Hello Gurus,
I have a question as follows. I was with an old company and transferred the H1 in the 9th year to the new company. I already had my Labor and I-140 approved with the old company (EB3-I Category).
After switching to this new company I had to start my PERM all over again as I missed the July 2007 boat and could not file for I-485. My new company is based in L.A.-California. I am already drawing my salary from new company. They only have office in L.A. I work for them from my home office in NJ. Today the company's attorney called & asked me that I needed to have L.A. residential address as it is required to be stated on the application. I have no intentions to move to L.A. in near future. I am in a fix now as to how to go about this. I will appreciate all you gurus and experts advice and also please advise me repercussions if any.

Hello Gurus,

I knw how it feels. BTW after how many days of raising an SR did u get this email? I'm thinking of raising an SR as well...
90 days is a lonnng time. I donno how it works if ur case dozn't get picked up in the next 50 odd days and the dates go back in Oct. Good luck anywayz...I'm sure thgs will work out.

Congratulations to all who got their approvals in Sept.
I really need your advise , it seems my case is frozen and no one is looking at it.

My dates were within processing dates for 3 months in 2007, 9 months in 2008 and 3+ months in 2009 but still no one is adjudicating my case.
I tried following

- Enquiry thru Ombudusman's office.
- Enquiry using info pass
All of these enquiries just send very standard formatted response suggesting we are working on your case get back in 6 months.

Ask your employer keep everything ready backlogs will be cleared by sep 30, hope you get your LC before that and you can apply for 140 & 485 concurrent. I know it is unfair, we can't help but act smart.
Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

Congratulations Dude !!! wow 6 years for a freakin LC.. What happened at the BEC.. did it go the BEC for BEC :)
By grace of Almighty, finally my Inbox received the email from USCIS that I was eagerly waiting for.
Just few minutes back, I received the Email from USCIS for myself, my wife and daughter saying "Current Status: Notice mailed welcoming the new permanent resident".
It's a long journey started in August 1997 with landing in Washington Dulles Airport. Got a chance to start the GC process by filing Labor in 2001. The labor approval didn't come until 2007.
In 2004 had to take a transfer to different company which caused me to start the Labor again in Nov 2004. Lost the valuable 3 years of PD date.
Finally the approval for 2nd labor came just right before 2007 July Fiasco. Luckily I had my attorney filed my application on July 2nd itself. And Rest you know the story.
All throughout I was on H1B, on permanent employment and never out of status. Never had any problem with Immigration process except for the GC delay. In any way it was an interesting journey, making new friends, had the chance to live in SFO, LA, New Jersey, Virginia and currently in Maryland.
Many thanks to IV and its members for providing the wonderful platform for sharing and collaborating for common cause.

How much clout does this congresswoman have? She seems to understand the entire scenario better than any american soul out there! It also seems like she has spent a lot of time on this and understands the system very well.

once USCIS gets a visa number from DOS for a "pre-adjudicated" app, it has to complete the approval and assign the visa number within 7 days, if not the visa number has to be returned back to DOS.

