I went to the rally today. One person "looked drunk" was shouting at us to go back to our country, and a very old lady "90" in a tour bus, gave me a thump down. But never the less a lot of people cheered for us and honk thier horns to support us. I wished there was some clear and big sighn shows we are LEGAL here, not ILLEGAL. I bit a lot people didn't understand the diffrence including the senator who gave the speech.

My father had his appointment today. It was a tough day . First he didn't take the blue hdfc receipt and when he got to the line they told him they need the blue receipt and not the pink one. they allowed him to go and get a new one so my father deposited 7k again and got the new receipt
So after spending close to 15k, he finally went for the interview. the officer asked him only 1 question, what do you do? my father said he has his own buisness and then he asked 2-3 questions related to it. he was looknig at the computer most of the time so i assume he was looking at ds 160. my mother already has 10 yrs multiple entry visa and she came here twice so he asked abt her travel etc
at the end he said sorry we can't grant you a visa and they rejected the visa.

Our group, IV's, main goal has always been relief from Employment-Based GC's backlog ,relief from this clogged process.Our effort has always , whenever bills have been introduced in Congress, been clipped along with an increase in H1-b's resulting in a huge uproar from anti-immigrant community.
i know IV core group has this in mind and tries to achieve it and that is to have a separate bill crafted solely for the purpose of EB backlog reduction, to iron out the process. We all also have to address this whenever we write to a Senator or Representative. I am planning on doin' the same . Just Employment-Based GC relief. I expect most would concur with this idea of pure GC relief than an increase in H1-b numbers.

This is simply ridiculous. They have taken some things out of context from the CIR to come up with these few paragraphs in this statement. Things like illegals being required to play only 3 year back taxes etc. Its so obvious that it is plain politics.
Also, CIR is not for open borders. They care about national security as well. The House republicans call for Border security first is totally impractical ... It is much more practical to handle the Security in parallel with taking care of other Immigration matters. In fact addressing larger immigration issues like having a good guest worker program may take away the need for lots of un-necessary patroling along the borders.
There is a reason why CIR is called Comprehensive Immigration Reform. The Senators are much more sensible.
Also, where is the President's and the Senators voice in all this. All we are hearing is from the vocal House republicans Hestert, Bohener etc ...

Well - Murthy explained about the negative consequences that "sitting idle" on a early Green Card may cause but she didn't elaborate on H .
What i'm planning - since i informed my employer ( who is the actual H petitioner ) and they shrugged it off , i would pass the blame on them if anyone comes after me in future - what do you say ? Its not my responsibility to be aware of every intricate rules and laws and getback to USCIS - even i'm not supposed to advice my employer as well. Its probably employer or their lawyers responsibility to inform USCIS if they see any errors.
What do you say - will this input logic be sufficient to vindicate me in case someone comes down on me in Future ??

The company I used to work for earlier was a consulting company and whenever I go to India for stamping (Chennai) the company used to send me all these docs - everything in a bundle and I used to take them to consulate.
I went for stamping 2 times through that company, first time they asked me to show ONLY my tax returns and paystubs and asked me what I do and also recent paystubs and I got the visa.
Second time I went for an extension - they never bothered to see any document, they straight away issued the visa though I carried all documents listed.
Consuulting companies have to be ready to give you all documents needed and I do not see an issue.
If you are in a project - get letter from client manager - how difficult is it?

If USCIS goes to Ex-employer they can say anything. They can say we had a agreement ( though a Void one )with this fellow that he will be my chained slave( sorry for the word but that's how some employers expect you to be) for next 5 years and he ditched us using a EAD ....
USCIS should directly come to me/petitoner or the petitioner's approved attorney (as in G28) and ask for a FUTURE employment proof again as an RFE... The above should never happen...
Could you please tell a little more detail on this - Did USCIS send an RFE to Ex-employers attorney ( because his/her name in mentioned in G28) and that attorney in turn queried Ex-employer about this Particular Guy ??

Coming to the case:
My wife's H4 & I-94 expired on Feb 26th 2007 (Company A). We had applied her extension on May 21st 2007. We couldnt file extension before time as my wife was going thru her pregnancy and child birth. In this process we forgot.
Currently the H4 extension is still pending. When we realised that its too late and thot of sending her to India, we had to wait for approvals our new born son's SSN, US passport, Indian visiting visa and also on the health grounds (vaccinations etc).Now when we got all that, this 485 thing came up which is a big blessing for us.
I have my valid I-797 approval from Comapny B till May'08.
Now for applying 485 for my wife, I heard that we can file under section 245(k) if its still uner 180 days. My wife is still under 180 days. 180th day wud be Aug 23rd. My attorney doesnt have much detailed knowledge about it. Some how I managed to get in touch with her and requested to file under 245(k).
After my long story, Now my questions are :
1. Do we need to explicitly apply under sec 245(k), or if the applicant is out of status her application fall under the 245(k)?
2. If we have to apply under 245(k), what other documents,forms etc do we need?
3. **If my wife's 485 gets filed this week and we get a receipt notice after her 180 days? what wud be the scenario? Does she need to leave the country before 180 days? Can she leave without receipt notice?
4. Assuming my attorney doesnt know how to file under 245(k) and she applies as a normal 485 filing, what wud be the outcome?
These are some of the concerns we both are facing now and having sleepless nites. Can some one pls take some time and advice us. Appreciate it.

Did you complete your 6 years H1. Thats y you got H1 extn only for 1 year. If your I 140 approved you should have gotten for 3 years.

I seriously doubt that we will find the answer for this in these forums...
the lawyer in my co told my colleague that if u use AP to enter- that doesn't mean you have lost H1B status- u can get H1B stamped next time you go to your home country
So my colleague came back on AP
At the immigration counter- he clarified with the office
The office replied- "Are you kidding me?- Once on AP- always on AP. You cant use H1b anymore"
so thats how it ended up for him
So do your research- you will always find conflicting opinions\analysis\comments\suggestions...
The bottom line is- if you are conservative- remain on H1B
anything other than that is dependent upon your appetite for risk.
