The Federal government has a whole agency to protect people against such discrimination, and we are here speculating on nuances. If somebody denied you employment on EAD, just talk to them and see what they say. You don't need anything in writing.
Agree. Most of us are not lawyers. Why add another job duty? The only legal document that I ever sign concerning employment is the I-9. It say discriminating EAD is illegal, and should be reported. Just go with that to the govt. As it is we are spending so much time to just maintain legal status. Let DOJ, DHS do their job, and not worry about every single detail.
Tell me whats the point of IV fighting for multi-year EAD (maybe good news is around the corner) if employers won't take it.

I don't want to be a spoilsport.
But there is a possibility that EB2I has not yet retrogressed (inspite of heavy porting) because USCIS knows EB1C 12000 will flow to EB2 right. In that case we may not see movement of dates in par with 12000 spillover.
Maybe I am pessimistic.
In all calculations, it is mentioned that porting at max could be 6k/year. How did we come up with this number? Any proof or just a guess?
Thanks.
This is a very simple calculation. Following are the numbers before Oct -2006. These total to ~ 12K.
EB2-C - 3521
EB2-I - 9345
The dates will move further if more than 12K numbers are infused into the system. I would say that the dates should be in Oct - Nov 2006 range with these 12K numbers, having Nov as buffer as they may issue RFE's to folks.

I used the format below:
Dear Officer,
My case has been pending since September 2007. Below are the steps I have taken till now in order to get a decision on my case:
1: Initiated enquiry through my attorney.
2: Opened a service request with USCIS (Got an invalid response of no visa numbers available)
3: Made an Infopass appointment with an immigration officer.
None of the above has resulted in any clarity towards my case status.
Below are my case details- (Myself & spouse)-
Applicant name:
Application type: I-485
Category: Employment based EB2 (India)
Priority date:
Receipt number:
Spouse details:

I had the following questions on my case:
1: As my priority date is current, has my case been assigned to an Immigration officer.
2: When can I expect a decision to be made on my case as my case is pre-adjudicated.
If you need any additional details from me, I can be reached at email or phone @ phone number.

I will take you up on your offer. Can you please PM me the details on the e-mail/letter, or post here, whatever you feel comfortable with? Thanks!

Thanks guys .... for coming behind me .. Shane Warne or Purple Haze won't satisfy you guys .. Y dont we discuss how Kanimozhi's discontent couldn't play spoil sport for the new govt and how Azhagiri got cornered with chemicals and fertilizers (these 2 are not any interntaional fame for an american 'tunnel rat' to know abt them).
Above all I am here to get some information to bring a company which violates rules to authorities, nothing more nothing less and not here to do any name calling of mud slinging.
Good job. I see B1 visa violations in my client place where I work currently(will post it shortly in donor forum). Would you mind joining your state chapter so that we all know who you are?

Over the past couple of days I have had 10 of my friends/colleagues who have signed the letter and they have been mailed out to the president. I also have copies of them to mail out to IV once I have all that I can get..
I plan to call my Senators & Congressman's office's today too. I believe we need to get through to our friends and colleagues and talk about the issues in this letter. I have yet to come across one person who does not agree that our situation needs the attention of the administration.
I know I can get a few more of these letters signed by the end of this week.
Anyone out there who has more letters going out??:D
Lets have some healthy competition!
Your first post is outstanding. Welcome to IV. Please join your state chapter so that you can help in a more organized manner.
Thanks for all the help and support.

Great effort Saralayar. I just voted. Vote for this, everyone. This is the least we can do get on the radar. There are so many voices crying for attention --- please vote so that we may be heard.
It is very easy:
1. Go to http://citizensbriefingbook.change.gov/home
2. Register, by clicking on "sign in to get started now" (very quick --- no email verification steps, etc.)
3. Search for "Citizenship if you have lived legally in this Country for 10 years continuously" (without quotes), in the "find an issue you care about" search box
4. Vote by clicking on the up arrow.
Post a quick comment as well. This way we will draw more attention to it.
Could not find the link..Which page do I need to go on to vote.. I have searched about 500 pages.. Pls. advise..