My suggestion is: those who have maxed out their 6 yrs on H-1B + have atleast crossed the labor and I-140 stage; should be automatically granted the green card.
These are the people who are really stuck, because if their green card does not get approved, they have no option but to return. Also, if they lose their job they are out of options as they cannot seek another H1B extension or transfer.
Typically, these people would have young children who were born here, and go to school here. These children sing the US national anthem and pledge allegience to the flag everyday at their school. Making these people wait and wait for their green cards helps no one. They are not taking anyones jobs, they are educated, civilized people. They have proved their usefulness to their companies and the society over the past 7~8 years.
Thank you Totoro. People like you keeps the hope alive in our heart that someday justice will be done.
So far all the arguments and suggestions were really good. But Totoro seems to be looking for compelling stories. There are very depressing cases where people had to restart their GC process for no fault of their own. And some people have been here for more than 10 years still rotting in the queue hoping to get a GC and move on with their dreams to become a Citizen of this country.
However the collective compelling story is what Eternal Hope has expressed. This is exactly the situation for people from India/China.
Sure anchor babies is not a great argument for illegals cause it promotes illegal immigration. (In fact I heard in some countries Citizenship by birth only works if the parents are legals. But thats a different story.).
Let us say because of the reasons listed by Eternal Hope we are forced to go back to our home countries.
Firstly, How fair will that be for our children who are Legit Citizens of US.
These innocent kids know only US as their home. Just as much as any other US Citizen. Most of the kids can only speak english. They can barely understand their mother tongue. Point is they are just as American as any American kid.
If they are forced to go to a foreign country, far from their friends and familiar surroundings. Had the change been for the better, still they would feel they were wronged. My guess is they will hold a grudge against us, their parents, and their own country.
This to me is compelling reason, specially since I am a Democrat (sorry can't vote yet).
BTW, my moral support has always with Obama, and with Zoe Loefgren.

That was the defining moment for all people who have been subjected to injustice, been told that they were not good enough because of their race or country of origin. Think about it... The Chinese and Indians having to wait so many years just to get a GC is injustice being done to a people of certain origin. Oh well!

I dont think IV will take credit for any behind the scenes efforts unless they become public as to who is doinig it. But the fact that IV responded to member requests for update even before any lawyer, immigration website or even before anti iimmigrants, shows that they are truely working behind the scenes driving our bills. They may not be disclosing it all on the forums since it will affect the effort.
IV should take credit at least for clearing the air when this bogus rumor was making the rounds last night. i knew it looked suspicious. it also shows IV are on top of everything going on.

Just back from an Infopass appointment.
The lady was friendly and chked the status of my application. First she informed me that it was under review and then she told me that on Aug 3, it was assigned to an IO. I didn't ask any further questions as the news that my case has been assigned to an officer made me happy. I just wished her a good day and left.
Now, I'm beginning to wonder if I shud have asked more questions such as about Namecheck, FP etc...But I donno its with an IO and I guess I'll know the actual status shortly.

Porting is legal..and as long as the government recognizes it why worry..I have not ported and green on EB2 but..dont see any issues if someone who applied in EB3 now satisfies the criteria laid out by govt and gets his GC...
If you have any problem with that fight it in the congress..not with folks who are just doing what they need to do..Dont get this porters vs. non-porters fight..also current VB shows that there are not that many porters..so it is not really hurting anyone..
On a side note USCIS has been really efficient in delivering your actual GC's under 1 week from CPO email.
Good luck and congrats to all who are current or soon to be.

all the studies by economists, investment experts, psychologists, etc for the last several decades clearly showed that for 99% of the people day trading makes them lose all their money. it is highly addictive and on an average everbody loses their savings. legally it is another style of trading and there are no consequences whether you are on J1, H1B, on EAD or a citizen! (ofcourse if somebody knows which stock is going to be up/down and exactly when, he can make a lot of money (better call him a prophet than a day trader/pattern trader).
Guys, My personal opinion. Pls do not fall for these risky trading tactics. I'm in no way against trading, but cautioning you whole heartedly...and I have nothing against the original poster
In trading if you are able to beat the market with 10-20% consistency for 2-3years, the wall street banks will be at your door steps asking you to work for them with profit sharing and salary

The so called wall street is full of crooks/manipulators and what an ordinary investor thinks to be an excellent stock would be junk if the street does not favour it...How much ever you compare relative stocks with fundamentals, p/e, Financials statements, beta , volatility etc etc....
And the Buzz words for these kind of manipulations are " Shorting, Naked- Shorting, Rumor mongering, Insider Trading, Pre-after market trading"
I bet once you are in trading, you will have tremendous Mood Swings.
However if you want to understand what trading is all about , you can visit this trading education website . Its a nice set of videos about technicals.

