Now both companies A and B made a joint venture (JV) and made company �c� joining company �a� and �b�.
Company A has 25% stake and company B has 75% stake in JV(Company "c"). The new formed company "c" has �new name�, all employees filed �new employment applications� and have �offered a new employment� with the new company �c�
Now my question is as this company �c� is totally �new�, can I convert my EB3 case to EB2 and use company �a� experience and file for EB2 with company �c�

It's interesting that people rely on consultants and body shoppers to enter this country and then curse them.
I doubt that so many people would have entered the US if it hadn't been for these very consultants and body-shoppers. Everyone knows that they pay less and take a cut of the salary. People curse them all the time and yet when it's convenient, they'll use them to get things like H1B application, labor substitution, etc. done.
I am on an H-1B visa I had a confusion regarding my wife's case. She is on H4 visa and her H4 visa was extended to September, 2009 when I changed my employer (XXX) last year. However, her passport carries H4 visa which expires in Oct. 2007 (this was through my previous employer, YYY). Both our I-485 are pending and we both received our EAD last month. She wants to use her EAD to work in future.
A twist is that a consultant had filed for her H-1B this April and we don't know if her H-1B came through or not. He is not telling us. We just don't want to deal with that scumbag. Can we just ignore him and forget about it? Since her I-485 is pending she has a lawful status (Pending AOS), right? Please let me know what you think.

My attorney sent me a questinaire and the following is a part of the questionaire.
I don't have any of the below mentioned but a checking account. Do I need to have any of the following so that I can get approval for my I485?

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. On May 5, 2008 I got a message through my employer that they received an EAC receipt number from USCIS.While checking online we received a message
Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Case Rejected because of Incorrect Fee
On May 5, 2008, we determined that this I129 PETITION FOR A NONIMMIGRANT WORKER was not properly filed because you submitted incorrect fee. Therefore, we have rejected your case and returned it to you with all supporting materials, along with the fee. Please follow the instructions on the notice to submit the case with correct fee."
The online notice specifies that "Please follow the instructions on the notice to submit the case with correct fee". Unfortunately, we did not receive the notice till June 5, 2008. I called USCIS and requested them for the papers, they reassured me to have the communication sent to their Vermont office and that I have to wait for another 45 days. Today morning 26th June, 2008 my employer received a notice from USCIS saying that the H1-B petition has been rejected because it was not randomly selected for processing.
I am confused how can I get a receipt number without getting randomly selected? what can I do in this regard please help me!

I have question to you. I am July 2007 filer. My EAD and My wife EAD expiring on 09-25-2008. I applied both renewal Yesterday(06-24-2008 -90 days before).
recently My wife moved from H1B and working on EAD ( I am still working on H1B).
1. If we wont get EAD cards in time (i.e. before 09-25-2008). What will be her status after 09-25-2008 ?
2. Can she change back to H4 or can she change back to H1?
Please advice me.
Don't worry about your status after EAD expires. As long as you have pending I-485 you are in status. Its a different matter that she might have to stop working until EAD is approved. That said, USCIS is super-fast in approving EAD and actually people have been complaining about it:D

It is unlikely that your I-140 was revoked because usually they are revoked only for fraud. Also, there is no limit on the time you can have I-140 approved before filing for I-485 and continuing your case. Most likely you cannot file I-485 anyway due to retrogression.

My wife's priority date is current now (Marriage took place before the acceptance of my GC). We have to options - applying for FTJ or I-485 as my wife is in USA currently on a visit visa.
Any suggestions if we can apply for I-485 from here, as that is our preference.

Can we go after State dept to have them make an administrative fix to publish 2 sets of Visa dates, one for Visa posts and one for USCIS. CIS Dates to reflect their processing length and allow for an early AOS application..
