    As long as I-485 is pending, I-485 applicant can chose what to do. Applicant is required to work (actually it is report to work in more strict terms) after I-485 is approved.

    Here is one example: F1 student files for I-485 under eb3 category for Chhoo Mantar, Inc. (fictitious name). he can continue study (or work on EAD or both) until I-485 is approved. Feel free to check this example with any attorney and may be then you can understand this.

    I am unable to decide if I agree or disagree with you but you sure have given some thought provoking things. For me IV , looks like the only hope and hence I would want this organization to succeed.

    One thing I noticed though your sentence structure and use of english language in general is quite good, an uncommon thing for a foreigner ,specially Indians. This makes me doubt if it is a job of a profesional. But again, it is possible.

    Also, you don't have sufficient credibility yet on the form but this does not mean that you cannot share you thoughts. As long as they are good for us and does not contain any malacious software.

    One thing , I can promise is to give some thoughts to your write up but this does not mean I will agree.


    All of us were frustrated (and still are) with the current immigration system. But in spite of a large community, no one had guts to speak out except handful of people. This reinforces that every cause needs leaders who are passionate about making a difference. The immigration voice was conceived by Aman and others to provide the leadership for this cause. This idea has now caught up big time in the skilled worker community resulting in recent rise of the group to become a formidable political and social force.


    In order to continue this fire one would need constant supply of leaders. Now that Aman has got his GC, will he still continue to work with same passion? We would like to believe that the answer is yes but please note that the original members of the group are no longer active. So, we as an educated community need to think and plan out ways to keep our struggle alive. For starters, please think about the following thoughts. Feel free to comment on these (without getting personal) and add to the list your own thought/ideas that can help our cause.

    Thought 1:
    I will love to see the current members continuing their work with same passion but on the other hand this is in a way �THANKLESS� job so it is alright if after getting their GCs, core members would like to focus on other priorities. Thus, it becomes important that appropriate succession plan is put in place. In other words, an organization structure is needed that can replenish any leadership vacuum.

    Thought 2:
    IV is a non profit organization that is run through contributions made by its members. There should be some transparency around money collected (revenue) and expenses. May be a quarterly financial statement is issued to the paying members. This will also help build credibility.

    People were too quick to give me bad ratings and judge me.
    I do not represent any organization and I am not a troll. But I do see something very valuable here that I am eager to preserve. I also see the point that disclosing financial information can be damaging. And no, not in my wildest dream I am questioning the leadership here. They have been amazing.

    My argument was if there is a need to build an accountability based system, which will serve to further our cause even if the current leadership is no longer active. As a matter of fact they are the ones (current leadership) who are in best position to create this type of system.

    I am still of the opinion that financial information should be disclosed but in light of the argument put forth earlier, I would modify my argument to include only high paying members (and not just paying members). These are basics of a governance model , which are also the foundation of a great organization.

    Hello All

    I am approaching 90 day mark by Sep 19th. I am preparing what I could do to to ensure I have EAD before the current one expires (October 18th)

    I think I qualify for expedited criteria under severe financial loss. Any one has exprience on what docs were given in support. I am thinking of following


    Letter from Employer that they'd have to terminate my employment
    Mortgage statement
    other expenses ( insurance, gas utilities)

    Any other suggestions on what I can do between now and Sep 19th ( 90 day mark). I am doing following


    took infopass appointment on 90 day mark.
    Writing to Senator and congressman in my area

    BTW, USCIS did not ask me any document for evidence. They approved the expedited request right away.

    It may even take more than 2 months to get receipts based on the SLUGGISH progress of USCIS!!

    to receive your GC, if you choose to do nothing about the broken process!

    hear hear!

    The point I'm trying to make that we must remain united to reach a goal, and comments that exclude some are not exactly tempting them to join the fight.
    We either keep the image of the IV as a multi cultural immigrant organization and fight to achieve our goals or rename it to IIV (Indian Immigration Voice) and deal with the Indian immigration issues only. Although all Indians, the IV core group maintained a multi-cultural approach until now and we should keep it this way. United we can achieve more and it would benefit everyone.

    I came to this country after marriage 8 years before. I was on H4 visa . My husband applied for I-485 in july fiasco . I got EAD & working as an IT tester for the past 16 months.

    Our relation had problems all the time recently only I know that he has a relationship with his colleague .They started living together. she is an american so he doesnt want I-485 GC & will cancel the I-485 application.
    We are living separate now & filed for divorce.
    What will happen to my I-485 status will it be revoked . I applied for I-485 as a dependant.

    I have 1 more year EAD .
    what will happen to status does my I-485 depends on my husbands I-485 .

    Pls advice me regarding this issue

    This is a just cause to be taken up by not just you or me individually but worthy of follow up by IV core....I am surprised, why IV core is not pursuing such an action item...