Hi Folks,
My PD is current but my lawyer is saying that I CANNOT file I-485.
Reason:
My labor cert / EB2 was originated in Illinois and then amended for Virginia by G-28.
Since my labor cert approval, i moved to Califonia - same job, same company.
Now my lawyer is saying that I need to go back to Virginia so i can apply for I-485.
Question:
1. Do i have to go back to the same state/location at I-485 filing stage where my Labor was originally approved?
2. Doesnot Green Card is for a future job?
3. Can i file I-485 while I am in California and my labor was approved for VA?

My PD is current but my lawyer is saying that I CANNOT file I-485.
Reason:
My labor cert / EB2 was originated in Illinois and then amended for Virginia by G-28.
Since my labor cert approval, i moved to Califonia - same job, same company.
Now my lawyer is saying that I need to go back to Virginia so i can apply for I-485.
Question:
1. Do i have to go back to the same state/location at I-485 filing stage where my Labor was originally approved?
2. Doesnot Green Card is for a future job?
3. Can i file I-485 while I am in California and my labor was approved for VA?
Please advise - thanks

People who are getting approved. Please post your notice received dates. It will help estimate if the USCIS is going by RD. Pappu says they are following FIFO but they are approving Feb and jan 2006 cases while 2005 PD is still waiting. Maybe they are going by RD FIFO. If we know the dates of people getting approved it will help.

If a visa availability date regresses, and an alien has already filed a Form I-485 based on an approved Form I-130 or Form I-140, USCIS should retain the Form I-485 and note the visa availability date at the time the Form I-485 was filed. Once the visa number again becomes available for that preference category, determine whether the beneficiary is a “child” using the visa availability date marked on the Form I-485. If, however, an alien has not filed a Form I-485 prior to the visa availability date regressing, and then files a Form I-485 when the visa availability date again becomes current, the alien’s “age” should be determined using the subsequent visa availability date."

Should I get another opinion? does USCIS send letter saying your child age is locked? we have received the EAD and AP.

There have been a number of publications that have shown that the vast majority of the "illegal" immigrants actually pay SS and Medicare taxes. They also contribute to federal and state tax regardless of the benefit that they receive from it.
Well it is against the law to employ illegals and this is enforced strictly, so we can forget about tax deduction at source, SS, etc. It will be minuscule. These so called publications are from their supporters which they have numerous of.
majority of the farmers especially in the South are willing to hire American workers but have had no success................ An American I met a few days ago was telling me about how he was unemployed for almost 3 years. He is a well educated person and didn't think it made sense for him to find low-skilled labor!
I am aware of that well publicized stunt. Do you know we have only 800K farm workers and 1.5 million farm workers were granted amnesty in 1986?
The only way to get cheap labor is with short term foreign contract labor, amnesty will never work, they have to return anyway.
The farmer will stop working in the farm, the day he gets his GC. Lets not compare an educated american. A citizen with no schooling would take the job at the right wage.
The reason there has been this huge push for health care reform is that it becoming a huge drain on the system. About 60% of bankruptcies in the US were due to medical bills.
There is no proof that the new bill will reduce costs at all! It will take many years to realize it anyway. Reform was needed but not at this moment when there were bigger issues that needed fixing in 6-12 months.
we, too, like the "illegals" contribute to a system that we cannot benefit from anytime soon. (Like social security and Medicare). We do need to push legislators to come up with a good immigration policy. Bashing another immigrant because they came here to do something different from you is not going to get us very far. Be compassionate towards those people too
We are not like illegals. The only one who is like them is an illegal employee at a gas station or grocery store.
My aim is not to bash them, I hope they can find a solution. Citizenship is not the answer and I'm tired of seeing all immigration bills partial to illegals. They should go to the back of the queue and get reform only after legal immigration is fixed. Their supporters are hampering our efforts. The sad news is they thought they could get amnesty like 86, but most will end up being deported.
Do you know of the 400,000 deported this year 50% were convicted criminals?
Compassion should be preceded by what is better for the US. There are millions of poorer people in Africa and India who need more help. These countries have better farmers too.