Hi AndyCool,
How did you open Infopass on aug 5th, because once SR is created they say wait for 45 days before opening infopass, as in the page where we open infopass it asks for SR#?
Can you please share what option you selected in the web page when you tried to open a Infopass appointment.
Thanks

I just selected need Information thats all it has nothing to do with SR

It would have been ideal if they mandated 1:5 ratio. Unfortunately, with lax lending standards and unregulated banking, people made almost zero down payment (instead of the normal 20%) and bought into loans they couldn't afford in the first place.
I would still blame the borrower 95% for all the mess.
Almost similar except:
1. You can't sell with a single click on E-Trade
2. Unlike stocks You pay taxes on your house every year.
3. You are leveraged 1:5 in your investment.
4. Your real estate investment is based on debt while stock (with an exception of margin calls) is purely on cash.
5. In stock you can never loose more than you invested. (again margin calls are exception)
6. You don't pay to play or you don't constantly have to pay to keep what you have invested.
7. Govt don't give you tax breaks to buy stock.
8. Equity holders are never bailed out by govt.
That makes real estate much leveraged and bigger liability than stock could stock ever be. And somehow govt. wants to promote home owner society but discourage stock ownership or saving minded frugal individual investors like us.

cannot locate my wife's OPT card from 2003
all other documents for status are available
how important is that card?
any way to get a duplicate/copy??
you might be able to get a duplicate by contacting the college/university.
my case is somewhat similar, but I dont have that option: I was on L2-EAD and I cannot find that damn EAD card (needed for filing EAD based on I485). However I do have the older I-797 so can atleast prove status...

These Numbers are based on the Priority dates of the applicants who filed their Labor.
If you look into the India Category for EB2 and EB3 for July 2007, The Number of Applications filed as per the document are both 1655 and 893 respectively. During July 2007, the dates for EB2-I and EB3-I are current, the USCIS is bombarded with the applications.
I think the Document shows the applicants who started their green card (labor) process.
Thanks

One way "in which we can get more people involved on IV" is to remove some of the barriers to such participation. And the infamous red/green thingie comes to my mind.
Any updates on when IV is going to get rid of the red/green dot thingie?
Counting time after I140 approval towards citizenship proposal is already on our table for things to consider as a campaign. For Campaigns like this, we will need massive support than what we currently have. Even recent greencard holders can benefit from it.
So the first step before we undertake any big project is to get more membership base.
So let us first figure out ways in which we can get more people involved on IV. Without massive participation no campaign, letter/lobby/phonecall etc will work. We need to really go out of our way and spread the word around so that everyone that is stuck in this immigration mess can join this movement.

The moment I get sufficient number of people I am going all out.
But as a compromise, I have got a very simple and easy way out...I can tell you one thing, I do have a case which does not require any law change but just the interpretation of it.
Make sure that 5882 is successful. If it proceeds, I will back down. It is a shame that among 25K members raising 5K becomes a challenge.
This goes on to show there is no community. If there is not community then I have to look after my interest.
Stupid is as stupid does
How about going after EAD's, because of the 2007 july fiasco many people were fortunate enough to get an EAD, now they are competing with you in the job market....how about filing a law suit against that ? to cut the competion ....looks like you have plenty of time.

You are kidding right. I currently has - 20,000 points. So that would mean 20 k IV members did not like what i stated and yes that is 20 k within a week :D:D:D
I occasionally happen to say something they like to hear. I may criticize, but I try to appreciate where it is warranted. World doesn't run by criticism alone.
The plus point with you is, you never use abusive language and your arguments (at least for the most part) look sane and rational. I wish more intelligent people would interact with you so that the discussion results in some good knowledge being produced.
Apart from that, what I dont understand is that you say that unless spillover is fixed not even visa recapture can help EB3i. Are you familiar with the numbers for this?
