch to CP processing....

    You need to file I 824 form and let USCSIS know that you want to transfer your case to consulate. If you are from Mumbai consulate area then u can do AC I 140. becasue I 824 can take 1-2 years to transfer your details.

    While in AC I 140 you just need receipt of I 824 and attorney certified package. More details you can get on internet. If you PD is near to current then u can initiate this process and thus with in 3-4 months if PD become current you can get visa interview. Generally they dont ask for hard ship reason for AC I 140 but in your case you can explain about your wait time and impact on your career etc..

    To do AC I 140 or normal CP process u need offer letter from employer.

    I have been a silent reader but a recurring contributor. We all need to come together and work for a Skill Bill or atleast be able to file for I-485 without Visa number availability so that we can get EAD's, Buy houses, Travel in and out of the country without going to the consulate, not pass up on projects which need a lot of International Travel. Can we work for this?. This would help a lot of us keep our minds peaceful

    Today I received email from my lawyer that my Perm was approved yesterday.

    Here are the details:

    Started preparing for Perm Late June Early July
    Advertised on DOL website October 1st - Nov 30th
    Paper Advertisements: October - November
    Applied Perm Dec 13th
    Approval received Dec 27th.

    In the 485 check list sent by my employer one of the item is :

    "Affidavit of support duly notarized (Form I-864) if you are applying for your family"

    I am applying for my self and my wife and for my daugher. I will send my all paper to my employer and he will sent to attorney.
    Do i have to fill form I-864 or attorney will fill form. if i need to fill then where i can find this form and how i can notarize it.

    Please help.

    Hello All,

    If my priority date is current as of November bulletin, do I have time
    until 30th November to mail the I-485 application?

    Or does the DOS need to have received the application on or before 30th November?

    And if I am in California, where does the I-485 application physically go?

    [Its a long story why I didn't when the doors were open in July-Aug]

    I was wondering if anyone has any info on the job
    market for international students in NY. I will be graduating
    in Dec and will be on the job market soon.

    Some of my friends say that there are jobs to be had but
    not many are keen on sponsoring H1, even non-tarp firms.

    Can anyone confirm/refute this?

    market is tough but dont give up & just sit back though - for what its worth look aggressively & hopefully you have opt for 1+year available so they get a chance to look at you

    Yes the bottom line is you have to withdraw one. In my case, I have to write in letter to USCIS in Nebraska becase I did self-filing. I've spoken to an agent a while ago. She said withdrawal will not affect my other I-485. Consult with your attorney. I already have a finger printing appointment next week so I'm goin to withdraw the I-485 receipt from Nebraska.

    Hi,
    I just got my H1B visa and I am working. My wife is currently on F-1/OPT. We are both in the USA. Could you please advise me what is the required documents/steps to apply for her for H4 visa? are there any inf on the web? can I do that myself?

    Like PMAT mentioned, I-539 is to be used, and you can do it by yourself, if you'd like. Download the latest form from http://www.uscis.gov/files/form/ (immigration forms).

    You will need, I-129, photocopy of your passport, your I-94 (current), Photocopy of Marriage certificate.

    In september my dates became current and my GC and my spouse GC has been approved . However my lawyer recieved interview notices for me and my wife. What should be the next step. Ignore the notices as we recieved the Green card or do we need to attend the interview.

    My advice "do not ignore it". Best is to take an infopass and get it resolved. Else attend the interview. Take a local lawyer if you need and tell the officer that you already have a GC. It is better to personally close this issue than reklessly abandon it hoping that it will close by itself. It can create more mess than you can handle.

    I applied for H1B and Green Card Simultaneously in 2002. My first H1B expired in 2005. I am working on EAD. My questions are--

    If I decide to change jobs and apply for H1B with the new company, am I subject to the QUOTA?

    If I change jobs( in similar field) to another state in another service center, how is my case transfered to TSC from NSC?

    Please reply.
