What is your point?
I don�t buy the argument that only India and China produce the brightest people who are willing to work here in U.S. There are just as many people from Europe and the rest of the world who are just as qualified and who would want to work in the U.S. The problem starts with the H1-B visas, where most of them are taken by these Indian IT consulting companies. Correct me if I�m wrong, but I don�t think these IT companies hire non-Indian workers. There are many qualified people from the rest of the world who are willing to work here in U.S, but can�t because the majority of the H1-B visas is going to Indians and Chinese nationals. Perhaps, there should be a per-country quota at the H1-B level. I don�t think there is anything wrong with the current country quota; if some countries don�t use their quotas then these quotas roll into the countries that have higher demand.

I highly doubt any one with a full time job will trade enough volume for it to be cost effective to claim trader status when filing taxes. If you trade for a living,not work as a trader then it makes absolute sense to file as a trader.
What is the advantage of claiming trader status on your tax return? I buy / sell shares on different days of the week (example: Buy on Monday, Sell on Friday). Does that make me a day trader?
I am doing this on H1B. I do have approved EAD.

Los Angeles � Reeves & Associates, A Professional Law Corporation filed a class action lawsuit today in the U.S. District Court, Central District CA, Case Number SACV08-688 JVX (SHx) on behalf of tens of thousands of immigrant families whose adult children have been wrongfully denied of visas. Attorneys for the families are seeking to compel the United States Citizenship and Immigration Service (�USCIS�) to act in accordance with the provision of Child Status Protection Act (CSPA) that enables children to reunite with their families more quickly.
Prior to CSPA children who reached the age of 21 were no longer eligible to obtain an immigrant visa with the rest of their family. These children became known as �age-outs.� However, Congress enacted Section 3 of CSPA, codified as INA � 203(h)(3), to keep children together with their parents. Specifically, this provision allowed children to automatically convert the visa petition and retain the original filing date � known as the priority date � after the child had aged out. As such, an aged-out child, who is a derivative beneficiary of the visa petition of his parent, can reunite with their family faster by utilizing their parent�s earlier priority date. As of today, USCIS has not only failed to comply with INA � 203(h)(3), but has also failed to promulgate regulations or issue policy memorandum regarding this provision of law.
�This case affects tens of thousands of immigrant families,� said Robert L. Reeves, founder and Managing Attorney of Reeves & Associates, APLC. �A child abroad who aged-out is eligible under CSPA for an immigrant visa, and if the child is in the United States, he or she will be able to adjust to legal resident status,� explained Mr. Reeves.
The class action lawsuit presents two different classes of aggrieved individuals. Nancy Miller, a partner with Reeves & Associates and co-counsel, describes the two classes as �those who filed petitions with requests for retention of the parent�s original priority date whose petitions were denied and those who have received no response at all to their requests for retention of the original priority date.� In both cases parents remain separated from their children.
Although USCIS has granted some visa petitions and permitted retention of the earlier priority dates pursuant to INA � 203(h)(3) to some, there appears to be no uniform policy from USCIS as a whole. Jeremiah Johnson, a partner with Reeves & Associates and co-counsel, said �the lack of any regulations or even policy memorandum has lead to arbitrary and inconsistent decision-making affecting thousands on a global level.� Joyce Komanapalli, an associate with Reeves & Associates and co-counsel, added �USCIS�s refusal to issue visa petitions with the original priority date is at odds with the language, structure, history and purpose of the Child Status Protection Act.�

We're all (mostly) techies.... we should be able to fix this and deliver higher SLAs for our web site...

Does the IV core team plan on sharing their strategy for the New Year with the new members?
I am sure the core will let us know as soon as the legislative session begins in Feb/March. Infact, even before that there are state chapters actively involved in meeting lawmakers. I feel for any activity to take place, we need more members.

If the petition is filed as a COS H1, then USCIS should approve it with an attached I-94 unless there are any doubts in which case, it still approves it but without an I-94 and sends a cable to your home country visa consulate where you would have to go and get the visa stamped before Oct 1st and come back to start working...
If her current status is Valid and is H4 and If the attorney does the paper work right as Change of Status she should get an I94 attached to the approval notice. In that case she does not need to get it stamped to work. But if she leaves the country for any reason she should get the H1B stamped.

If they accept all 500k I-485 application. They will have more than 140k cases eligible for approval every year. I don�t see any visas will get wasted.
Visas are getting wasted, because they sit on their "chairs" not working on the cases. Not because there are not many applications.

We should NOT be surprised that there is no movement in EB2/EB3 (INDIA) Categories given the number of applications filed recently. We may not see any reasonable forward movement for a long time unless congress passes the visa recapture bill.

Can you give me some reasons why visas are unused and a percentage.
In other words, why would someone go through all the paperwork and then not get the visa?
He meant that 140k Visa numbers allocated each year, out of which less number Visas are actually processed by CIS, all the unused visa numbers in the past which might be more than 300k should be used now to reduce the backlog.

I paper filled EAD renewal application on 04/17 and until now my cheque has not been chashed. I called the customer service last week and the representative told me to call after a week. Don't know what happened to my application. Has anyone else experienced this long delay. I sent my application to Phoenix, AZ lockbox.

I had a somewhat similar epiphany little while ago and started a new thread... and got laughed at.... but the more you think about it the more this sequence of events comes across as a plausible and logical explanation of what may have happened.
It would be interesting to watch if and how the agencies respond to Congresswoman Lofgren's letter and if any new and more interesting details about this whole mess reveal themselves.
Where's an investigative reporter when you need one.... is Bob Woodward listening? :)
BTW, loved the Post's coverage - perhaps the best amongst all I've read so far.

So is it possible that the following was USCIS' plan all along in a bid to (1) force applicants to pay the higher fees and (2) reduce the number of applications they would receive. So let's try and see where USCIS or DOS acually broke the law. BTW, the following is pure speculation on my part.
1. DOS makes all categories current in the visa bulletin dated June 12.
2. This screws up USCIS's plans. So they have to force the DOS to issue a revision before July 1st.
3. USCIS frantically starts requesting visa numbers. Even for 485s with pending FBI checks.
4. Come July 2nd, USCIS still hasn't used up all the 60,000 or so numbers, but still informs DOS that all visa numbers have been exhausted.
5. DOS publishes a revised visa bulletin dated July 02 where everthing becomes unavailable.
6. USCIS acts on DOS revised visa bulletin and decides to reject all I-485s filed on July 02 and beyond.
7. July 05 onwards, USCIS starts returning the numbers to DOS. This could be for applications that have pending FBI checks.
8. DOS now decides to use some caution before issuing August bulletin. They will probably not make all categories current, but will probably shift them by a few months based on June bulletin.
9. USCIS now gets all new applications with higher fees and a reduced number of applications.
Please add to this sequence of events if you think I missed anything.

Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!
After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....
After 15 years in the US, I will finally have my green card in hand soon.