    Basically we need IV core to guide us and lead a initiative below -

    Drive for Transparent USCIS
    -------------------------------
    - Prepare a FOI request application with request for just the basic information above and nothing else (so as not to make it too complicated and delay the results of the request)

    - File ONE request as a non-profit organization on behalf of legal high skilled immigrants (rather than by individuals). So there is one request to track, and high profile than several individual requests

    - Make the request high profile, by spreading the news/email to congressmen, get their support, attestation/support mails etc if it makes sense and possible to do so.

    - May be take out some ads to spread the news of the FOI request after it gets filed. Or may be even take a small procession/rally and submit the FOI in person.

    - If signatures (either online or paper) are required from IV members to strengthen the case, I am sure every one of the 70000 strong members would be interested in the information and hence will promptly sign online or send signed mails etc


    This is a simpler (relatively speaking) first step that IV can pursue before possibly moving on to take legal steps like class action lawsuits etc that have been suggested in other threads.

    The reason I feel this should not be too hard for IV core to pursue (Please excuse me if I tend to oversimplify things)

    - Its going to cost very little money
    - no lawyers required
    - very little or no lobbying required (as opposed to huge effort we need for things like fighting for 5882 etc)
    - The initiative is not heavily dependent on actions/contributions on a large scale from IV members

    Most of these have been pain points in the past that IV core has brought to our attention. And since none of these are an issue in this particular initiative, at the same time the direct returns (transparency of USCIS internal status) are very useful and potentially the indirect returns (USCIS watches and treads carefully in future and honors FIFO) are huge, IMHO, this is really a worthy cause to pursue.

    And instead of some group of people trying to organize this by themselves, I feel it would be much better executed by the experienced group of people in IV core.

    And also recently there seems to be lots of intitiatives being proposed/organized (Whether or not to fruition is doubtful) by several different group of peoples in the forum.....sometimes causing division (Eb2 vs Eb3 etc). Its time for IV core to step in again, unite us all with one cause/initiatve that we all believe in and willing to support and lead us in good direction.

    Here is the update for my case:

    Today i received the physical notice.it is a NOID.although online status was showing denial notice sent.

    bacically I didn't file AC21 and my previous company revoked I-140(approved)

    Eligibility under section 204(j) of the act

    the service has determined that you are a benificiary of a visa petition under section 204(a)(1)(F),and that your form I-485 application was pending for more than 180days when the visa petition was revoked.However,absent from the record is evidence which demonstrates that you will be permanently employed in an occupational classification that is the same as ,or similar to,the occupation specified in the visa petition utilized as the basis of your adjustment.in the absence of such evidence,the record fails to demonstrate that you remain eligible for change of employment under section 204(j) of the act.Your application therefore may be denied.

    You hereby afforded an opportunity to respond to this intended denial and submit documentry evidence in support of your application for adjustment of status

    Evidence of section 204(j) Eligibility

    You must submit a letter from the new intended employer describing the permanent employment.This letter should include the job title,the specific duties of the position,the position's educational and /or training requirements,the date your employment first began and the offered wage or Salary.

    This letter shall be issued by an officer or executive within the organisation who is authorized to confirm the permanent job Offer

    I hope I just need to file AC21

    I have seen a lot of people immigrating to the US as "refugee" (real or fake), through the lottery, or via brothers or sisters. They are on social security once they arrive without having paid a penny of tax. Where did the money come from? From those EB workers who got stuck in the backlog!

    I don't see any reason why the EB system is what it is.

    We should all go on a protest for a day abstaining from work to draw attention to highly skilled EB immigrants, similar to what the illegal immigrants did last year. They shut down hotels, meat plants, car wash etc..that affected the common man but not the big business or the government..

    Let us strike and they will jump out of their slumber when IBM servers go down, NASDAQ and NYSE trading platforms go down, professors bunk classes or the big businesses suffer..we need to show our might..

    Maybe IV can organize something to draw attention????

    Any suggestions..

    The high-tech workers are one of the highest paid in the industry and they are all legal workers and contributing to the economy in every way. So by the looks of it, everything looks fine. So there is no reason to change laws that benefits someone else. Maybe we should do something that shows that all is not well. yes, what you are proposing may not be a bad idea.

    I am in the same boat and learnt from my company HR and attorney. I am assuming that you might have changed the employer in between H1B expiry and EAD.

    If the H1B is expired and one has started working on EAD, then for coming back to H1B status, one has to exit the country and come back with Visa stamped. The H1B change of employer won't be possible but counselor notification can be done.

    If you are working for the same employer, there might be some hope. However, Please consult it with your HR and attorney. Do not consider my comment as advice.

    Finally received the Denial notice.
    According to USCIS "we have filed our I485 on Oct 08, 2007 when there was no visa available."
    We filed our I485 in Aug. 2007, the receipt date on I485 receipt is Oct. 8 2007 but Notice date is Aug.10 2007.
    According to lawyer this is USCIS service error and should be resolved by filing MTR.
    Unfortunately we have to suffer because of USICS mistakes :mad: :mad:

    Don't know the denial reason just received the email.
