I do not think that is the cause anymore. All those people had PDs till Apr 2001. We are past that PD long back.
Yes, I agree that EB3-I is past 245K. Almost all of the retrogression years have gone in getting 245k filers and out of the system. Even then, situation is still grim.
Now this all my estimate….
There are about 10-12 thousand EB3-I I-485 applications for every year since 2002. With 3.5 thousand applications approved every year, it will take 3-4 years to move PD year by an year. To reiterate for every calendar year there will 3-4 months of real movement in PD.
Around June/July 2009 EB3-I will reach around March/April 2002 and then go back to Nov 2001 in October 09.
Hopefully FOIA result will disprove me in +ve way.

stamp problem is reported by "cowboy" for F. Heausner rececived @11 AM to 12:30 PM. He has the physical USPS receipt stamp dated June 29th.
Only good news is that USCIS ready to accept back application with their error. We have to send original application as it back to USCIS. They will honor the July 2nd RD also.

- W2 or Tax documents.... only a letter from the employer confirming AOS application

Hi friends,
My lawyer has replied to my Very strange I-140 RFE. My lawyer(Murthy) never got such RFE in their practice.
My LUD is changed 11/6 and 11/7. What does this mean? Are they working on my case on 11/6 and are they taking any decision on 11/7?

Hi,
What is the best way for an NRI to transfer money from India(rupees) to US bank account(dollars). I'll get some money (about 2 lakh rupees) from LIC money back policy. I have an NRE account but my parents cannot deposit this amount in rupees in India into this account, because only dollars can be deposited into NRE account. I will appreciate your suggestions.

I had a bad experinece with CitiNRI. They keep changing policies and I could not transfer my US$ to India. Moreover their site is very slow and very badly designed - I had a frustrating 4 years with CitiNRI - I closed it now.

I believe the new job has to be in same/similar occupation as the old one for which I-140 was approved. Does anyone know how same/similar is defined ?

I do have the problem with the way you have been responding to genuine questions posted by concerned people. From your post, it sounds like you know the facts and you are an expert, which you are NOT. But the other poor guy might think otherwise and be misled.
So if you know the answer then respond else don't. If you can't contain your urge to respond then use the words like "I think" , "I believe" or in a manner that refelcts your understanding , then no issues. Untill then I will continue to monitor you and refute every time you make a wrong statement.
By the way one of your comments almost landed someone in trouble.
You need to stop making rude comments. If you feel I have said something incorrect. Say it in a mature manner stop being rude!!

Everybody gave a good insight about what needs to be done.
We are going to mobilizing the lawmaker meetings at the state level.
I will write about the meet in detail later on.
Overall, it was a good meeting and lot of positives came out of it.

This website is great help to people who are in the queue of employment based immigration.
I apologies if my answer misguided any one.
I asked my lawyer specific regarding the fees about EAD and AP as I have filed with new fee structure and lawyer replied with confidence you have to pay fees...it was free only for first time.
We have just sent the applications in last week with fees....we are still waiting for receipts. Hope USCIS is not going to encash my checks I will update this thread later with what USCIS did with my checks.
This is lesson for me to not trust lawyar all the time.

I got an RFE too for both me and my wife (and we're not current either) ... wonder whats going on!
First of all, thanks for sharing the info! Some questions:
- When did they mail your RFE? (Mine was mailed on Oct 3 but havent recieved it yet)
- Did you receive it or did your lawyer recieve the RFE?
- Do you think a visa number has been assigned to your case or my case under Sept Bulletin?
- What do you think will happen after they recieve your response? Would they issue GCs or will they file the applications till your PD gets current again?
- Are you using a lawyer to respond to the RFE or are you doing it on your own?
- Would your lawyer charge for responding to RFE? (I'm under the impression that lawyer fees for RFEs are covered in the fees paid during 485 filing)

We did H1 transfer and planning to notify USCIS soon.

The employer is extremely shrewd. They have fraudulent policies and procedures. They said that they are not required to provide me an experience letter. They will take 3 months to provide you with your 1 month salary. They took a sweet 60 days to provide me the last but one paycheck(I called them for that like 100 times). Now, they simply don't send my last paycheck. Please refuse to deal with them at any cost like vermin they are...
